' •~ +~ .rr .~ ORDINANCE N0, 7 Series of 1988 "AN ORDINANCE VACATING A PORTION OF VAIL VALLEY DRNE, CONSTITUTING THE CUL-DE-SAC BETWEEN LOTS 7, $ AND 11, BLOCK 6, VAIL VILLAGE, 7TH FILING, TOWN OF VAIL. " WHEREAS, the owners of Lots 7, 8 and 11, Block 6, Vail. Village, 7th Filing, Town of Vail, have requested the Town of Vail to vacate a portion of Vail Valley Drive, constituting the cul-de- sac abutting said lots, which property is more particularly described on Exhibit "A", attached hereto and by this reference incorporated herein. WHEREAS, the said property described in Exhibit "A" has never been necessary for the public use and benefit; that the owners of the abutting lots and lands desire to improve said property described on Exhibit "A" and place the same on the tax rolls of the Town; and WHEREAS, the Board of Trustees of the Town of Vail has determined that such use will benefit the public interest; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF VAIL: Section 1. Vacation. That the portion of Vail Valley Drive constituting the cul-de-sac between Lots 7, 8 and 1~., Block 6, Vail Village, 7th Filing, Town of Vail, as more particularly described on Exhibit "A", be and , the same is hereby vacated and discontinued as a public street, and the same Shall be and become the property of the owners of the adjoining Lots 7, 8 and Z 1, Block 6, Vaal Village, 7th Filing, Town of Vaal, pursuant to the statutes in such case made and provided. ~..• . ti ,,•_ , ' r s Page # 2 Section 2. Reservations. That all. rights of way or easements for the continued use of existing sewer, gas, water, or other similar pipelines and appurtenances, and for electric, telephone and similar lines and appurtenances, and for other rights of way or easements in the above vacated property are reserved pursuant to the provisions of C.R. S, 1.963, 7.20-143. Section 3. Costs. It is further ordained that the cost of preparation, and publication of this Ordinance shall be paid by the owners of Lots 7, $ and 11, Block 6, Vail Village, 7th Filing, Town of Vail. April 8, 1,968 Mr, Blake Lynch Town Manager Town of Vail Vail, Colorado Dear Blaka: Confirming our telephone can~vexsation of this afternoon, I acu requesting that the Town of Vail vacate the twin-out on the north aide of Vail Valley Drive which was originally dedicated to service lot 8 0£ block 6 on ::he 7th filing. . On the first plat of Block 6, far lots 7,8 and 11, all these lots were to be serviced by this turn-out. Hawevex, in the current 7th filing, lot 7 and the wrest part of lot 8 have been re-plated into a single lot known ag 1ot E., and lot 11 and the east part of 8 have been re-plated into another single lot known as lot D. Thus, lot 8 has been eliminated, and there is no longer any need fax the turn-out access to the street. I am now purchasing the new Iot D which is all of ill and the east part of ~8 {the option has been signed and a cash deposit already made +~ith Rod Slifer.) We shall need to run our driveway acxoss the east half afthe turn-out in ordex to reach our property. Therefore, Y sea requesting that the Town of Vail vacate the east half of the dedicated turn-out and assign the Land over to us so that we may pxopexly put in our drive and landscape +~ maintain the land around it right up to the street right-of-way. Simultaneously, it~is my suggestion that the town of Vail. alas vacate the west half of the turn-out end assign that portion back to Vail essaciates as gars of the new lot B. Thus theturn-out will be eliminated, and myself and the eventual purchaser of new lot 1~ can properly landscape the vacated area up to the edge a£ Vail Valley Drive. Please have your Town Attorney properly e~cecute the necessary papers far this transfer of the land in question, and 1 will pay far all of the legal expenses which may be incurred to make the change. Also, I am milling to pay one half the cnst of moving the hydrant back out to the - edge of the road, Assuming that Vail.Assoeiates will pay the other half c - -- _ ' ~ ~ ~ .
