"AN ORDINANCE VACATING A PORTION OF
VAIL VALLEY DRIVE; CbNSTITUTING TTdE
CUL-DE-SAC BETWEEN LOTS ?, 8, AND 11,
BLOCK 6, VAIL VILLAGE, 7TH FILING,
TOWN OF VAIL,. "
ViIHEREAS, the owners of Lots 7; ~s, ~;nd 11, flock 6,
Vail V' ~llage, 7th Filings .Town of Nail, have requested the Town
of Vail to ~~racate a portion of Vail Valley Drive, constituting the
aul-de-sac abutting said lots, and;
WHE~iEAS, the said property referred to in this
ordinance has never been necessary for the public use and bene-
fit; that the owners of the abutting lots and lands desire to improve
said property described herein and place the same on the tax
rolls of the Town; and
VtiTrIEREAS, the Baard of Trustees of the Town of Vail
has determined that such use will benefit the public interest;
NOW, THEREFORE, BE IT ORDAINED BY THE $OARD
OF TRUSTEES OF THE TOWN OF VAIL:
Section 1, Vacation.
That the portion of Vail Valley Drive constituting the
cul-de--sac between Lots 7, a, and 11, Block 6, Vail V liage,
7th Filing, Town of Vail, be and the same is hereby vacated and.
discontinued as a public street, and the same shall be and becorne
the property of the owners of the adjoining Lots 7, b, and 11,
Block 6, Vail Village, 7th Filin;;, `T'own of Vail, pursuant to the
statutes in such case made and provided.
S~:ction 2. Reservations.
That all ri.~~hts of way or easements for the continued
use of existing sewer, yas, water, or other similar pipelines and
appurtenances, and for electric, telephone and similar lines and
appurtenances, and far other rights of way ar easements in the
above vacated property are reserved pursuant to the provisions
of C. R, S, 1968, 12.)-14-3.
Section 3. Repeal of Prior Ordinance.
The incent and purpase of this Ordinance is to amend
and correct Ordinance No, 7, series of 1968, of the Ordinances
of the Town of Vail, and to effectuate said purpose said Ordinance
is hereby repealed on the effective date of this Ordinance.
