SERIES OF 1971 AN ORDINANCE FOR THE ADOPTION BY REFERENCE OF THE "UNIFORP4 BUILDING CODE", 1970 EDITION, VOLUME I, AND "UNIFORM MECHANICAL CODE", 1970 EDITION (DESIGNATED "UPdIFORM BUILDITG CODE" , VOLUME II) , AP1D "Ur1IFORM PLUMBING CODE", 1970 EDITION, AND THE "NATIONAL ELECTRIC CODE", 1968 EDITION, REGULATING THE CONSTRUCTION, AL- TERATION, REPAIR, REPIOVAL, DEMOLITION, EQUIPMENT, USE ArTD OCCUPANCY, LOCATION AND MAINTENANCE OF BUILDINGS OR OTHER STRUCTURES fiERETOFORE OF HEREAFTER ERECTED IN THE TOWN OF VAIL; PROVIDING FOR TFiE ISSIIANCE OF PERMITS AND COLLEGTIOP~ OF FEES THEREOF; AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF; MAKING AMENDMENTS TO THE FORE_ GOING CODES; AND SETTING FORTH DETAILS IAT RELATIOAT THERETO: WHEREAS, the Board of Trustees for the Town of Vail has studied in considerable detail the needs within the Town of Vail for the adoption of certain codes and regulations relating to construction of buildings within the Town; and WHEREAS, the Board of Trustees considers it in the pub- lic interest to adopt building, plumbing and electrical codes and other regulations relating to construction within the Town of Vail for the public health, safety and welfare; NOW, THEREFORE, BF IT ORDAIATED BY THE BOARD OF TRUSTEES FOR THE TOWN OF VAIL, COLORADO: SECTION 1. ADOPTION OF THE BUILDING, PLUMBING, AND ELECTRICAL CODES_ - _ _ _ - - - - - -- - - -- ---- Pursuant to Chapter 139, Article 34, Colorado Revised Statutes, 1963, as amended, there is hereby adopted as the Building, Plumbing, and Electrical Codes of the Town of Vail for regulating the construction, alteration, repair, removal, demolition, equip- ment, use and occupancy, location and maintenance of buildings or other structures heretofore or hereafter erected in the Town of Vail, those certain documents, three (3) certified copies of each which are on file in the office of the Town Clerk, Town of Vail, Colorado, being titled, marked and designated as the "Uniform Building Code", 1970 Edition, Volume I, and "Uniform Mechanical Code", 1970 Edition, (Designated "Uniform Building Code", Volume II), published by the International Conference of Building Of- ficials, and hereinafter referred to as the Building Code; and the "Uniform Plumbing Code", 1970 Edition, published by the Inter- national Association of Plumbing and Mechanical Officials, and hereinafter referred to as the Plumbing Code; and the "National Electrical Code", 1968 Edition, published by the National Fire Protection Association, and hereinafter referred to as the Electri- cal Code. SECTION 2. DELETIONS, AMENDMENTS, AND CHANGES The adoption of the Bu~_lding, Plumbing and Electrical Codes is subject to the following deletions, substitutions, amend- _~ ments and changes: AMENDMENTS TO THE 1970 BUILDING CODE, VOLUME I Section 201 is herebv amended to read as follows: "The Board of Trustees of the Town of Vail hereby creates the office and position of. Building Official. The Build- ing Official shall be appointed by, and serve at the pleas- ure of the Board of Trustees of the Town of Vail, but in no event shall his appointment continue beyond one week • • • • • after the qualification of the members of the Board of Trustees for office following t?leir election as pre- scribed by law. ~t such time the Building ~ffi.cial may be reappointed. The. functions, res~onsihilities and duties of the Building official shall be the same as those set forth in the Building Code.° Section 303 (a) Building Permit Fees is hereby amended by deletinn the first part of 'T'able T'o. 3- A, and adding, `"`inimum building permit fee shall be $10.00. Section 303 is hereby amended by adding the follo~°~in~ nara~raph, ''(c) Cleanup T1enosits. '' . • ~ ~ ~ • Section 2314 (a) General. is hereby amended by adding the words, "for seismic zone 1" at the end of the first sentence in the first paragraph. Section 2517 (f) Firestopping. 2+ is hereby amended by deletion of said paragraph and substitution of the words, "In all stud walls and partitions, in- cluding furred spaces, so placed that the maximum di- mension of any concealed space is not over eight feet (8'-On) ~~ Section 2905 (a) General. is hereby amended by adding the following: EXCEPTIONS: 1. In lieu of extending footings below the frost line, one of the following may be used but in no case shall the footings extend less than three feet, six inches (3'-6") below finish grade. a) Place footings on sand or gravel, minimum of six inches (6") thick, compacted to a minimum of ninety-five percent (95~) and to a minimum depth equal to the least lateral dimension of the footing. b) Place footings on a minimum of four feet (4'-0") in width and six inches (6") thick, of ninety- five percent (95a) compacted sand or gravel backfill, the minimum width of the backfill to be depth plus the width of the footings, except where the water table is within the depth of frost penetration in which case the footings shall extend below the frost line. c) Place the footings at a depth and in such soil wherein allowable soil bearing pressures may be calculated as prescribed elsewhere in this code. Section 3305. (a) General. EXCEPTION: is hereby amended by adding the words, "Circular stairs and/ or ships ladder shall be allowed in H and I Occupancies when serving an area of not more than one hundred twenty (120) square feet." Section 3305 (n) Stairway to Roof. is hereby amended by deletion of said paragraph and substitution of the words, "In every building two or more stories in height, a steel ladder shall be provided for access from floor of top story to roof surface unless roof has a slope greater than four (4) in twelve (12). Rails of ladder shall extend a minimum of three feet (3') above roof. Location of ladder shall have the approval of the Town of Vail Fire Chief. A required stair may be continued to the roof in lieu of ladder." Section 3309 (b) Enclosure Construction. is hereby amended by deletion of said paragraph and sub- stitution of the words, "In buildings five or more stories in height, one of the required exits shall be a smokeproof enclosure." Section 3804 (b) Where Required. is hereby amended by changing the fifth line from, "and H Oc- cupancies four or more stories in height;" to "and ri Occupancies three or more stories in height;". -3- ~ • • • ~ AMENDMENTS TO~THE 1970 UNIFORM PLUMBING CODE Part Two - Qualification of Plumbers is hereby amended by deletion of said paragraph and substitution of the words, "All licenses required by this Code shall be as required by the State of Colorado." AMENDMENTS TO THE 1968 T?ATIONAL ELECTRICAL CODE Article 348 Electrical Metallic Tubing is hereby amended by deletion of the first sentence and substitution of the words, "Electrical metallic tubing shall be the minimum used for both exposed and concealed work in all buildings except single family residences." SECTION 3. DECLARATION OF VIOLATION It shall be unlawful for any person, firm or corporation to construct, alter, repair, remove, dEmolish, equip, use, occupy or maintain any building or structure in the Town of Vail, or cause the same to be done, contrary to or in violation of any of the provisions of the Building, Plumbing, and Electrical Codes. SECTION 4. PENALTIES Any person, firm or corporation violating any of the provisions of the Building, Plumbing, and Electrical Codes in- corporated herein or other provisions of this Ordinance, shall be deemed guilty of a misdemeanor, and such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of the Building, Plumbing, and Electrical Codes, or of this Ordinance, is committed, continued, or permitted, and upon conviction of any such violation such person, firm or corporation shall be punish- able by a fine of not more than $300, or by imprisonment for not more than ninety (90) days, or both such fine and imprisonment. SECTION 5. FILING COPIES After the effective date of the adoption of the Building, Plumbing, and Electrical Codes, three copies of each, certified to be true copies by the Mayor and the Town Clerk, shall be filed in the office of the Town Clerk where they shall be kept for public inspection during regular office hours while this Ordinance is in force. SECTION 6. PUBLIC HEARING A public hearing on the adoption by reference of the "Uniform Building Code", 1970 Edition, Volume I, and "Uniform Mechanical Code", 1970 Edition, (Designated "Uniform Building Code", Volume II) published by the International Conference of Building Officials, and hereinafter referred to as the Building Code; and the "Uniform Plumbing Code", 1970 Edition, published by the International Association of Plumbing and Mechanical Of- ficials, and hereinafter referred to as the Plumbing Code; and the "Pational Electrical Code", 1968 Edition, published by the National Fire Protection Association, and hereinafter referred to as the Electrical Code, is hereby scheduled for 7:30 o'clock p.m. on Monday, February 22, 1971, before the Board of Trustees of the Town of Vail in the Vail Elementary School Building (above the Vail Clinic) in the Town of Vail, Colorado; and the Town Clerk is hereby directed to publish notice of said public hear- ing in the manner and style as provided by the applicable statutes and to publish notice as prescribed in C.R.S. 1963, 139-34-3, as amended. -4- `~~ . ~ ~ • t SECTION 7. EFFECTIVE DATE AND REPEAL OF PRIOR ORDINANCES This Ordinance shall be in full force and effect after its approval by the Board of Trustees and final publication as prescribed by law, and shall supersede all previously adopted `,~ Building Codes as amended. Upon the effective date of this Ordinance, the Board of Trustees specifically repeals Ordinance ..~. No. 6, Series of 1969, Ordinance No. 9, Series of 1969, Ordinance No. 11, Series of 1970, and Ordinance P1o. 12, Series of 1970. SECTION 8. SAFETY CLAUSE The Board of Trustees hereby finds, determines, and declares that this Ordinance is necessary and proper to provide for the safety, preserve the health, promote the prosperity, improve the morals, order, comfort and the convenience of the Town of Vail and the inhabitants thereof. SECTION 9. SEVERABILITY It is the intention of the Board of Trustees that this Ordinance or any part or provision thereof, shall be considered severable and, if any provision of this Ordinance or the applica- tion thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the Ordinance which can be given effect without the invalid pro- vision or application, and to this end the provisions of this Ordinance are declared to be severable.
