ORDINANCE NO. 14 Series of 1972 AN ORDINANCE AMENDING ORDINANCE NO. 6 (Series of 1971) REFERRING TO THE UNIFORM BUILDING CODE, 1970 EDITION, DELETING PORTIONS OF SAID UNIFORM BL+I LDING CODE AND MAKING ADDITIONS THERETO; AND SETTING FORTH DETAILS IN REL.~TION TO THE FOREGOING. WHEREAS, the Board of Trustees For the Town of Vail has duly adopted Ordinance No. 6 (Series of 1971) on 'the 22nd day of February, 1971 , adopting several uniForm codes regulating the construction of buildings within the Town; and WHEREAS, the Town Council now crnsiders that it is in the public interest to make certain amendments to 'the said Ordinance No. 6 (Series of 1971) to deal with speciFic construction problems within 'the Town of Vail; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL FOR THE TOWN OF VAI L, COLORADO: Section 1 . That portion of Section 420 of the Uni-Form Building Code, 1970 edition, previously amended by Ordinance No. 6 (Series of 1971) is hereby amended by deleting 'the following words: "EXCEPTIONS: Lofts that Fail within 'the definition of 'Mezzanine' Section 2. Section 3305 (a) as amended by Ordinance No. 6 (Series of 1971) is hereby deleted in its entirety. Section 3. Section 1714 of the Uniform Building Code, 1970 edition, is hereby amended by deleting the second sentence of same and substituting the Following: "Guardrails shall not be less than 42 inches in height, except in 'the interior of "H" and "I"-type occupancies where guardrails shall not be less than 38 inches in height . " Section 4. Part II , Chapter 4, DeFinitions and Abbreviations of the UniForm Building Code, 1970 edition, adopted by reFerence in Ordinance No. 6 (Series of 1971) is hereby amended by 'the following addition: Section 413(a) . LOFT . 1 . Aloft is deFined as an intermediate Floor placed in any story or room within an "H" or "I" occupancy and which is conFined 'to use as storage, bedroom and/or bathroom. 2. Such loft shall not exceed 33 1/3 percent of the total floor area of the room into which 'the loft projects, or 180 square Feet, whichever is less. 3. Regardless of the fire resistance requirements, ail loFts constructed over kitchen areas shall have a minimum of one-hour separation from kitchen area. 4. Any powtion of the loFt measuring less than 5' from 'the Finished Floor to the Finished ceiling shalt be included in any computation of 'the minimum Floor area thereof. w"»• ~ • 5. The clear height above or below a loft shall not be less than seven feet (7') as measured at the leading projecting edge. 6. Winding stairways (circular stairs) may be used iF the required width of 9" run is provided at a point not more than 12" From the side of the stair- . way where the treads are the narrower, but in no case shall any width of run be less than 6" at a point not more than 12" from center pole. 7. A minimum of 65% of projecting edge of loft shall remain open. 8. A guard rail shall be installed being sufficient in strength ~to withstand a horizontal force of 20 pounds per lineal foot applied at the top of the railing, not less than 38" in height and having intermediate rails of design such that no object 9" in diameter can pass through. 9. In computing the allowable floor area, the Following requirements shall apply: The room into which 'the loft will project may be utilized For computing allowable Floor area, with the Following exceptions: (i) Any adjacent room which is 50% or more open into primary room may be included as basic floor area. (ii) In 'the event a bathroom and/or closet is constructed within the loft area, 40 square Feet for one bathroom and 12 square Feet For one closet or storage area may be granted as allow- able area increase. Section 5. The Uniform Building Code, 1970 edition, incorporated by reference in Ordinance No. 6 (Series of 1971) is Further amended by the addition of the following provision: Shaft Enclosure to the RooF. All ventilating and exhaust equipment shall be enclosed in a shaft enclosure and ventilated 'to 'the rooF For all commercial kitchens and food service facilities. The shaft enclosure shall be constructed in accordance with the provisions of Section 1706(a) and (b) of 'the Uniform Building Code, 1970 edition. Section 6. Section 2, Deletions, Amendments, and Changes, of Ordinance No. 6 (Series of 1971), reFerring to Section 1705(c), Walls Fronting on Streets or Yards, is hereby amended by deleting said reference and substituting 'the following: Section 1705(c), Walls Fronting on Streets or Yards. "Wood veneer of not less than one inch (1") nominal thickness, or exterior type plywood or particleboard not less than three- eights inch (3/8") in nominal thickness may be applied on required Fire-resistive rated exterior walls as Follows: (a) One hundred percent (100%) of the wall area of the first floor above grade. (b) Forty percent (40%) of each wall area For each story above the first Floor providing it is fire-retardent treated wood . Page 2 Such wood shall be placed either directly against noncombustible, or fire-resistive surfaces or Furred out from such surface not to exceed one and one-half inches (1 1/2") with all spaces fire stopped as provided in Section 2517(f)." Section 7. Section 304(a) of the Uniform Building Code, 1970 edition, is hereby amended by 'the addition of the foliowing sentence: "A re-inspection fee in the amount of 'ten dollars ($10.00) may be charged in the event the contractor requesting the inspection is not prepared for said inspection at the time specified and requested by him." Section 8. It is the intention of 'the Tawn Council that this Ordinance or any part or provision thereof, shall be considered severable and, if any provision of 'this Ordinance or the application thereof to any person or circumstance is held invalid, such invaiidity shall not affect other provisions or applications of 'the Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
