l~ ORDINANCE NO. {~~ Series of 1976 AN ORDINANCE RELATING TO THE INSTALLATION, CONSTRUCTIDN, AND MAINTENANCE OF ELECTRIC CONDUCTORS AND EQUIPMENT INSTALLED '~7TTHIN OR ON PUBLIC AND FRIVATE.BUTLDINGS AND OTHER PREMISES TO SAFEGUARD PERSONS AND BUILDINGS FROM HAZARDS ARISING FROM THE USE OF ELECTRICITY WITHIN THE TOWN OF VAIL, COLORADO; ADOPTING BY REFERENCE THERETO THE 1975 NATIONAL ELECTRIC CODE, OF THE NATIONAL FIRE PROTECTION ASSOCIATION; REPEALING ALL ORDINANCES OF THE TOWN OF VAIL, COLORADO, IN CONFLICT OR INCONSISTENT HEREWITH; Ar7D PROVIDING A PENALTY FOR VIOLATION OF THE PROVISIONS OF SAID NATIONAL ELECTRIC CODE WHEREAS, the Charter of the Town of Vail, Section 4.13, and the Statutes of the State of Colorado, provide that the National Electric Code may be adopted by reference with or without amendments; WHEREAS, the Town Council and the administration of the Town have made a thorough study of the 1975 National Electric Code; and WHEREAS, the Town Council finds that the adoption of the 1975 Edition of said code is necessary for the preser- vation of the property within the Town, the public's health, safety and welfare; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: (1} Pursuant to the Charter of the Town of Vail, and the Statutes of the State of Colorado, there is hereby adopted as the electrical code of the Town of Vail, by refer- ence thereto, the National Electric Code, 1975 Edition, pub- lished by the National Fire Protection Association, 470 Atlantic Avenue, Boston, Massachusetts, to have the same force and effect as if set forth herein in every particular. The subject matter of the National Electric Code includes com- prehensive provisions and standards regulating the installation, construction, and maintenance of electric conductors and equipment installed within or on public and private buildings ' ~ f r F~ Ord. 15 1976 Page 2 and other premises for the purpose of protecting the public health, safety, and general welfare. (2) Amendments and Deletions: (A) Article 90 is amended by the addition of Section 90--8 to read as follows Electrical permit fee; electrical inspec- tion fee; computation of electrical valuation. (a) An electrical permit fee shall be paid to the Building Official in accordance with the following schedule: Electrical Valuation ~'ee $0.01 to $5,000.00 $20.00 $5,000.01 to $50,000.00 $20.00 + $4.40 per $1,000.00 valuation or fraction thereof $50,000.01 to $500,000.00 $218.00 + $3.30 peat $1,000.00 valuation or fraction thereof $500,000.01 or above $1,485.00 f $2.20 per t $1,000.00 valuation or fraction thereof (b) An electrical inspection fee shall also be paid to the Building Official in accordance with the fallowing schedule: Electrical Valuation Eee $0.01 to $300.©0 $6.a0 $300.01 to $2,000.00 $8.00 $2,000,01 to $50,400.00 $4.00 per each $1,000.00 valuation or fraction thereof $50,000.01 to $500,000.00 $50.00 + $3.00 per each $1,000.00 valuation or fraction thereof $500,000.01 and above $550.00 + $2.00 per each $1,000.00 valuation or fraction thereof (c) Inspection fee far installation of temporary construction meter shall be $10.00, 1~ ~ ~. /~ Ord. 15, 1976 Page 3 {d} Computation of electrical valuation with respect to electrical permit fee and electric inspection fee. The electrical valuation shall be 9.0 per cent o.f the total structure valuation if the building requires conduit by the Code, or 5.Q per cent if the building does not require conduit by the Code, or the electrical contract price as substantiated by a copy of the contract if said contract is lower. (B} Section 331--4 is amended by the addition of the following subparagraph: Aluminum conductors smaller than No. 8 shall not be used within any structure. (C) Section 336-3 is amended by the addition of paragraphs (d), {e), (f), {g), and (h) to read as follows: (d) Structures less than 4 floors above grade which may be wired with either type of non-metallic sheated cable: 1. Condominium unit. 2. Apartment unit. 3. Efficiency dwelling unit. ~. Any other unit having kitchen facilities to be rented other than on a day-by--day basis. 5. 1 and 2 family dwelling structures. (e) Individual distribution panel required. Each individual unit referred to in subparagraph (d) of this section which is wired shall have an individual distribution panel specifically for and installed within said unit. (f) Wiring from main electrical source to individual unit. Electrical service from the main electric source of the building to each individual unit shall be wired in approved metallic conduit in buildings containing 5 or more dwelling or lodging units. {g) All commercial buildings and portions of buildings used for commercial purposes must be S ? t Ord. 15 1976 Page 4 wired in approved metallic conduit or approved P.V.C. conduit. (h) Horizontal runs of approved cable tray may be used in leiu of conduit. I (3) At least three (3) copies of the National Electric Code, 1975 Edition, of the National Fire Protection Association, all true and correct copies thereof, have been and now are on file in the off ice of the Town Clerk, and may be inspected by any interested person between the hours of 8:00 A.M. and 5:00 P.M., Monday through Friday, holidays excepted. The National Electric Cnde as finally adapted shall be available for sale to the public through the office of the Town Clerk. (4) Penalties: All penalty provisions in the National Electric Code, 1975, are hereby abrogated. A violation of any provision .- of the National Electric Code, 1975, which is adopted by this 3 ~ ordinance by reference shall be deemed a violation of the Town Code. Penalty therefore shall be as follows: Any person violating any provision of the Town Code of Vail shall be guilty of a misdemeanor and upon convic- tion thereof shall be punished by a fine not to exceed $300.00 or by imprisonment not to exceed 90 days or both, unless other- wise stated by any section of the Cade. Each and every day that any violation continues shall be considered a separate violation. (5) Severability: Tt is the intention of the Town Council that this ordinance or any part or provision hereof, shall be con- sidered severable, and if any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without .* ~ ~. 1, ~ i _~. Ord. 15 1976 Page 5 the invalid provision or application, to this end the provi- sions of this ordinance are declared severable. ~6) Repeal: Any or all ordinances or parts of ordinances of the Town of Vail in conflict or inconsistent herewith are hereby repealed, provided, however, that the repeal of any ordinance or parts of ordinances of the Town of Vail shall not revive any other section of any ordinance or ordinances heretofore repealed or superseded. ~7) Effective Date: This ordinance shall be in full force and effect after approval and Final publication as prescribed by the Charter of the Town of Vail. A public hearing shall be held on the 6th day of July, 1976, at 7:30 P.M., i.n the Council Chambers of the Municipal Building, Vail, Colorado.
