HomeMy WebLinkAbout1969-10 Vacating a Public Right of Way known as Hanson Ranch Road Lying between Gore Creek Road and Gore Creek Drive in the TOV..~ ORDINANCE NO. 10 (Series of 19b9) AN ORDINANCE VACATING A PUBLIC RIGHT-OF-WAY KNOWN AS HANSON RANCH ROAD LYING BETWEEN GORE CREEK ROAD AND GORE CREEK DRIVE IN THE TOWN OF VAIL and SETTING FORTH DETAILS IN RE- LATION THERETO. WHEREAS, a portion of Hanson Ranch Road within the Town of Vail, Colorado, lying between its intersection with Gore Creek Road and Gore Creek Drive, has not generally been used as a public right-of-way since the time of its dedication to the Town of Vail; and WHEREAS, adjacent property owners may put the portion of said roadway to beneficial use and assume the maintenance of said property; and WHEREAS, the Board of Trustees far the Town of Vail deem it in the public interest that said portion of Hanson Ranch Road, mare particularly described hereinafter, be vacated; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF VAIL, COLORADO: Section 1. That the fallowing described street right- of- way situate in the Town of Vail, County of Eagle, State of Colorado, be and the same is vacated, and the title thereto vested in those as set forth by the laws of the State of Colorado, to wit: A part of Hanson Ranch Road from Gore Creek Road to Gore Creek Drive as platted in Vail Village Fifth Filing, County o£ Eagle, State of Colorado, and more particularly described as follows: Commencing at a point on the Southerly line of Hanson Ranch Road, said point being the point of tangent of the South- easterly curve intersection of said Hanson Ranch Road and Gore Creek Road; thence Northeasterly along the Southerly ~ ~ ~ ,~ ~ ~. ~. Page 2 ~ Ordinance No. 10 line of said Hanson Ranch Road and along said tangent 32.94 feet to a point of curve; thence along said Southerly line and along a curve to the left having a xadius of 181.41 feet, a central angle of 47021' Ob", an arc distance of 149. 92 feet to a point of reverse curve; thence along said Southerly line and along a reverse curve to the right having a radius of 20.00 feet, a central angle of 90°00'00", an arc distance of 31.42 feet to a point of intersection with the Southwesterly line o£ Gore Creek Drive; thence on an angle to the left of I80°00'00" and along said Southwesterly line 80. 00 feet; thence on an angle to the left of 1$0°00'00" and along the Northwesterly line of Hanson Ranch Road and along a curve to the right 'having a radius of 20. 00 feet, a central angle of go°oo'ao", an arc distance o£ 31.42 feet to a point of compound curve; thence along said Northwesterly Line and along said compound curve to the right having a radius of 141.41 feet, a central angle of 47021'06", an arc distance of 116. 87 feet to a point of tangent; thence along said Northwesterly line and along said tangent 32.94 feet to a point of curve; thence along said Northwesterly line and along a curve to the right 'having a radius of 20. 00 feet, a central angle of g0°00'00", an arc distance of 31.42 feet to a point of intersection with the Northeasterly line of Gore Creek Road; thence on an angle to the left of 180°00'00" and along said Northeasterly line 80. 00 feet; thence on an angle to the left of 180°00'00" and along the Southeasterly line of Hanson Ranch Road and along a curve to the right having a radius of 20. 00 feet, a central angle of 90°00'00", an arc distance of 31.42 feet to the true point of beginning; con- taming 8, 579. 05 square feet, more or less. Section 2, The within vacation is not t° be construed as ever being constructed within any portion of the right-of- way vacated by virtue of this ordinance. Section 3. That as the above-mentioned street right- of-way is no longer needed for street purposes and as said street vacated herein constitutues an unnecessary buxden on the abutting pxoperty, in the opinion of the Board of Txustees of the Town of Vail an emergency exists and this ordinance is deemed necessary for the preservation of the public peace, health,, welfare and shall, therefore, take effect irru~nediately upon its passage as an emergency measure and be published as such in accordance with the laws of the State of Colorado.
