HomeMy WebLinkAbout1973-12 Annexing to the TOV Certain Territory, More Particularly Described as Vail Village 11th Filing, Zoning said Property in Accordance with the Zoning Ordinance for the TOV ORDINANCE NO. 12 Series of 1973 AN ORDINANCE ANNEXING TO THE TOWN OF VAIL CERTAIN TERRITORY SITUATED IN EAGLE COUNTY, STATE OF COLORADO, MORE PARTICULARLY DESCRIBED AS VAIL VILLAGE filth FILING, A000RD- ING TO THE RECORDED PLAT THEREOF; ZONING SAID PROPERTY IN ACCORDANCE WITH THE ZONING ORDINANCE FOR THE TOWN OF VAT L; AND SETTING FORTH MATTERS AND DETAILS IN RELATION THERETO. ,~ WHEREAS, a petition for annexation of territory into the Town of Vail, Colorado, was duly Filed with the Town Clerk on or about the sixteenth day of April, 1973, requesting the annexation to the Town of Vail of certain property commonly known as the Vail Village 11th Filing, according to the recorded plat thereof, County of Eagle, State of Colorado; a nc WHEREAS, by resolution the Town Council Far the Town of Vail Found that said petitions substantially complied with the Municipa! Annexa- tion Act of 1965 of the State of Colorado; and WHEREAS, the Town Council For the Town of VaiE duly established the time For holding a public hearing on said petitions For annexation, and Following public notice of said hearing the matter came before the Town Council at a public hearing held on July 17, 1973, in the Vail Municipal Building, and at the public hearing duly held before the Town Council on JuEy 17, 1973, the Town Council, at the completion of the hearing by reso- lution set Forth its Findings of Fact and conclusions including the following: 1 . That the requirements of the applicable parts of the Sections, CRS 139-21-3 and 139-21-4, had been met and complied with. 2 . That under the provisions of CRS (1963) 139-21-6 {2} no election would be required. 3. That there would be no additional terms or conditions imposed upon the annexation of the subject territory. 4. That an appropriate ordinance would be introduced at the next ensuing regular meeting of the Town Council pertaining to the annexation of the subject territory. WHEREAS, the Town Council Finds that the annexation of the subject property herein described is necessary and desirable, and in the best interests of the Town of Vail and that said territory should be annexed into the Town of Vail; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: SECTION 1 . Property Annexed to the Town of VaiE. The Following described territory, which was described in petitions for annexation, be, and the same is hereby annexed to the Town of Vail, Colorado: Vail Village 11th Filing, according to the recorded plat thereof, County of Eagle, State of Colorado. _~ 1 SECTION 2. Eligibility far Annexation. The Town Council Finds and determines that the territory described in Section 1 is eligible for annexation in accordance with the requirements of the Municipal Annexation Act of 1965, Colorado Revised Statutes (1963 Chapter 139, Article 21 , as amended, and that all of the proceedings relating to a public hearing, public notice and findings of fact have been conducted in accordance with the said Munictpa[ Annexation Act of 1965. SECTION 3. Zoning. A[! of the subject property annexed to the Town of Vail by virtue of this Ordinance is zoned "Two-Family Residential" in accordance with the Town of Vail zoning ordinance (Ordinance No. 8 [Series of 1973 ~, as amended, and the official zoning map Far the Town of Vail shall be ,~ appropriately amended to include such zoning designation for the territory q e herein annexed . E SECTION 4. Severability. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council for the Town of Vail hereby declares it would have passed this ordinance and each part, section, subsection, sentence, clause or phrase thereof, irrespective of the Fact that any one ar more parts , sections, subsections, sentences, clauses or phrases be declared invalid.
