OF THE SIGN ORDINANCE RELATING TO BACK LIGHTING, STAINED GLASS, WINDOW SIGNS, TEMPORARY WINDOW SIGNS, DISPLAY BOXES, TEMPORARY SITE DEVELOPMENT SIGNS, APPLICATION PROCEDURES, AND VARIANCE PROCEDURES WHEREAS, certain difficulties in the administration of the Sign Ordinance have occurred as a result of provisions for application, variance, display boxes, and temporary site development signs, the definition of window signs, the lack of provisions permitting temporary window signs, and the lack of definitions for back lighting and stained glass; and WHEREAS, the Town Council of the Town of Vail, Colo- rado, considers that it is appropriate to amend the Sign Ordi- Hance in order to eliminate the aforesaid difficulties; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF TiiE TOWi1 OF VA IL , COLORADO , AS FOLLOWS Section 1. Title. This ordinance shall be known as the "Ordinance Amending Sign Ordinance Sections 1-3-i through 1-3-p, 2-3, 4-3, 14-11-i, 14-12-d, 14-12-h, 14-15-a, and 17". Section 2. Amendments to Sign Ordinance. The Sign Ordinance, Ordinance No. 9, Series of 1973, of the Town of Vail, Colorado, is hereby amended as hereinafter provided: A. Section 1-3-i is amended to read as follows: 1. Lighting, back -- An indirect source of light which is located from behind the sign surface or shielded from the viewer's eyes by a translucent or opaque material. 2. Lighting, indirect - A light source separated from the surface and illuminating such sign surface by means of spotlights or similar fixtures. Town C1 rk, lieputy i t Ord. 4, 1975 Page 2 3. Lighting, pan-channeled - Indirect, concealed light source which is recessed into any element of a sign, which element is attached directly to the face of such sign. Each element to be lighted must have an opaque surface such that the light does not shine through the element. B. Sections 1-3-j through 1-3-n-3 shall read as follows j. Person - Shall include any person, firm,part- nership, association, corporation, company or organization of any Yind. k. Plate line - The point at which any part of the roof structure first touches or bears upon an external wall. 1. Restoration - The routine maintenance and painting of existing, approved signs, that do not change the approved design and colors in any way. m. Reflective Surface - Any material or device which has the effect of intensifying reflected light, such as Scotchlite, Dayglo, glass beads and luminous paint. n. Sign - A surface or space, as permitted in this ordinance, whether continuous or not, which identifies a business, conveys a message to, or attracts the attention of any person by means of letters, numbers, figures, or other symbols, devices, or representations. 1. Wall Sign - A sign attached to, painted on, or erected against the wall of a building or structure with the exposed face of the sign in a plane parallel to the face of said wall and not projecting more than nine (9) inches from the face of said wall. ' 2. Free-Standing Sign - A single or multi~- faced sign affixed to a supporting structure, or imbedded in and extending from the ground and detached from the building. Allowable size does not include supporting structure. 3. Pro,~ecting or Hanging Sign - Any sign attached to a building and extending in whole or in part more `~'~ Town /clerk i Ord. 4, 1975 Page 3 than nine (9) inches beyond the building line. Allowable size does not include supporting structure. C. Section 1-3-n-4, heretofore known as Section 1-3-0-4, is amended to read as follows: 4. Window Signs - A sign affixed on or located within thirty-six (36) inches of the interior surface of a win- dow fronting a public way, which sign shall not include the two {2) square feet allowed for the display of hours, credit card information, and similar general information items. D. Sections 1-3-n-5 through 1-3-o shall read as follows: 5. Display Box - A free-standing or wall sign enclosed in glass for the express purpose of displaying menus, current entertainment or real estate listings. 6. Residential Name Plate Sign - A sign per- mitted for the sole purpose of identifying the inhabitant resid- ing therein, the house name or identifying the address thereof. Said sign may contain no advertising of any kind. 7.' Subdivision Entrance Sign - A sign permit- ted to identify a subdivision as defined herein in a CC1, CC2, or SD-1 district only. 8. Temporary Site Development Sign - A sign permitted to identify a project under construction including the project name, general contractor, architect, prime real estate agent and may include "model apartment". 9. Traffic Control Sign -- A permitted sign for the purpose of identifying private parking areas and directing the flow of traffic on private property. 10. Flag - Shall mean any state or national flag. 11. Banners, Pennants or Bunting - Any announce- ment device affixed to pales, wires or ropes for the purpose of announcing or promoting community events or activities or decor- ating the Town for special holidays. Mural or Supergraphic - A painted scene, figure or decorative design on a wall, so as to enhance building architecture, not including written trade or place names, trade marks or logotype, or advertising message. 13. Sign Program - A comprehensive approach to a sign or group of signs for an entire building. o. Size, allowable - Allowable area of a sign shall be computed by using the outside dimensions of the face, in the same plane, of a one or two-sided sign and each face of a multi- sided sign. Computation of allowable sign area shall include all existing signs on the premises whether such signs be conform- ing or non-conforming under this ordinance. Free-standing or wall--mounted letters will be measured using the smallest geometric figure which will enclose all letters or symbols. E. Section 1-3 is further amended by the insertion of sub-section p as follows: p. Stained-glass - Multi pieces of translucent material held together by foil or lead tames and having the var- ious joints soldered together. Signs made out of translucent materials, at the discretion of the Design Review Board, may be either back-lighted or have indirect lighting. F. Section 2-3 is amended to read as follows: 3. Sign materials should be predominately natural such as rough cedar, pine or other types of wood. Stained-glass may also be considered by the Design Review Board. Plastic or other materials are discouraged. G. Section 4-3 is amended to read as follows: 3. The Administrator shall review and accept the properly completed sign application permit. The Administrator will then refer said application signed and dated to the Design Review Board after having determined the sign meets the general requirements of the ordinance. If the Administrator determines that the sign application does not meet the technical requirements, Tow 'Clerk Ord. 4, 1975 i ~~ - r~` Page 5 including but not limited to size, height, and number, of this ordinance, the Administrator may deny the application. Upan denial of an application by the Administrator, the applicant may resubmit a modified application, file an application for a variance, or file an appeal to the Design Review Board within 30 days following such determination. The Board shall consider an appeal at its next regularly scheduled meeting or as promptly as practicable at a subsequent regular meeting of which the applicant is given written notice. The Board shall render a decision on the appeal within 30 days after the hearing, unless additional time is required for good cause, and serve a capy of its decision~on the applicant by mail to applicant's Last known address. H. Section 14-11-i is amended to read as follows: i. A sign or signs advertising temporary events are exempt from this definition provided that a single sign does not exceed six (6) square feet with a maximum area of ten (IO) square feet aggregate for all signs denoting temporary events, provided such sign or signs are removed at the conclu- sion of the temporary event and not erected prior to ten (10) days before the event is scheduled to take place. A temporary event is one which does not last more than thirty (30) consecu- tive days in any given calendar year. Signs denoting current or future events erected by a non_profit organization are not subject to the time limits outlined in this section, provided that said signs are removed within twenty-four (24) hours after the event has ended. I. Section 14-12-d is amended to read as follows: d. Number: 1. Permitted. One (1) display sign. 2. Conditional. If a business has two (2) consumer entrances on distinct, separate pedestrian ways, a proposal for a second Town lerk i i Ord . 4 , 1.975 Page 6 display box may be approved at the discretion of the Design Review Board; said proposal shall conform to the other provi- sions of this section. J. Section 14-12-h is amended to read as follows: h. Landscaping: 1. A landscaped area of two (2) square feet for each square foot of each side of a permanent free-standing display box may be required at the base of the box. 2. If landscaping is required by the Design Review Board, a plan showing the landscaping must be submitted to the Design Review Board by the applicant at the next Design Review Board meeting. 3. All landscaped areas shall be maintained to Town standards. K. Section 14-I5-a is amended to read as follows: a. Purpose: To indicate or identify a develop-- ment of real property under construction in HDMF, PA, CSC, CC1, CC2, SD, MDMF, LDMF, and RC zones. L. Section 17 is amended to read as follows: Section 17. Variances. 1. Purposes and Limitations. In order to prevent or to lessen such practi- cal difficulties and unnecessary physical hardships inconsistent with the objectives of this ordinance variances from the regula- Lions may be granted. A practical difficulty or unnecessary physical hardship may result from the size, shape, or dimensions of a structure, or the location of said structure, from topogra- phic or physical conditions on the site or in the immediate vicinity, or from other physical limitations, street locations, or traffic conditions in the immediate vicinity. Cost or incon- venience to the applicant of strict or literal compliance with a regulation shall nat be a reason for granting a variance. Town ~Ierk r- ....: <<, ~ - ©rd. 4, 1975 i r~ ~ . ~ ~- . Page 7 A variance may be granted with respect to any regulation contained in this ordinance. 2. Application. Application for a variance shall be made upon a form provided by the Administrator. The variance application shall include the application for a sign permit and shall also state the applicant's reasons for requesting variance in accord- ance with the criteria set forth in Paragraph 7 of Section 17. 3. Variance Fee. The Town Council shall set a variance fee sufficient to cover the cost of Town staff time and other expenses incidental to the review of the application. The fee shall be paid at the time of application and shall not be refundable. 4. Hearing. Upon receipt of a variance application, the Administrator shall set a date for hearing before the Design Review Board. 5. Notice. Not less than 15 days prior to the date set for the hearing, the Administrator shall cause a copy of a notice of the time and place of such hearing to be published once in a newspaper of general circulation in the County of Eagle. 6. Action by the Design Review Board. Within 20 days of the closing of a public hearing on a variance application, the Design Review Board shall act on the application. The Board may recommend approval of the ' application as submitted or may recommend approval of the appli- cation subject to such modifications or conditions as it deems necessary to accomplish the purpose of this ordinance, or the Board may recommend denial of the application. A variance may be revocable or may be granted for a limited time period. Town lerk i Qrd. 4, 1975 Page 8 7. Criteria and Findings. Before the Board acts on a variance applica- tion, the applicant must prove physical hardship, and the Board must find that: a. there are special circumstances or condi- tions applying to the land, buildings, topography, vegetation, sign structures or other matters on adjacent lots or within the adjacent right-of-way, which would substantially restrict the effectiveness of the sign in question; provided, however, that such special circumstances or conditions are unique to the par- ticular business or enterprise to which the applicant desires to draw attention, and do not apply generally to all businesses or enterprises; b. that such special circumstances were not created by the applicant or anyone in privy to the applicant; c. that the granting of the variance will be in general harmony with the purposes of this ordinance, and will not be materially detrimental to the persons residing or working in the vicinity, to adjacent property, to the neighborhood, or to the public welfare in general; d. the variance applied for does not depart from the provisions of this ordinance any more than is required to identify the applicant's business or use; e. such other factors and criteria as the Design Review Board deems applicable to the proposed variance. 8. Action by the Town Council. The recommendation of the Design Review Board shall be promptly transmitted to the applicant and to the Town Council. At its next regularly scheduled meeting following receipt of the recommendation of the Design Review Board or as promptly as practicable at a subsequent regular meeting of which the applicant is given written notice, the Town Council shall hold a hearing to review the recommendation of the Board, and shall Town ~l rk, Deputy i .. Ord. 4, 1975 Page 9 either approve the application as submitted, approve the application subject to such modifications or conditions as it deems necessary to accomplish the purpose of this ordinance, or deny the application. Tf the Council deems insufficient information is adduced at said hearing to provide the basis for a sound decision, it shall, continue the hearing to one or more subsequent meetings. The Council shall render a decision on the appeal within 60 days after the final hearing unless additional. time is required for good cause and serve a copy of its decision on the applicant by mail to applicant's last known address. Section 3. Effective Date. This ordinance shall take effect five days after pub- licatian fallowing the final passage hereof. IT IS HEREBY CERTIFIED that on the 1st day of April, 1975, this ordinance was introduced, read on first reading, approved, and ordered published once in full and a public hear- ing was scheduled at the regular meeting of the Town Council of the Town of Vail, Colorado, on the 15th day of April, 1975, at 7;30 P.M., in the Municipal Building of the Town.
