ORDINANCE NO. 16
Series of 1972
A SUPPLEMENTAL ORDINANCE AUTHORIZING THE
EXPENDITURES OF FUNDS BY THE TOWN OF VAI L
IN EXCESS OF THE TOWN BUDGET FOR 1972, AND
DECLARING AND DEFINING THE EMERGENCY FOR
SUCH APPROPRIATION.
WHEREAS, numerous contingencies have arisen during the Fiscal
year 1972, which could not have been reasonably Foreseen or anticipated
~ by the Board of Trustees at the time of the adoption of the budget For the
year 1972; and
WHEREAS, the Town of Vail has received certain revenues not
~ budgeted For previously; and
WHEREAS, the population of the Town of Vail, and the use and
demand For municipal services within the Town, has expanded at a
greater rate than previously anticipated; and
WHEREAS, the Town has incurred obligations For municipal
purposes, Including general services, cultural and recreation programs,
and public safety projects; and
WHEREAS, the Town has previously adopted a budget which has not
taken into consideration the increased revenues received by the municipality
this fiscal year, nor has said budget taken into consideration the increased
expenditures necessary to provide adequate municipal services For the Town,
including general services, cultural and recreation programs, and public
safety projects; and
WHEREAS, the Town Manager has certified 'to the Town Council 'the
availability of additional revenues in 'the amount of eighty thousand dollars
($80,000), not otherwise reFlected in the budget, in accordance with
Section 9. 10(a) of the Charter For the Town of Vail; and
WHEREAS, due to the contingencies which could not have been Fore-
seen at the time of the adoption of the Town's budget, the Town Council
considers an emergency exists and that emergency appropriations and
expenditures be authorized as hereinbeiow provided.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TC7~NN OF VAI L,
COLORADO:
Section 1 . There is hereby appropriated 'to the General Fund the
sum of $80,000.00.
Section 2. There is hereby authorized 'the expenditure of the sum
of $80,000.00, For the Fiscal year 1972, including general services, cultural
and recreation programs, and public safety projects.
Section 3 . Emergency. The Town Counci 1 Finds and determines that
'the passage of this ordinance is necessary 'For the immediate preservation
of the public hearth and safety of the inhabitants of the Town of Vail, and that
this ordinance shall become effective upon final passage.

CERTIFICATION
To: Town Council Date: November 29, 1972

Gentlemen:
On the recommendation of Stanley Bernstein, Director of Finance 'For the
Town of Vail, and in compliance with Section 9.10 of the Charter For the
Town of Vail, I hereby certify that there is eighty thousand dollars ($80,000)
available For appropriation in excess of the revenues estimated in the budget
For 'the fiscal year 1972, and that a supplemental appropriation for said
fiscal year should be made in the amount of eighty thousand dollars ($80,000).
The supplemental appropriation is intended to cover the additional expenses
outlined in 'the attached memorandum from Mr. Bernstein with an additional
reserve for contingencies in the amount of sixteen thousand dollars ($16,000).
In order to eFfectuate the supplemental appropriation prior to the end of the
fiscal year, I recommend that an emergency ordinance be adopted by the
Town Council in accordance with Section 9. 10(b) of the Charter For the Town
of Vail a~t the next regular meeting of the Town Council 'to be held on December
5 , 1972 .
