HomeMy WebLinkAbout1973-13 Establishing Bicycle and Pedestrian Paths within the TOV, Regulating the use, Prohibiting the use thereof by certain vehicles, providing the right-of-way along the pathsrte, .,•-- ~ • - ' 't - ORDINANCE NO. 13 Series of 1973 AN ORDINANCE ESTABLISHING BICYCLE AND PEDESTRIAN PATHS WITHIN THE TOWN OF VAI L; REGULATING THE USE OF SUCH BICYCLE AND PEDESTRIAN PATHS; PROHIBITING THE USE THEREOF BY CERTAIN VEHICLES; PROVIDING FOR THE RIGHT-OF-WAY ALONG SUCH BICYCLE AND PEDESTRIAN PATHS; PROVIDING PENA LTIES FOR VIOLATION OF THIS ORDINANCE; AND SETTING FORTH MATTERS AND DETAI LS IN RELATION THERETO, WHEREAS, the Town Council For the Town of Vail has established bicycle and pedestrian paths throughout the Town of Vail For the use of residents of and visitors to the Town of Vail and wishes to provide for the safe and convenient access to and enjoyment of said bicycle and pedestrian paths; and WHEREAS, the Town Council has determined that it is necessary for the health, safety and welfare of the community to prescribe certain limitations and restrictions upon the use of said bicycle and pedestrian paths; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL FOR THE TOWN OF VAI L, COLORADO, THAT: SECTION 1 . Definitions . When used in this Ordinance, the words and phrases herein defined shall have the meanings respectively ascribed to them as follows: 1 . Bicycle arr! Pedestrian Paths. That portion of the public domain specifically dedicated and designed for the exclusive use of bicycles and pedestrians and so described on the official bicycle and pedestrian path map on file with the Town Clerk for the Town of Vaii, and excluding therefrom all portions of said bicycle and pedestrian paths which may otherwise be dedicated as public streets. 2. Public Streets. The entire width betweenthe boundary lines of every way publicly maintained when any part thereof is open for the use of the public For purposes of vehicular traffic , 3. Bicycle. Every device propelled by human power upon which any person may ride, having two tandem wheels. 4. Motor Vehicle. Any self-propelled vehicle which is designed primarily for travel on the public streets and highways and which is generally and commonly used to transport persons and property over the public streets and highways . 5. Motorcycle. Every motor vehicle designed to travel on not more than three {3) wheels in contact with the ground. 6. Motor-driven cycle. Every motorcycle, including every motor-scooter, bicycle with motor attached, trail bikes, mini-bikes, go-carts, golf carts and similar vehicles. 7. Pedestrian. Any person afoot. ._~ ~'i ~ • - ` ~- S. Right-of-way. The privilege of the immediate use of the bicycle and pedestrian path, this being the right of one bicycle or pedestrian to proceed in a lawful manner in preference to another bicycle or pedestrian approaching under such circumstances or direction, speed and proximity as to give rise to danger of collision unless one grants precedence to the other. SECTION 2 . Use of the Bicycle and Pedestrian Paths . The access to and use of the bicycle and pedestrian paths within the Town of Vail, as herein defined, shaft be restricted to the exclusive use of persons operating bicycles thereon and pedestrians. It shall be unlawful for any person to operate a motor vehicle, motorcycle, motor-driven cycle, as herein defined, upon or across any bicycle ar~d pedestrian paths within the Town of Vai [ . SECTION 3. Right-of--way. Operators of bicycles along, across or upon bicycle and pedestrian paths s ha L t at a L t times yield the right--of-way, as herein de Fi ned , to pedestrians using said bicycle and pedestrian paths . SECTION ~l. Penalties. It shall be unlawful for any person to violate any of the provisions of this Ordinance, and upon conviction of any violations of any provision of this Ordinance such person shall be subject to a fine not to exceed $300.00 or by imprisonment in the Municipal Jail for a period of not more than 90 days or by both such Fine and imprisonment. SECTION 5. Severability. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council for the Town of Vail hereby declares it would have passed this ordinance and each part, section, subsection, sentence, clause or phrase thereoF; irrespective of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. iNTRQDUCED, READ, APPROVED, AND ORDERED PUBLISHED THIS / ~~`' day of August, 1973 .
