AN ORDINANCE FOR THE REGULATION OF TRAFFIC
BY THE TOWN OF VAIL COLORADO FOR THE PURPOSE
OF PROVIDING A SYSTEM OF TRAFFIC REGULATIONS
CONSISTENT WITH STATE LAW AND GENERALLY CON-
FORMING TO SIMI LAR REGULATIONS THROUGHOUT THE
STATE AND THE NATION; ADOPTING BY REFERENCE THE
1971 EDITION OF THE "MODEL TRAFFIC CODE FOR COL-
ORADO MUNICIPALITIES;" REPEALING ALL ORDINANCES
IN CONFLICT THEREWITH; AND PROVIDING PENALTIES
FOR VIOLATION THEREOF.
WHEREAS, the Board of Trustees for the Town of Vail have
previously adopted by reference the "Model Traffic Code for Colorado
Municipalities", 1970 Edition, for the regulation of traffic within the
Town of Vail; and
WHEREAS, the Department of Highways for the State of Colorado
has revised said "Model Traffic Code" , and the Board of Trustees for
the Town of Vail deems it in the interest of the public safety and welfare
to adopt such revised "Model Traffic Code" , in its revised form for the
regulation of traffic within the Town of Vail.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES FOR THE TOWN OF VAI L, COLORADO:
SECTION 1 . ADOPTION BY REFERENCE.
Pursuant to Chapter 139, Article 34, C.R.S. 1963 as amended,
there is hereby adopted by reference Sections 1 to 26 inclusive, of
the "Model Traffic Code for Colorado Municipalities," officially
approved, adopted, and published in 1971 as such by the State Depart-
ment of Highways, Denver, Colorado, and hereinafter referred to as
the "Municipal Traffic Code" of which three (3) copies are now filed
in the office of the Clerk of the Town of Vail, Colorado and may be
inspected during regular business hours, the same being adopted as if
set out at length save and except the following articles and sections
which are declared to be inapplicable to this municipality and are there-
fore expressly deleted ,
A, Deletions.
1 , Article III, Sections 1 through 4 inclusive are hereby
deleted .
2 , Article XIV is hereby deleted in its entirety.
3. Article XVII, Sections 2 through 9 inclusive and Section
17 (a) are hereby deleted .
4. Article XVIII, Section 1 (d) is hereby deleted,
5 , Article XXIV , Section 1 (a) and (b) are hereby deleted .
B , Amendments .
1 , Article IV, Section 1 (b) is hereby amended as follows:
(1) 15 miles per hour in any business district.
(2) 15 miles per hour in any residential district.

2 . Article XIII , Section 1 , is hereby amended by changing
the words, "and then only for a period not to exceed 3
minutes," to "and then only for a period not to exceed
10 minutes , "
3. Article XX, Section 13, shall be amended by adding the
following subparagraph:
(n) Any motorcycle shall be prohibited in Commercial
Core I zones as defined by the Zoning Ordinance for the
Town of Vail, where signs are posted in accordance with
Article XVIII , Section 1 , of this ordinance .
4. Article XXII, Section 20 (a) shall be amended as follows:
Whenever any police officer finds a vehicle, attended or
unattended, standing upon any portion of a street or high-
way right of way within this municipality in such a manner
as to constitute a violation of Article X, Section 5, Article
XI , Section 1 (1-5) and (10-13), and Article XI , Section 4
of this ordinance, or left unattended for a period of 24 hours
or more and presumed to be abandoned under the conditions
prescribed by 13-5-71 (2) and 13-5-72 (2) C.R.S. 1963 as
amended, such officer shall require such vehicle to be re-
moved or cause the same to be removed and placed in
storage in the nearest garage or other place of safety
designated or maintained by this municipality,
5, Article XXII is hereby amended by the addition of Section
23, which shall read as follows:
Penalty Assessment Schedule: The Penalty assessment and
the nature of the violation for which said penalty assessment
may be made by the arresting officer and accepted and paid
by the violator under the privileges of this section shall be
as herein set forth, to-wit:
SPEEDING (1-10 mph over speed limit) $10.00
(11-15 mph over speed limit) 15.00
(16-20 mph over speed limit) 35.00
SPECIAL HAZARDS 15.00
CARELESS DRIVING 15.00
ON WRONG SIDE OF STREET OR IN IM-
PROPER LANE 10.00
IMPROPER PASSING 10.00
FAILURE TO YIELD RIGHT OF WAY 10, 00
FAILURE TO STOP AT STOP SIGN 15.00
IMPROPER TURNING 10.00

The schedule defined and set forth in this section 23 hereof
shall not apply to any violation of said ordinance which is
tried in the municipal court.

6. Article XXIV, Section 1 (b) is hereby deleted and amended
to read as follows:
(b) The Traffic Violations Bureau is designated as a Bureau
of the Police Department which shall be in charge of its opera-
tion. The Traffic Violations Bureau shall be open on such days
and at such times as may be established by the Police Depart-
ure nt .
SECTION 2. APPLICATION OF ORDINANCE.
This ordinance and the Municipal Traffic Code shall apply to
every street, alley, sidewalk or sidewalk area, driveway, park and
to every public or private way and public parking area, whether within
or outside the corporate limits of the Town, the use of which the Town
has jurisdiction and authority to regulate .
SECTION 3. VIOLATIONS AND PENALTIES THEREOF.
It shall be unlawful for any person to violate any of the provisions
of the Municipal Traffic Code as adopted and amended herein, or of
any provision of this ordinance and any such violation shall be punishable
as hereinbefore provided . Every person convicted of a violation of any
provision of the Municipal Traffic Code or of any provision of this ordinance
shall be punished by a fine of not more than three hundred dollars ($300.00)
or by imprisonment for not more than ninety (90) days, or by both such fine
and imprisonment.
SECTION 4. FILING COPIES.
After the effective date of the adoption of the Municipal Traffic
Code, three copies certified to be true copies by the Mayor and the Town
Clerk shall be filed in the Office of the Town Clerk where they shall be
kept for public inspection during regular office hours while this ordinance
is in force.
SECTION 5. REPEAL.
This ordinance shall be in full force and effect after its approval
by the Board of Trustees and final publication as prescribed by law,
and shall supersede all previously adopted Municipal Traffic Codes as
amended. Upon the effective date of this ordinance, the Board of Trustees
specifically repeals Ordinance No. 5, Series of 1971 .
SECTION 6. SEVERABI LITY.
It is the intention of the Board of Trustees that this ordinance or
any part or provision thereof, shall be considered severable and, if
any provision of this ordinance or the application thereof to any person
or circumstance is held invalid, such invalidity shall not affect other
provisions or applications of the ordinance which can be given effect
without the invalid provision or application, and to this end the provisions
of this ordinance are declared severable .
SECTION 7. EFFECTIVE DATE.
This ordinance shalt be in full force and effect within thirty days
after its approval and final publication as prescribed by law.
