ORDINANCE N0. 8
SERIES OF 1971
AN ORDINANCE ESTABLISHING FIRE LANES; REGULATING
THE USE OF SAME; ESTABLISHING EMERGENCY PROCEDURES;
PROHIBITING PENALTIES FOR VIOLATIONS; AND SETTING
FORTH DETAILS IN RELATION THERETO.
WHEREAS, the Board of Trustees for the Town of Vail has
determined that it is in the interest of public safety and the
welfare of the inhabitants of the Town of Vail to create fire
lanes within the Town for the purpose of facilitating greater
safety measures in dealing with fires or potential fire hazards;
and
WHEREAS, the Police Department for the Town of Vail and
the Board of Directors for the Vail Fire Protection District have
recommended the creation of fire lanes within the Town of Vail,
as well as certain procedures regarding the regulation of such
fire lanes;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
FOR THE TOWN OF VAIL, COLORADO:
SECTION 1. DEFINITIONS
A. "Fire Lane" shall be any public right
of way, including streets, alleys, and other thorough-
fares, as well as privately owned land, not otherwise
dedicated to public use, which is officially designated
by the Board of Trustees, as herein provided, as a fire
lane. The purpose of such fire lanes herein established
is to provide access to structures in order to more ef-
fectively combat fires or deal with other hazards which
may occur in such structures.
B. "Fire Lane Map" shall be the official
map maintained by the Town Clerk of the Town of Vail
indicating the exact locations of the fire lanes es-
tablished by the Board of Trustees pursuant to the pro-
visions of this ordinance.
C. "Fire Prevention Code" shall mean Or-
dinance No. 2 (Series of 1969) adopted by the Board of
Trustees for the Town of Vail and any subsequent revi-
sions or amendments thereto duly enacted by the Board
of Trustees.
SECTION 2. ESTABLISHMENT OF FIRE LANES
There are hereby created within the Town of
Vail fire lanes as herein defined as shown and otherwise
indicated in the official fire lane map, which is referred
to and incorporated herein by reference. Said fire lane
map is hereby declared to be a part of this ordinance.
SECTION 3. IDENTIFICATION OF OFFICIAL MAP
The official fire lane map shall be main-
tained by the Town Clerk and shall be located in the
office of the Town of Vail and shall be identified by
the signature of the Mayor, attested by the Town Clerk,
and shall bear the official seal of the Town of Vail.
Said map shall also bear the certification that it is
the official fire lane map and shall refer to this or-
dinance establishing fire lanes as indicated on said
fire lane map.

SECTION 4. CHANGES IN FIRE LANE MAP
From time to time after the adoption of
this ordinance, the Board of Trustees for the Town
of Vail may alter or revise the official fire lane
map by adding, deleting or otherwise changing the
fire lanes indicated on the fire lane map by ordinance
duly enacted in accordance with the laws of the State
of Colorado. At such times as the Board of Trustees
adopts changes in the official fire lane map, said
map shall immediately be changed to reflect the ad-
ditions, deletions or alterations adopted by the Board
of Trustees so that said map shall at all times accu-
rately portray and reflect the status of fire lanes
in accordance with this ordinance.
SECTION 5. PARKING PROHIBITED TN FIRE LANES
Upon the establishment of fire lanes, in
accordance with this ordinance, signs shall be posted
in all such fire lanes bearing the words, "FIRE LANE -
NO PARKING AT ANYTIME". Parking of any vehicle shall
be prohibited in all such fire lanes at all times, and
enforcement of this ordinance shall be strictly admin-
istered by the Vail Police Department. No person shall
stand or park any vehicle within a fire lane as es-
tablished by the ordinance or in any way obstruct said
fire lane. Enforcement of this ordinance shall be ap-
plied in order to implement provisions of the Fire Pre-
vention Code for the Town of Vail.
SECTION 6. IMPOUNDING OF VEHICLES
Any police officer of the Town of Vail,
upon finding a vehicle, whether attended or unattended,
standing or being parked within a fire lane shall require
such vehicle to be removed or cause the same to be re-
moved and be impounded, and the owner or operator of
said vehicle shall be liable for the cost of such removal
and impounding, in addition to any other penalties im-
posed by this ordinance.
SECTION 7. PENALTIES
It shall be unlawful for any person to
violate any provisions of this ordinance. Every person
convicted of a violation of any provision of this ordi-
nance shall be punished by a fine of not more than Three
Hundred Dollars ($300.00) or by imprisonment of not more
than ninety (90) days or both such fine and imprisonment.
SECTION 8. SEVERABILITY
It is the intention of the Board of Trustees
that this ordinance or any part or provision thereof,
shall be considered severable and if any provision of
this ordinance or the application thereof to any person
or circumstance is held invalid, such invalidity shall
not affect other provisions or applications of the or-
dinance which can be given effect without the invalid
provision or application, and to this end the provisions
of this ordinance are declared severable.

SECTION 9. EMERGENCY
It is declared that an emergency exists
and that this ordinance is necessary for the immediate
preservation of the public peace, health, safety and
general welfare, and shall be in force and effect five
(5) days after publication.
