SERIES OF 19~r1 • • AN ORDINANCE FOR THE REGULATION tlF TRAFFIC WITHIN THE TOWN OF VAIL, ADOPTING BY REFERENCE THE "MODEL TRAFFIC CODE FOR COLORADO MUNICI- PALITIES", AS APPROVED AND PUBLISHED IN 1970 BY THE DEPARTMENT OF HIG~iWAY5 OF THE STATE OF COLORADO AND INCLUDING IN SAID CODE REFERENCES TO A SECONDARY CODE OFFICIALLY TITLED "UNIFORM TRAFFIC CONTROL DEVICES" OF CURRENT ISSUE ALSO PUBLISHED BY THE STATE DEPARTMENT OF HIGHWAYS; MAKING AMENDMENT TO SAID CODE; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; AND SETTING FORTH DETAILS IN RELATION THERETO. WHEREAS, the Board of Trustees for the Town of Vail have previously adopted by reference the "Model Traffic Code for Colorado Municipalities", 1966 Edition, for the regulation of traffic within the Town of Vail; and WHEREAS, the Department of Highways for the State of Colorado has revised said "Model Traffic Code" in 1970, and the Board of Trustees for the Town of Vail deems it in the interest of the public safety and welfare to adopt such revised "Model Traffic Code", in its revised form for the regulation of traffic within the Town of Vail. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF VAIL, COLORADO: SECTION 1. ADOPTION BY REFERENCE, DELETIONS AND AM E iv liN1t; N'1' S Pursuant to Article 34 of Chapter 139, Colorado Revised Statutes (1963), as amended, there is hereby adopted for the purposes of regulating traffic within the Town of Vail, Colorado, that certain primary code known as the "Model Traffic Code for Colorado Municipalities", as revised in 1970, embodying references to a secondary code of traffic control devices as jointly described in the title of this Ordinance of which three (3) copies of both primary and secondary codes, together with traffic control sched- ules for designated streets have been filed in the office of the Town Clerk, the same being adopted as if set forth herein in full and complete detail, subject to the following deletions and amend- ments: A. Deletions: 1. Article XIV is hereby deleted in its entirety. 2. Article XVII, Sections 2 through 9 are hereby deleted. 3. Article XXI, Section 5 is hereby deleted. 4. Article XVIII, Section 1 (c) is hereby deleted. B. Amendments 1. Article XIII, Section 1 is hereby amended by changing the words, rand then only for a period not to exceed 3 minutes." to "and then only for a period not to exceed 10 minutes." • • • • • 2. Article XXII is hereby amended by the addition of Section 23, to read as follows: "Sec. 22-23. Penalty Assessment Schedule--The Penalty assessment and the nature of the violation for which said penalty assessment may be made by the arresting; officer and accepted and paid by the violator under the privileges of this section shall be as herein set forth, to-wit: SPEEDING SPECIAL HAZARDS CARELESS DRIVING ON WRONG SIDE OF STREET OR IN IMPROPER LANE IMPROPER PASSING FAILURE TO YIELD RIGHT OF WAY FAILURE TO STOP AT STOP SIGN IMPROPER TURNING FOLLOWING T00 CLOSELY FAILURE TO COMPLY WITH INSPECTION LAW IMPROPER PARKING PARKING IN FRONT OF FIRE PLUG PARKING TO IMPEDE NORMAL FLOW OF TRAFFIC IMPROPER EQUIPMENT tHOP.r1, MUFFLER, REAR VISION MIRROR, WINDSHIELD WIPER, BRAKES, AND OTHERS) WRONG WAY ON A ONE-WAY STREET $15.00 5.00 20.00 10.00 10.00 10.00 15.00 10.00 10.00 5.00 3.00 5.00 5.00 5.00 10.00 The schedule defined and set forth in this Section 23 hereof shall not apply to any violation of said Ordinance which is tried in any court." 3. Article XXI_V, Section 1 (b) is hereby deleted and amended to rca~ as follows: "(b) The Traffic Violations Bureau is designated as a Bureau of the Police Department which shall be in charge of its operation. The Traffic Violations Bureau shall be open on such days and at such hours as may be established by the Police Department." SECTION 2. APPLICATION OF ORDINANCE This Ordinance and the Municipal Traffic Code shall apply to every street, alley, sidewalk or sidewalk area, drive- way, park and to every public or private way and public parkih.g area, whether within or outside the corporate limits of the Town, the use of which the Town has jurisdiction and authority to regulate . SECTION 3. VIOLATIONS AND PENALTIES THEREOF It shall be unlawful for any person to violate any of the provisions of the Municipal Traffic Code as adopted and amended herein, or of any provision of this Ordinance and any such violation shall be punishable as hereinbefore provided. Every person convicted of a violation of any provision of the Municipal Traffic Code or of any provision of this Ordinance shall be pun- ished by a fine of not more than three hundred dollars ($300.00) or by imprisonment for not more than ninety t90) days, or by both such fine and imprisonment. SECTION 4. FILING COPIES After the effective date of the adoption of the Munic- ipal Traffic Code, three copies certified to be true copies by the Mayor and the Town Clerk shall be filed in the Office of the Tawn Clerk oahere they shall be kept for public inspection during regular office hours while this ordinance is in force. -2- ~~ • ~ • • ~ SECTION 5. REPEAL This Ordinance shall be in full force and effect after its approval by the Board of Trustees and final publication as prescribed by law, and shall supersede all previously adopted Municipal Traffic Codes as amended. Upon the effective date of this Ordinance, the Board of Trustees specifically repeals Ordi- nance No. 7, Series of 1967. SECTIOIvT 6. SEVERABILITY r It is the intention of the Board of Trustees that this Ordinance or any part or provision thereof, shall be considered severable and, if any provision of this Ordinance or the applica- tion thereof to any person or circumstance i:s held invalid, such invalidity shall not affect other provisions or applications of the Ordinance which can be given effect without the invalid pro- vision or application, and to this end the provisions of this Ordinance are declared severable. SECTION 7.
