L Series of L974 AN ORDINANCE RELATING TO REGULAR AND SPECIAL MEETINGS OF THE TOWN COUNCIL ~. WHEREAS, the Town Code of Vail, Section 2-1-1, of the Town of Vail, Colorado, hereinaFter referred to as the "Town", establishes that the Town Council shall have regular meetings on the first and third Tuesdays of each month at 7:30 P. M, in the Municipal Bui tding of the Town, but said section is deficient in that it has no provision For the deferment of a regular meeting in the event the First or third Tuesday is a legal holiday or there is some other good reason as to why a regular meeting cannot be held on the first or third Tuesday of a month; and WHEREAS, Section 4.5 of the Charter of the Town provides that the Town Council may prescribe rules and regulations for all regular and special meetings of the Council, such that Section 2-L-2 of the aForesaid Code is unnecessary and inadequate, and general rules of order and procedure for said meetings are needed and should be expressly prescribed by ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCI L OF THE TOWN OF VAIL, COLORADO, AS FOLLOWS: Section 1. Title. This ordinance shall be known as the "Regular and Special Council Meetings Ordinance". Section 2. Regular meetings; regular meeting dates. Pursuant to Section 4. L of the Charter of the Town, the Town Council shall have regular meetings on the first and third Tuesdays of each month, to be known as the regular meeting dates, at 7:30 P. M, , in the Municipal Building of the Town, except as provided in Section 3 hereof. Section 3 . Deferment of regular meetings , In the event a regular meeting pursuant to Section 2 hereof would fall on a legal holiday recognized by the Town or a regular meeting cannot for good reason be held by the Town Council on a regular meeting date, said regular meeting shalt automatically be held on the next secular day at the same time and place; provided, however, that For good cause the Council at a regular meeting preceding the regular meeting which will be deferred may defer the regu tar meeting to a subsequent date not later than one week after the deferred regular meeting date . Section 4. Notice of regular and special meetings. r A , This ordinance constitutes notice of regu tar meetings to be held pursuant to Sections 2 and 3 hereoF and no other notice shalt be required. B, With respect to a special meeting which is called, in addition to the requirements of Section 4.2 of the Charter of the Town, the Town Council will endeavor to have a Legal notice thereof published once preceding the date of said meeting; provided, however, that said publication shall not be required in the absence of adequate time therefor or may be dispensed with For other good cause . .. ~- ~„ . _ • Section 5. Order of business. In regular and specia t meetings of the Town Counci 1 the order of business shall be as follows: 1) Call to order by the Mayor . 2) ROIL call of councilmen; determination of quorum. 3) Minutes of preceding meetings . 4) Administrative financial reports. 5) Consideration of ordinances, resolutions, and motions. 6) Reports from Town Manager and Town Attorney. 7) Statements, observations, and inquiries by the Mayor and councilmen. 8) Consideration of other matters on the agenda. 9) Citizen participation. l0) Concluding statement by the Mayor. L t) Adjournment. Section 6. Ru Les of procedure . A. Regular and special meetings of the Town Council held in accordance with Sections 4. L and 4.2 of the Charter of the Town while open to the public and citizens of the Town fundamentally are administrative hearings, the principal purposes of which are to enable the Council to obtain inFormation, consider, and determine legislative and administrative matters. B. In administrative hearings the Town Council shall not be required to observe any formal rules of evidence and may consider any matter which a majority of the present councilmen concludes is reasonably reliable and calculated to aid the Council in reaching a reasonable determination of the issues involved. C . The Town Council in its public meetings shalt have the right to preserve order and to take such actions and follow such procedures as are necessary or reasonable to enable it to conduct the meeting and its business in a proper manner . D . Except as otherwise provided by applicable law or the pro- visions hereof, Robert's Rules of Order, as amended, shall generally govern the public meetings of the Town Council. Section 7. Effective date. This ordinance shall take effect five days after publication following the final passage hereof. Section 8. Repeal of Town Code Sections 2-L-1 and 2-1-2. Upon enactment of this ordinance, Sections 2-1-I and 2-t-2 of the Town Code of Vail are thereby repealed.
