HomeMy WebLinkAbout1972-10 Accepting the Dedication of a Public Right-of-Way, the same being a portion of Lot A, Block 1, Vail Village Seventh Filing ORDINANCE NO. 10 Series of 1972 AN ORDINANCE ACCEPTING THE DEDICATION OF A PUBLIC RIGHT-OF-WAY, THE SAME BEING A PORTION OF LOT A, BLOCK 1 , VAI L VI LL~GE, SEVENTH FI LING; THE DETERMINATION OF THE PUBLIC NECESSITY FOR SAID RIGHT-OF-WAY; AND SETTING FORTH MATTERS AND DETAILS I N RELATION THERETO. WHEREAS, Vail Associates, Inc. , a Colorado corporation, is the owner of certain real estate located within the Town of Vail, and which ' heretofore has been commonly used as a roadway; and WHEREAS, Vail Associates, Inc. , by an agreement with Manor Vail Corp. , a Colorado corporation, dated August 1 , 1967, indicated its intention to dedicate said right-of-way at a subsequent date to the Town of Vail as a public right-of-way; and WHEREAS, by a dedication instrument dated July 15, 1970, Vail Associates, Inc. , dedicated said right-of-way to the Town of Vail; and WHEREAS, the Board of Trustees for the Town of Vail at a public meeting held on the sixteenth day of May, 1972, a quorum being present, voted to accept said dedication of a public right-of-way, and said Bca rd of Trustees having determined that it is a matter of public necessity and convenience to accept said public right-oF-way; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF VAIL, COLORADO, THAT: Section 1 . The Town of Vail hereby accepts the dedication of certain real estate heretofore owned by Vail Associates, Inc. , as a public right-of- ' way, street, road, and thoroughfare, the same being more speciFically des- cribed as follows: ' A portion of Lot A, Block 1 , Vail Village, Seventh Filing, according to the recorded plat thereof, Town of Vail, County of Eagle, Colorado, more particularly described as follows: ~ Beginning at the Southeast corner of Lot A, Block 1 , Vail Village, Seventh Filing; thence Westerly al ong the Southerly boundary of said Lot A a distance of five (5) Feet to the true point of beginning; thence on an angle to the right of 70°04'03" and along a line parallel to and five (5) Feet West of the Easterly boundary of said Lot A a distance of 53.19 feet; thence on an angle to the left of 70°04'03" and along a line parallel to and fifty (50) feet from the Southerly boundary of said Lot A a distance of 344.98 feet; thence on an angle to the left of 83°50'00" a distance of 50.30 Feet; thence on an angle to the left of 96° 10'00" and along the Southerly boundary of said Lot A a distance of 347.75 feet to the true point of beginning. Section 2. The subject property described herein shall be used only as a public right-of-way and for no other purposes whatsoever . Section 3. The Board of Trustees for the Town of Vail Finds and determines that this ordinance accepting a dedication of a public right-of- way is necessary to protect the public health, safety, and welfare, for the reason that said right-oF-way is necessary to serve territory recently annexed to the Town of Vail, for purposes of traFfic regulation, police and Fire protection, and related municipal Functions . t•~~~ • r ~ This ordinance shall beco~ ~ ~a effective upon its introduction, adoption and publication in accordance with the laws of the State of Colorado.
