AN ORDINANCE CREATING THE TCWN OF VA] L RECREA-
TIONA L FUND; PROVIDING FOR THE COLLECTICN OF
RECREATIONAL FEES AS A CONDITION OF ISSUING
BUILDING PERMITS; PROVIDING FOR PROCEDURES FOR
COLLECTING AND DISBURSING FUNDS; SPECIFYING
PURPOSES FOR WHICH SUCH FUNDS MAY BE EXPENDED;
AND PROVIDING MATTERS AND DETAILS IN RELATION
THERETO.
WHEREAS, the Town of Vail has been founded as a resort and recrea-
tion community, and has attained a prominent reputation as such a community
and has attempted to maintain its status as a preeminent national recreattonal
facility; and
WHEREAS, rapid development within the community has in recent
years created situations which overtax and burden the physical recreational
facilities within the Town of Vai[, such as the golF course, tennis courts
and other recreational Facilities; and
WHEREAS, in order to keep pace with the extraordinary influx of
residents and visitors to the Town of Vail occasioned by the construction
of residential and commercial Facilities it is, in the judgement of the Town
Council, necessary and appropriate to provide additional recreational
facilities in order to maintain the high standards previously established
within the Town of Vail; and
WHEREAS, the Town Council deems it necessary to establish
additional sources of revenue to provide For the funding of recreational
facilities, such as, but not necessarily limited to, tennis courts, bicycle
paths, park and picnic areas, and play grounds;.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL
OF THE TOWN OF VAI L, COLORADO, THAT:
SECTION 1 , Definitions.
(a) "Town of Vail Recreational Fund." A special Fund, for accounting
purposes, created by virtue of this ordinance Far the purpose of purchasing
recreational facilities, or acquiring or constructing recreational facilities,
including the acquisition of real estate on which such facilities may be
purchased or constructed.
(b) "Recreational Fees." The fee determined by virtue of this
ordinance, and any subsequent amendment hereto, to be used For the creation
of the Town of Vail recreational fund.
{c) "Contractor." Any person, firm, partnership, joint venture,
or corporation, required to obtain a building permit under Ordinance No. 7
(Series of '1971) adopting by reference the Uniform Building Code, or any
other Town of Vail ordinance adopting subsequent editions of the Uniform
Building Code.
{d) "F'Eoor Area." The area included within the surrounding exterior
walls of a building or portion thereof, measured From the inside of all exterior
wails, excluding parking garages, public hallways, and public stairwells.
(e} "Building OfFiciai." The aFficer charged with the administration
and enforcement of the Uniform Building Code, as adopted by the Town of
Vail, or his regularly authorized deputy,

SECTION ~ . Payment of Recreational f=ees.
{~) Any contractor applying For a building permit in accordance with
the applicable ordinances of the Town aF Vail shall, as a condition of obtarning
such building permit, pay to the Town of Vail a recreationaE fee:
(a) For any buildings constructed in "Residential," "Multi-
Family," and "Agricultural" districts as defined in the zoning
ordinance For the Town of Vail (Ordinance No. 7 [Series of 1969
as amended) a recreational fee of twenty-five cents (25 cents} per
square Foot of Floor area, as herein defined, as the same may be
determined from the plans and specifications submitted 'to the
Building Official as part of the application for a Building Permit.
(b) For any buildings constructed in "High Density Multi-
Family," "Public Accommodations," "Commercial Core," "Com-
mercial Core Ii," "Commercial Service Center," and "Heavy
Service" districts as defined in the zoning ordinance For the Town
of Vail (Crdinance No. 7 [Series of 19697 as amended) a recrea-
tional Fee of seventy-five cents (75 cents) per square Foot of floor
area, as herein defined, as the same may be determined From the
plans and specifications submitted to the Building OfFicial as part
of the application for a Building Permit; except for retail com-
mercial facilities within any of the districts described herein and
far such space a recreational fee of fiFky cents (50 cents} per
square foot of floor area, as herein defined.
(2) The recreational fee shall apply to all new construction, all
additions to existing structures and to substantial alterations or re-
construction of existing structures; except for churches, clinics, hospitals,
schools and public structures .
{3) The recreational fees shall be due and payable at the time the
Building Permit is Issued, or,in the alternative, may be paid within a
period aF six (6} months from the date of issuance of the Building Permit.
Under no circumstances shall the Building Official issue a certificate of
occupancy until and unless the recreational Fee, as calculated in this section,
has been paid in full.
SECTION 3. Creation of the Town of Vai! Recreational Fund.
There is hereby created a Town of Vail Recreational Fund. All
recreational fees collected in accordance with Section 2 shall be paid into
a special and segregated fund. The Finance Director shall account separately
For all receipts and disbursements to and from the fund and shall not co-mingle
any part of said fund with other funds of the Town of Vail.
SECTION 4. Disbursements from the Town of Vail Recreational Fund.
Any and all disbursements From the Tawn of Vail Recreational Fund
shall be strictly limited to purchasing real or personal property, constructing
or otherwise acquiring recreational Facilities, including, but not necessarily
limited to, tennis courts, bicycle paths, park and picnic areas, and play
grounds. The foregoing ttems are not intended to limit, but merely describe
examples of the Kind of recreational facilities For which expenditures may be
made From the Town of Vail Recreational Fund, and the Town Council For the
Town of Vai[ may from time to time determine other appropriate purposes Far
expenditures in the area of recreational amenities. To the extent feasible

and practicable, the Town Council shall, within its absolute discretion,
budget the expenditure of funds For recreational projects in or near the
area From which such funds may have originated or been collected. The
budget for the Town of Vail shall include provisions For funds collected
by and to be disbursed from the Town of Vail Recreatinna€ Fund, and all
disbursements shall be approved by ordinance enacted by the Town Council
for the Town of Vail .
SECTION 5. Emergency.
The Town Council declares that an emergency exists insoFar as the
resort and recreationa! character of the community will be seriously jeopardized
if additional sources for creating the Tnwn of Vail Recreational Fund are not
immediately established; and that the immediate preservation of the public
health, safety and welfare requires the adoption of this ordinance under the
emergency provisions of the Charter of the Town of Vaii. This ordinance
shall take effect upon final passage.
SECTION 6. Severability.
IF any part, section, subsection, sentence, clause or phrase of this
and finance is for any reason held to be invalid, such decision shall not aFFect
the validity of the remaining portions of this ordinance; and the Town Council
for the Town of Vail hereby declares it would have passed this ordinance and
each part, section, subsection, sentence, clause or phrase thereof, irrespective
of the fact that any one or mare parts, sections, subsections, sentences,
clauses or phrases be declared invalid .

SECTION 4. Disbursements from the
Town of Vail Recreational Fund.
Any and all desbursemenis from
the Town of Vail Recreational Fund
shall be strictly limited to purchasing
real or personal property, construe-

tional facilities, including, but not
necessarily lemited to, tennis courts,
bicycle paths, pazk and picnic areas,
and play grounds. The foregoing
items are not intended to limit, but
merely describe examples of the kind
of recreational facilities fox which
expenditures may be made from the
Town of Vai] Recreational Fund, and
the Town Council for the Town of
Vail .may from time to time
determine other appropriate purposes
for expenditures irr the area of
recreational amenities. To the extent
feasible and practicable, the Town
Council sha11, within its absolute
