AN ORDINANCE RELATING TO THE USE OF THE
VAIL TRANSPORTATION CENTER; PROHIBI'1"ING
THE PARKING OF CERTAIN VEHICLES THEREIN;
PROHIBITING CERTAIN USES OF PARKING
PASSES FOR SAID CENTER; PROHIBITING THE
USE OF VEHICLES PARKED IN THE CENTEP. FOR
RESIDENTIAL PURPOSES; PROVIDING PENALTIES
THEREFOR; AND OTHER MATTERS IN RELATION
THERETO

WHEREAS, the Town has provided parking passes for
the Vail Transportation Center;
WHEREAS, improper use of season and other parking
passes will detrimentally affect the Town's revenues from the
facility and its efficient and orderly use by the residents
and visitors to the Town;
WHEREAS, the parking of vehicles towing other
vehicles or oversized vehicles interferes with the efficient
use of the facility; and
•
WHEREAS, the use of vehicles parked in the Center
for residential or living purposes and the carrying of tanks
for flammable materials such as propane create health, sani-
tation and fire hazards;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL
OF THE TOWN OF VAIL, COLORADO, THAT:
(1) Definitions .
(a) Vehicle - The term "vehicle" as used
herein shall be defined as provided in the Model
Traffic Code for Colorado municipalities as
adopted by the Town Council of the Town of Vail.
(2) Prohibited Activities.
(a) It shall be unlawful for any holder of
a Vail Transportation Center seasonal or other
parking pass to:
(i) Park or leave one or more vehicles
in the Vail Transportation Center and while

said vehicle or vehicles are in the Center
to use the parking pass to park another
vehicle in the Vail Transportation Center;
(ii) Lend or give a season parking
• pass or daily ticket to another person to
use the same to remove the vehicle previously
parked by that person in the Vail Transpor-
tation Center or paid lot.
(iii) Use a parking pass to remove the
vehicle of another from the Vail Transporta-
tion Center or paid lot that was previously
parked in the Center or lot without use of
a parking pass.
(b) No person may use a vehicle parked in the
Vail Transportation Center for residential purposes,
including but not limited to, cooking, sleeping,
eating, or other similar activities.
(c) No vehicle towing a trailer of any size,
other vehicle, or boat shall be parked in the Vail
Transportation Center.
(d) No vehicles exceeding 7'4" in height or
7' in width shall be parked in the Vail Transporta-
tion Center except in areas specifically designated
therefor.
(e) No vehicle carrying propane or other
flammable material in pressurized tanks shall be
parked in the Vail Transportation Center except
in areas designated therefor.
(3) Penalties.
A violation of this ordinance shall be punished
• by the revocation of the parking pass or the imposition of a
fine not to exceed $300.00 or both such revocation and fine.

(4) Severability.
If any part or parts of this ordinance are for
any reason held to be invalid, such decision shall not affect
the validity of the remaining portions of this ordinance. The
Town Council hereby declares that it would have passed this
ordinance and each section, sub-section, sentence, clause, or
phrase thereof, irrespective of the fact that any one or more
sections, sub-sections, sentences, clauses, or phrases may be
declared invalid.
(5) The Town Council finds that this ordinance is
necessary for the preservation of the public health, safety,
and welfare.
INTRODUCED, READ ON FIRST READING, APPROVED, AND
ORDERED PUBLISHED ONCE IN FULL, this 21st day of December,
1976. A public hearing shall be held hereon on the 4th day
of January, 1977, at the regular meeting of the Town Council
of the Town of Vail, Colorado, in the Municipal Building
of the Town.
