AN ORDINANCE AME"TDINC'T TITLE II, CHAPTER 7,
OF THE TOWN CODE OF VAIL RELATING TO THE
MUNICIPAL COURT

WHEREAS, the J14unicipal Court in and for the Town
of Vail, State of Colorado, was created by Article VII,
Section 7.2,of the Charter of the Town of Vail, Colorado;
WIiEREAS, the Municipal Court was established as
a qualified municipal court of record by Title II, Chapter
7, Section 2-7-1, of the Town Code of Vail; and
WHEREAS, the Town Council considers that it is
appropriate to amend Title II, Chapter 7, of the Town Code
of Vail so as to establish the Municipal Court as an ordi-
nary municipal court and to provide for the operation of the
court;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL
OF THE TOWN OF VAIL, COLORADO, AS FOLLOWS:
Section 1. Title.
This ordinance shall be known as the "Ordinance
Amending Code Title II, Chapter 7, Relating to Municipal Court".
Section 2. Amendments to Title II, Chapter 7, of
Town Code.
Title II, Chapter 7, of the Town Code of Vail is
hereby amended as hereinafter provided:
A. Section 2-7--1 is amended to read as follows:
2-7-1 Established; Operation of Municipal Court;
Implemented by Resolutions.
(a) The Tunicipal Court in and for the Town
of Vail, State of Colorado, created by Article VII, Section
7.2, of the Charter of the Town of Vail, Colorado is esta-
blished as an ordinary, non-record municipal court.
(b) The operation of the ^4unicipal Court
shall be governed by Chapter 37, Article 22, Colorado Revised

Statutes 1963, as amended, which is incorporated by reference
herein and made a part hereof, excluding any provision or por-
tion thereof in said statute which is inconsistent with an
applicable provision of the Charter, the Code, or any ordi-
nance of the Town.
(c) The laws relating to the operation of
the Municipal Court shall be implemented by the Town Council
through its adoption of resolutions.
B. Section 2-7-5 is amended to read as follows:
2-7-5 Clerk of 114unicipal Court.
(a) The Town Council shall establish the
position of Clerk of the Municipal Court; provided, however,
that for good cause the presiding municipal ,judge shall serve
as ex officio clerk.
(b) The Clerk of the Municipal Court shall
be appointed by the presiding municipal judge with the con-
currence of the Town Council and shall have such duties as
are delegated to said person by law, court rule, or the pre-
siding municipal judge.
(c) The Town Manager shall determine the
salary of the Clerk of the Municipal Court.
(d) All fines, costs, and other funds col-
lected or received by the Municipal Court shall be reported
and paid monthly by the Clerk to the Finance Director of the
Town of Vail in accordance with his directions, said monthly
report and funds to be submitted on or about the last day of
each month.
(e) The performance bond to be given by the
Clerk of the Municipal Court to the Town of Vail pursuant to
Section 37-22-7, CRS 1963, as amended, shall be satisfied by
the bond applicable to employees of the Town of Vail, provided
that the Clerk is within the purview of said bond.

Section 3. Effective Date.
This ordinance shall take effect five days after
publication following the final passage hereof.
INTRODi7CED, READ ON FIRST READING, APPROVED, AND
ORDERED PUBLISHED ONCE IN FULL, this 3rd day of December,
1974, and a public hearing on this ordinance shall be held
at the regular meeting of the Town Council of the Town of
Vail, Colorado, on the 17th day of December, 1974, at ?:30
P.M., in the Municipal Building of the Town.
