ORDINANCE NO. /~~% Series of 1976 AN ORDINANCE FOR THE REGULATION OF TRAFFIC BY THE TOWN OF VAIL, COLORADO, FOR THE PURPOSE OF PROVIDING A SYSTEM OF TRAFFIC REGULATIONS CONSISTENT WITH STATE LAW AND GENERALLY CONFORMING TO SIMILAR REGULATIONS THROUGHOUT THE STATE AND THE NATION; ADOPTING BY REFERENCE THE 1974 EDITION OF THE "MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES"; REPEALING ALL ORDINANCES IN CONFLICT THEREWITH; AND PROVIDING PENALTIES FOR VIOLATION THEREOF WHEREAS, the Town Council of the Town of Vaal has previously adopted by reference the "Model Traffic Code for Colorado Municipalities", 1.971 Edition, for the regulation of traffic within. the Town of Vail; and WHEREAS, the Department of Highways for the State of Colorado has revised said "Model Traffic Cade", and the Town Council of the Town of Vail deems it in the interest of the public safety and welfare to adopt such revised "Model Traffic Cade", in its revised form for the regulation of traffic within the Town of Vail; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, AS FOLLOWS: Section 1. Adoption by Reference. Pursuant to Chapter 31, Article 16, C.R.S. 1973, as amended, there is hereby adopted by reference Sections 1 to 26 inclusive, of the "Model Traffic Code for Colorado Municipalities", officially approved, adapted, and published in 1974 as such by the State Department of Highways, Denver, Colorado, and herein- after referred to as the "Municipal Traffic Code" of which three {3} copies are now filed in the office of the Clerk of the Town of Vail, Colorado, and may be ansnected during regular business hours, the same being adopted as if set out at Length save and except the following articles and sections which are declared to be inapplicable to this municipality and are therefore expressly deleted. _1_ ~. T `~. ~ • ~, Ord. 10 , 1976 A. Deletions. 1. Article III, Sections 1 through ~ inclusive, relating to railroad crossings, are hereby deleted. 2. Article XIV, relating to parking meters, is hereby deleted in its entirety. 3. Article XVII, Sections 2 through 9 inclusive and Section 17(a), relating to bicycle licensing and parking, are hereby deleted. 4. Article XVIII, Section 1{d), relating to travel on restricted public ways, is hereby deleted. B. Amendments. 1. Article IV, Section 1(b) is hereby amended as follows: (1) 15 miles per hour in any business district. {2} 15 miles per hour in any residential ~~ district. 2. Article xIII, Section 1, is hereby amended by changing the words, "and then only for a period not to exceed 3 minutes." to "and then only for a period not to exceed 10 minutes." 3. Article XX, Section 13, shall be amended by adding the following subparagraph: (n) Any motorcycle shall be prohibited in Commercial Core I zones as defined by the zoning Ordinance for the down of Vail, where signs are posted in accordance with Article XVIZI, Section 1, of this ordinance. 4. Article XXTI, Section 20 (a) shall be amended as follows: Whenever any police officer finds a vehicle, attended or unattended standing upon any portion -2- {• - ~ • s ord. l0 , 1976 of a street or highway right of way within this municipality in such a manner as to constitute a violation of Article X, Section 5; Article XI, Section 1(1-5) and {10-13); and Article XI, Section 4, of this ordinance, or left unattended for a period of 2~ hours or more and presumed to be abandoned under the conditions prescribed by 42-4-1102 and 42--4-1103 C.R.S. 1973, as amended, such officer shall require such vehicle to be removed or cause the same to be removed and placed in storage in the nearest garage or other place of safety designated or maintained by this municipality. 5. Article XXII is hereby amended by the addition of Section 23, which shall read as follows: Penalty Assessment Schedule: The Penalty i assessment and the nature of the violation for which said penalty assessment may be made by the arresting officer and accepted and paid by the violator under the privileges of this section shall be as herein set forth, to-wit: SPEEDING (1-10 mph over speed limit) $10.00 (11-15 mph over speed limit) 15.00 (16-20 mph over speed limit) 35.00 SPECIAL HAZARDS 15.00 CARELESS DRIVING 15.00 ON WRONG SIDE OF STREET OR IMPROPER LANE 1.0.00 IMPROPER PASSING 10.00 FAILURE TO YIELD RIGHT OF' WAY l0.00 FAILURE TO STOP AT STOP SIGN 15.00 IMPROPER TURNING 14.00 FOLLOWING TOO CLOSELY 10.00 -3- ~~ ~~- -~ - Ord. 10 1976 FAILURE TO COCdPLY WITH INSPECTION LA[^I IMPROPER PARKING PARKING IN FROTIT OF FIRE PLUG PARKING TO IP~iPEDE NORMAL FLOW OF TRAFFTC IMPROPER EQUIPMENT (HORN, MUFFLER, REAR VISION MIRROR, WINDSHIELD WIPER, BRAKES, AND OTHERS) WRONG WAY ON A ONE-WAY STREET 5.oa 5.00 x.00 5. o0 5.00 10.00 The schedule defined and set forth in this section 23 hereof shall not apply to any violation of said ordinance which is tried in the municipal court. 6. Article XXIV, Section 1(a-b) is hereby deleted and reenacted to read as follows: The Traffic Violations Bureau is designated as a Bureau of the Police Department which shall 3 be in charge of its operation. The Traffic Vio- lations Bureau shall be open on such days and at such times as may be established by the Police Department. Section 2. Application of Ordinance. This ordinance and the Municipal Traffic Code shall apply to every street, alley, sidewalk or sidewalk area, driveway, park and to every public or private way and public parking area, whether within or outside the corporate limits of the Town, the use of which the Town has jurisdiction and authority to regulate. Section 3. Violations and Penalties Thereof. It shall be unlawful for any person to violate any of the provisions of the Municipal Traffic Code as adopted and amended herein, or of any provision of this ordinance, and any such violation shall be punishable as hereinbefore provided. Every person convicted of a violation of any provision of the Municipal Traffic Code or of any provision of this ordinance shall be punished by a fine of not more than three hundred --4- _ ~ - ti~ Ord. 10 , 1976 dollars ($30x.00) or by imprisonment for not more than ninety {9p) days, or by both such fine and imprisonment. Section 4. Filing Copies. After the effective date of the adoption of the Municipal Traffic Code, three copies certified to be true copies by the Mayor and the Town Clerk shall be filed in the Office of the Town Clerk where they shall be kept for public inspection during regular office hours while this ordinance is in force. Section 5. Repeal. This ordinance shall be in full farce and effect after its approval by the Town Council and final publication as pre- scribed by law, and shall supersede all previously adopted Municipal Traffic Codes as amended. Upon the effective date of this ordinance, the Town Council specifically repeals Ordinance No. 2, Series of 1972, provided, however, that nothing herein shall be construed or deemed to affect or prevent the prosecu- Lion or punishment of any person for any act done or committed ~` in violation of any ordinance, section or provision of any ordi- :~ nonce repealed or superseded by this ordinance. Section 6. Severability. Zt is the intention of the Town Council. that this ordinance or any part or provision thereof, shall be considered severable and, if any provision of this ordinance or the appli- cation thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared severable. Section 7. Effective Date.
