AN ORDINANCE RELATING TO MUNICIPAL HOME RULE FOR
THE TOWN OF VAI L, INITIATING THE ADOPTION OF A HOME
RULE CHARTER, AND PROVIDING FOR THE ELECTION OF
MEMBERS TO A CHARTER COMMISSION; AND SETTING FORTH
MATTERS AND DETAI LS IN RELATION THERETO.
WHEREAS, the General Assembly for the State of Colorado has en-
acted the "Municipal Home Rule Act of 1971", otherwise referred to as Chapter
139, Article 90 of the Colorado Revised Statutes (1963), as amended, for the
purpose of implementing Section 9 of Article XX of the Constitution of the
State of Colorado, which authorizes the Board of Trustees to initiate by ord-
inance the adoption of a Home Rule Charter; and
WHEREAS, the Board of Trustees for the Town of Vail wishes to
avail itself of the procedures available to initiate the adoption of a Home Rule
Charter for the Town of Vail; and
WHEREAS, the Board of Trustees for the Town of Vail finds that it
is in the public interest of said town to adopt a Home Rule Charter which will
facilitate an improved form of government for said town;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
FOR THE TOWN OF VAI L:
SECTION 1 , Initiation of Home Rule Procedure.
The following question shall be submitted to a vote of the qualified
electors of the Town of Vail, in accordance with the provisions of Article XX
of the Constitution of the State of Colorado and the "Municipal Home Rule
Act of 1971" , at a special election to be held on the 18th day of April, 1972:
"Shall the Town of Vail form a Home Rule Charter Commission?"
SECTION 2, Commission Members.
At such election, referred to in Section 1 herein, the qualified electors
may elect a total of nine (9) members at large to serve on the Charter Commission,
in accordance with the "Municipal Home Rule Act of 1971 ." If a majority of the
qualified electors voting on the question referred to herein vote for forming the
Charter Commission, a commission to frame a charter shall be deemed formed.
SECTION 3, Notice of Election.
A notice of the election referred to in this ordinance shall be published
on February 10, 1972, and on March 18, 1972, with the second notice including
the names of all candidates for the Charter Commission who shall have qualified
and complied with the provisions of the "Municipal Home Rule Act of 1971 ."
SECTION 4. Effective Date,
This ordinance is necessary for the immediate preservation of the
public health and safety for the specific reason that it is necessary to implement
at the earliest possible date a Home Rule Charter for the Town of Vail in order

to properly provide for the safety of the inhabitants as well as to preserve
the health and promote the prosperity, order and comfort of the inhabitants
of said town; therefore, this ordinance shall take effect in five (5) days fol-
lowing publication of same.
SECTION 5 . Separability of Provisions .
If any part, section, subsection, sentence, clause or phrase of this
ordinance is for any reason held to be invalid, such decision shall not affect
the validity of the remaining portions of this ordinance; and the Board of
Trustees for the Town of Vail hereby declares it would have passed this
ordinance and each part, section, subsection, sentence, clause or phrase
thereof, irrespective of the fact that any one or more other parts, sections,
subsections, sentences, clauses or phrases be declared invalid .
