HomeMy WebLinkAbout1973- 2 Providing for the Review of all Applications for Building Permits for Construcion within the TOV, excepting from said provisions the application of same to residential zoning districts, providing review procedures and criteria ORDINANCE NO. 2 Series of 1973 AN ORDINANCE PROVIDING FOR THE REVIEW OF ALL APPLICATIONS FOR BUILDING PERMITS FOR CONSTRUC- TION WITHIN THE TOWN OF VAI L; EXCEPTING FROM SAID PROVISIONS THE APPLICATION OF SAME TO RESIDENTIAL ZONING DISTRICTS; PROVIDING REVIEW PROCEDURES AND CRITERIA; AND SETTING FORTH MATTERS IN RELATION THERETO AND PROVIDING PENH LTIES FOR THE VIOLATION THEREOF. WHEREAS, the Town of Vail has experienced rapid and extensive growth within the previous several years which has had a serious impact on the capacity of the Town of Vail to render adequate services to new areas of development and the inhabitants thereof; and WHEREAS, an extraordinary number of applications For building permits has taxed the administrative capacity of the Town of Vail to adequately assimilate the expansive growth thereby engendered; and WHEREAS, the capacity of the facilities for the Vail Water and Sanitation District to adequately service newly constructed facilities as wet! as those anticipated to be constructed in the immediate Future is presently being studied by a professional engineering Firm to ascertain what remedial measures may be required to accommodate additional growth and increases in population density; and WHEREAS, it appears necessary and appropriate to analyze the impact on the environment occasioned by current growth patterns; and WHEREAS, the Planning Commission For the Town of Vaii has recommended to the Town Council substantial and significant revisions for the zoning ordinance (Ordinance No. 7 [Series of 1909], as amended) in order to assure more orderly growth and development within the Town of Vail; and the services of professional planning consultants have been contracted For by the Town Council to provide For more sophisticated and reliable development within the Town of Vail; and WHEREAS, the Town Council has determined that it is necessary and appropriate to provide for interim procedures to administer the issuance of building permits within the Town of Vatl to assure that ail subsequent building permits will require substantial compliance with the anticipated revisions of the zoning ordinance For the Town of Vail; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAI L, COLORADO, THAT: SECTION 1 . Review of Applications For Building Permits. No building permit shall be issued by the Town of Vail or any of its agencies or employees unless and until plans and speciFications, together with any other submittals, in support of an application For a building permit shall have been previously reviewed by the Town Council For the Town of Vail and its approval granted For the issuance of such building permit. An additional period of thirty (30) days shalt be provided For the review proce- dures referred to herein, in addition to any other periods of time provided by Ordinance No. 6 (Series of 1971), adopting by reFerence the Uniform Building Code, 1970 Edition. SECTION 2. Exceptions. The provisions of this ordinance steal! not apply to any applications for building permits or construction within residential zones, as the same are defined by Ordinance No. 7 {Series of 1969), as amended; nor shall the provisions of this ordinance apply to minor renovating or remodeling construction whicY~ would not substantially alter the character, size, ar appearance of any existing structures located within the Town of Vail. SECT ION 3 . Review Procedures . Upon submission to the building official for the Town of Vail of any application for a building permit, except as provided in Section 2 above, the building ofFiciai shall transmit to the Town Council a[l working drawings, plans, and specifications which are otherwise required in support of and as apart of an application for a building permit. The Town Council, thereupon, shall review all such submittals at a regular or special meeting as provided in the Charter for the Town of Vail. In advance of any determination relating to the approval or disapproval of the vari ous submittals, the Tawn Council may, in its discretion, solicit any recommendations or guidance from the Planning Commission for the Town of Vail or proFessiona! consultants retained For the purpose of providing technical and expert analysis of such submittals. SECTION 4. Review of Preliminary Plans . Any applicant who desires may in advance of application for a building permit submit plot plans, floor plans, elevations, Landscaping plans and outline specifications to the building aFficial for the Town of Vaii who shall transmit such materials to the Town Council which shall, thereupon, review such material at a regular or special meeting as provided in the Charter for the Town of Vail. Within a period not to exceed thirty (~O) days from the filing of such material, the Town Council shall either approve or disapprove such material, and in the evert of dis- approval, shall set forth in a written decision the reasons for such dis- approval. The Town Counci! may also grant provisional or conditional approval by imposing specific requirements which must be met by the applicant as a condition of approval. In the event the Town Council grants its approval of the submitted material, the applicant shall prepare the plans and specifications in support of an application For a building permit which will be subject to review, iF prepared in accordance with the materials previously approved, only by the budding department For normal processing, and in that event the additional thirty (30) day period provided in Section 1 shall not apply to the plans and specifications in support of an application for a building permit. SECTION 5. Determination upon Review. W ithin a period not to exceed thirty {30) days from the filing of an application For a building permit, as herein provided, the Town Council shaft either approve or disapprove the issuance of each building permit, and in the event of disapproval, shall set forth in a written decision the reasons and explanations for such disapproval. The Town Council may also grant provi- sional ar conditional approval for the issuance of any building permit by imposing speciFic requirema~ts which must be met by the applicant as a condition of approval. In the event the Town Council grants its approval For the issuance of a building perm it, the application shall be referred to the building department For normal processing; notwithstanding any approval granted by the Town Council, the applicant must in all other respects comply with the ordinances For the Town of Vail in order to obtain a building permit. In reviewing alE applications for building permits as provided herein, the Town Council shalt consider, as part of the applicable criteria, the height and size of all projects falling within the purview of this ordinance, as well as architectural design, setbacks from property lines, landscaping plans, and compatibility of proposed buildings in relationship to their sur- roundings and other buildings in the same vicinity; environmental efFects of such projects; demands said projects may make on utility service; and considerations retating to lighting, parking and traFfic. SECTION 7 . Review Fee . A fee of $75.00 shall be charged far the review procedures provided for in the ordinance, the payment of which shall be due at the time of filing an application for a building permit. SECTION 8. Penalties . ' Any person convicted of violating any of the pravisicns of this ardinance shalt be punished by a fine of not mare than $300.00 or by imprisonment For not more than ninety (90) days. SECTION 9. Severabiiity of Provisions. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shalt not affect the validity of the remaining portions of this ardinance; and the Town Council for the Town of Vail hereby declares it would have passed this ordinance and each part, section, subsection, sentence, clause or phrase thereoF, irrespective of the fact that any one ar mo-'t: parts, sections, subsections, sentences, clauses or phrases be declared invalid .
