ORDINANCE N0. 3 Series of 1973 AN ORDINANCE PROHIBITING PARKING UPON OR WITHIN PRTVATE PARKING LOTS OR PRIVATE PROPERTY WITHOUT THE CONSENT OF THE OWNER THEREOF OR PERSON IN POSSESSION OR CONTROL OF SAID PRIVATE PARKING LOT OR PROPERTY; IMPOSING CERTAIN REQUTREh1ENTS UPON THE OWNER OR PER50N IN POSSESSION OR CONTROL OF PRIVATE PARKING LOTS OR PROPERTY; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; AND SETTING FORTH MATTERS AND DETAILS IN RELATION THERETO. Wf~RFAS, the Town of Vail has been confronted with a serious deficiency of parking facilities to provide for the parking requirements of the inhabitants of the community, as well as guests and visitors to the community; and WHEREAS, many persons trespass upon private property by parking and leaving their vehicles within private parking lots and private property, thereby creating serious inconvenience to the owners thereof and generally creating traffic congestion and related hazards within the Town of Vail; and 4VI~REAS, the Town Council for the Town of Vail deems that it is in the public interest to prohibit unauthorized parking within and upon private parking lots or private property and finds that it is necessary for the preservation of the public safety and welfare to limit and restrict such parking and to impose penalties for the violation of the provisions of this ordinance; NOW, TY~FORE, BE IT ORDAINED BY THE TO~~~f COUNCIL OF THE TOWN OF VATL, COLORADO, THAT: SECTION 1. Definitions. apply: For the purposes of this ordinance, the following definitions shall The word "person" means and includes individuals, partnerships, associations and corporations. The words "private parking Lot and private property" mean and include any and all real property privately awned by persons as herein defined and includes lands, tenements, hereditaments, and all other possessory rights and claims. The word "owner" shall include any part-owner, joint-owner, tenant in common, joint tenant or Lessee of the whole or of a part of any private parking lot or private property as herein defined. The word "tenant" or "person in possession or control" shall mean and include any person who occupies in whale or in part or otherwise has the right to possess or control, the use of any private parking lot or private property as herein defined. The wards "Chief of Police" shall mean the duly appointed Chief of Police of the Toi,m of Vail, Colorado. . ~ [ SECTION 2. Unlawful Parking on Private Parking Lots or Private Fro~erty. ~ It shall be unlawful for any person to park or cause to be par ed any vehicle upon any private parking lot or any other private property within the Town of Vail, without the consent of the owner thereof or the tenant or person in possession or control of said private parking lot or private property. SECTION 3 .Pasting of Sign. Any owner, tenant, or person in possession or control of a private parking lot or private property wishing to avail himself of the provisions of this ordinance shall post at each and every entrance to a private parking lot or private property a sign containing essentially the following words: "Private Parking Lot Parking is reserved far persons having permission of the o~,mer and any other person may be subject to the penalties imposed by Ordinance No. 3 (Series of 1973}." A11 signs must be approved by the Chief of Police, who shall have the authority to determine size, shape and lettering of such signs. SECTION 4. Signing of Complaints. No complaint shall be issued for any violation of this ordinance less the same is signed by the owner, tenant or person in possession ror control of the private parking iot or private property within or upon which a violation of this ordinance may have occurred. SECTION 5. Penalties. Every person, upon conviction of a violation of this ordinance, shall, upon first conviction thereof, be punished by a fine of not less than $5.00, or by imprisonment of not more than 5 days, or both such fine and imprison- ment. Upon a second conviction of a violatio n of this ordinance, within one year of a prior conviction, the fine shall be not less than $l0.DD, or imprison- ment for not more than 10 days, or bath such fine and imprisonment. Upon a third and subsequent convictions, within one year from a prior conviction, the fine therefore shall be not less than $20.OD or imprisonment for not more than 2D days, or both such fine and imprisonment. SECTION 6. Severability of Provisions. If any p~.rt, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council for the Town of Vail hereby declares it would have passed this ordinance and each part, section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid.
