AN EMERGENCY ORDINANCE PROHIBITING PEOPLE POWERED
VEHICLES FROM USE OF STREETS AND BICYCLE AND
PEDESTRIAN PATHS IN THE TOWN OF VAIL AND AMENDING THE
MUNICIPAL TRAFFIC CODE, ORDINANCE NO. 13, SERIES OF
1973, AND TOWN CODE OF VAIL
WHEREAS, so-called people powered vehicles, which
are three-wheeled vehicles propelled by human power having
seats for two persons within a body, have been operated on
the highways, roads, streets, and alleys and on the bicycle
and pedestrian paths in the Town of Vail, Colorado, since
the 15th day of July , 197 4 ;
WIiEREAS, the Town Council of the Town of Vail, Colorado,
hereinafter referred to as the "Town", considers that the
operation of people powered vehicles on the streets is dangerous
to the occupants of said vehicles and to pedestrians and that
their operation on the bicycle and pedestrian paths is dan-
gerous to pedestrians, such that the operation of said
vehicles within the Town is inappropriate and should be pre--
eluded;
WHEREAS, the prohibition of people powered vehicles
from the use of its streets and bicycle and pedestrian paths
is within the police power of the municipality;
WHEREAS, inasmuch as the operation of people powered
vehicles on the streets and bicycle and pedestrian paths in the
Town creates a danger to persons and property which caristitutes
an emergency situation, the Town Council finds that it is
necessary for the preservation of public property, health, wel-
fare, peace, or safety to enact this ordinance as an emergency
measure before a person is k:i_llec~. or injured; and
WIiEREAS, this ordinance amends the D4unicipal Traffic Code,
Ordinance Na. 13, Series of 1973, of the Town of Vail, Colorado,
and the Town Code of Vail;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF
THE TOWN OF VAIL, COLORADO, AS FOLLOL~7S:

Section 1. Title.
This ordinance shall be known as the "Ordinance
Prohibiting People Powered Vehicles From Use of Streets
and Eicycle and Pedestrian Paths in the 'T'own of Vail".
Section 2. Definition.
For purposes of this ordinance a "people powered
vehicle" is defined as a vehicle propelled by human power
having a body, three or mare wheels, and a seat or seats
for two or more persons.
Section 3. People powered vehicles prohibited from
using streets in Town of Vail; amendments to Municipal
Traffic Code.
The following sections of the Municipal Traffic
Code are hereby amended as hereinafter provided:
A. Section 25-2:
Subparagraph (kk) is added as follows:
(kk} People powered vehir_le.--£very vehicle
propelled by human power having a body, three or more
wheels, and a seat or seats for two or mare persons.
B. Section 23-12(b):
Subparagraph (11) is added as follows:
(11) People powered vehicles shall be prohibited
from using the highways, roads, streets, and alleys in the
Town of Vail, Colorado.
C. Section 23-9 (b)
Cubparagraph (26) is added as follows:
(?6) DeGignate and sign the streets in the
Town of Vail., Colorado, indicating prohibition of use by
people powered vehicles.

Section 4. People powered vehicles prohibited from
using bicycle and pedestrian paths in Town of Vail; amendments
to Ordinance No. 1.3, Series of 1973.
The following sections of Ordinance No. 13, Series of
1973, of the Town of Vail, Colorado, are hereby amended as
hereinafter provided:
A. Section l:
Subparagraph 10 is added as follows:
10. People powered vehicle. Every vehicle
propelled by human power having a body, three or more wheels,
and a seat or seats for two or more persons.
B. Section 2:
The second sentence is amended to read as follows:
It shall be unlawful for any person to operate a motor
vehicle, motorcycle, motor-driven cycle, or people powered
vehicle, as herein defined, upon or across any bicycle and
pedestrian path in the Town of Vail.
Section 5. Effective date.
This ordinance shall take effect upon th.z passage hereof.
Section 6. Amendment to Town Code of Vail.
Upon its enactment this ordinance shall amend Section
9-1-3 of the Town Code of_ Vail as provided in Section 3 hereof.
