HomeMy WebLinkAbout1971-18 Amending 1966-17, relating to the use and occupancy of campers and trailers within the TOV, Designating Temporary Facilities within the TOV for the Temporary Parking of Same~ • . ~ • ORDINANCE NO, {~ SERIES OF 19~ AN ORDINANCE AMENDING ORDINANCE NO. 17, SERIES OF 1966, RELATING TO USE AND OC- CUPANCY OF CAMPERS AND TRAI LERS WITHIN THE TOWN OF VAIL; DESIGNATING TEMPORARY FACI C- ITIES WITHIN THE TOWN OF VAIL FOR THE TEM- PORARY PARKING OF SAME; AND SETTING FORTH MATTERS AND DETAILS IN REI.~,TION THERETO. WHEREAS, the Board of Trustees for the Town of Vail has previously passed and adopted Ordinance No. 17 (Series of 1966) on or about the 20th day of November, 1966, which, among other matters, sets forth certain provisions relating to campers and trailers, specifically in Article VI , Section 3; and WHEREAS, it has become a matter of public necessity and convenience to permit within the Town of Vail the overnight use of campers and trailers for the inhabitants of and visitors to the community; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES FOR THE TOWN OF VAIL: SECTION 1 . Amendment relating to campers and trailers. Article VI, Section 3 of Ordinance No. 17 (Series of 1966) shall, and the same is hereby amended by deleting said section and sub- stituting therefore the following: It shall be unlawful for any person to sleep, spend the night, cook or establish a place of abode in any vehicle, trailer, or camper on any public street, way, sidewalk, or place within the Town of Vail, except the main park- ing lot at Vail/Lions Head, described as Lot 1 , Block 2, Vail/Lions Head First Filing, according to the recorded plat of same filed with the Town of Vail, County of Eagle, State of Colorado, which shall be the only designated place for the temporary parking of such vehicles referred to herein. In no event shall any vehicle, trailer, or camper be parked or stored in the designated area for a period in excess of ten (10) days . SECTION 2. Reference to prior ordinance. In all other respects and particulars, the provisions of said Ordinance No. 17, (Series of 1966) shall be and remain as originally adopted by the Board of Trustees for the Town of Vail, subject to prior amendments enacted by the Board of Trustees. SECTION 3 . Separability of Provisions . If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Board of Trustees for the Town of Vail hereby declares it would have passed this ordinance and each part, section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more other parts, sections, subsections, sentences, clauses or phrases be declared invalid. SECTION 4. Declaring an Emergency. The Board of Trustees find that this ordinance is necessary ~ • • • ~ for the protection of the public health, welfare and safety; that this ordinance shall become effective upon its introduction and adoption and shall be published in accordance with the laws of the State of Colorado.
