THE TOWN OF VAIL, AND AMENDMENTS THERETO; ESTABLISHING NEW REQUIREMENTS FOR OFF-STREET PARKING; AND ' SETTING FORTH MATTERS AND DETAI LS IN RELATION J THERETO. WHEREAS, the Vail Planning Commission, after due consideration and study of parking problems within the Town of Vail and the serious impact of the construction of additional living accommodations within the Town on traffic and parking facilities, has recommended certain amendments to the Zoning Ordinance for the Town of Vail, otherwise known as Ordinance No. 7 (Series of 1969); and WHEREAS, the amendments proposed by the Vail Planning Commis- sion have been submitted to the Board of Trustees for the Town of Vail, i which has duly considered said proposal and finds same to be necessary and desirable to provide for the parking needs of the community; and WHEREAS, the Board of Trustees for the Town of Vail finds that it is necessary for the public health, safety, and welfare to provide additional parking facilities within the Town of Vail and to amend the Zoning Ordinance to implement additional parking facilities; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF VAI L, COLORADO: SECTION 1. AMENDMENT OF ORDINANCE NO. 7 (SERIES OF 1969): Article III, Section 3 (a) is hereby amended by deleting said provision and substituting therefor the following: (a) The minimum number of off-street spaces required of every new or substantially reconstructed building shall be as follows: ZONE PARKING REQUIREMENT Residential District 2 spaces per dwelling unit Multi-family District 1 l/2 spaces per dwelling unit High Density Multi-family District Floor Area: Public Accommodations District Commercial Core District O to 600 sq. ft. 1 space Commercial Core II District 601 to 1000 sq. ft, l l/4 spaces Commercial Service Center District 1001 to 1300 sq. ft. l l/2 spaces Heavy Service District 1301 and more sq . ft. 2 spaces Churches, theaters, auditoriums 1 space for every (5) seats (provided and other public assembly facilities however, that spaces required by housing seated audiences other uses on the same lot, may be applied as a credit to the spaces required by a church, theater, etc. , use if such other uses and such ~ church, theater, etc. , uses occur at different hours , no two of which coincide) -r ~ • • • • • V Elementary and Nursery Schools 2 spaces for every classroom Medical and Dental Clinics 1 space for every 200 sq. feet of PFA Retail Floor Space 3 spaces for every l , 000 sq , feet of PFA Public, commercial or professional 3 spaces for every 1,000 sq. feet of offices and banks PFA Restaurants and Bars 3 spaces for every l , 000 sq . feet of PFA The provisions of this amendment shall apply, in addition to new or substantially reconstructed buildings, to any additions to existing buildings from the effective date of this ordinance. In all other respects, Ordinance No. 7 (Series of 1969) shall be and remain as originally adopted except for prior amendments . SECTION 2 . SEVERABI LITY: It is the intention of the Board of Trustees that this ordinance or any part or provision thereof, shall be con- sidered severable and, if any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared severable. SECTION 3. EFFECTIVE DATE: This ordinance is necessary for the immediate preservation of the public health and safety for the reason that the parking and traffic problem within the Town of Vail presents critical difficul- ties which must be alleviated at the earliest possible date to promote the comfort and health of the inhabitants of said town; therefore, this ordinance shall take effect in five (5) days following publication of same.
