AN ORDINANCE AMENDING ORDINANCE NO. 12,
SERIES OF 1969, TO PROVIDE FOR THE
INFORMATION REQUIRED ON THE APPLICATION
FOR A TRANSIENT DEALER'S LICENSES LICENSE
FEE; SALES TAX DEPOSIT; LIMITING LICENSE
TO 14 DAYS; PROVIDING A PROCESS FOR
REVOCATION OF LICENSE; PROVIDING FOR
FAIRS, SHOWS AND EXHIBITIONS; AND SETTING
FORTH DETAILS IN RELATION THERETO
WHEREAS, with increased numbers of transient dealers,
there have been complaints to the Town Council concerning
questionable business practices, failure to pay sales tax
and Lack of proper supervision of such dealers;
WHEREAS, the Town Council is of the opinion that the
public interest would be served by the regulation, control and
supervision of transient selling and solicitation; and
WHEREAS, it is within the public health, safety and
welfare to adopt more stringent transient business regulations;
NOW, THEREFORE, BE IT ORDAINED BY THE TOL~TN COUNCIL OF
THE TOWN OF VAIL, COLORADO, THAT:
Section 1. Sections 4, 5 and 7 of Ordinance No. 12,
Series of 1969, are repealed and re-enacted to read as follows:
Section 4(a): Every person, before transacting any
business as a transient dealer or other activity described in
Section 2 of this ordinance, shall first procure from the Town
Clerk a license permitting him to engage in any of the selling
or soliciting activities referred to in this ordinance. This
License shall be referred to as a "Transient Dealer's License".
Section 4(b): This transient dealer's license sha11
be issued for a period of fourteen {14) days. Said license maylbe
renewed for successive periods of 14 days upon the payment of
the license fee for each such period.
Section 4{c): Applicants for a transient dealer's
License shall f i1e with the Town Clerk at least ten days prior
to the date upon which the applicant desires to begin his

business, a sworn application in writing on a form to be
furnished by the Clerk, which shall give the following infor-
mation:
(1) Name and physical description of the applicant;
{2) The permanent home address and full local
address of the applicant;
(3} A brief description of the nature of the business
and goods shown for sale ox for future delivery; including the
manufacturer, producer and supplier of said goods;
(4) If employed, the name, address and phone number
of the employer together with credentials establishing the
exact relationship between the employer and employee;
(5) The length of time far which the right to do
business is desired;
{{) Two (2) identical photographs of the applicant
which reasonably identify the applicant; such photographs to
measure two inches {2") by two inches (2");
(7) The fingerprints of the applicant;
(8) A statement taken by the Town Clerk or Chief of
Police as to whether or not the applicant has ever been con-
victed of any crime or misdemeanor, and if the applicant has
been so convicted, a statement as to the nature of the offense
and conviction;
(9) The particular manner and means by which he
intends to sell his goods or take his orders.
Section 4{d): At the time of the filing of the
application, ~ a license fee of Fifty Dollars ($50.00) shall be
paid to the Town Clerk to cover the cost of investigating the
facts stated herein and administrative costs.
Section ~ {e) : At the time of the filing of the
application, the applicant shall provide the Town Clerk an
estimate of his anticipated sales taxable in accordance with
the Town of Vail sales tax ordinance and shal3. deposit a sum
equal to 4~ of said amount with the Finance Department of the

Town of Vail provided, however, that said deposit shall not
be less than $100,00. Upon verification by the Town that the
licensee has paid the sales tax due the Town, the deposit shall
be returned to him. If the licensee fails to pay the Town's
sales taxes and seeks return of the deposit, within 90 days
from the expiration of the license, the Town Council may declare
the deposit forfeited and notify the licensee thereof at the
local address shown on the license.
Section 5. Upon receipt of such application, an
investigation shall be conducted at the direction of the Town
Clerk to determine the applicant's business and moral character.
(a) If, as a result of such investigation, the
applicant's character and business responsibility are found to
be unsatisfactory, the Town Clerk shall so endorse upon the
application and set forth the reasons therefor, and thereupon
shall notify the applicant of the disapproval of such application
and that no license will be issued thereunder.
(b) If, as a result of-such investigation, the appli-
cant's character and business responsibility are found satis-
factory, the Town Clerk shall endorse the same on the applica-
tion and upon receipt of the necessary fees as set forth here-
after, shall execute and deliver to the applicant a license
and permit to carry on such business within the corporate limits
of the Town for a period of time, not exceeding fourteen {14) davs.
{c} The license and permit so issued to a successful
applicant shall contain the signature of the Town Clerk, the
type of license or permit issued, the kind of goods to be sold
thereunder, the date of issuance, the expiration date thereof,
and a two inch by twa inch photograph of the applicant.
(d) Tf the Town Clerk refuses to issue a transient
dealer's license, the applicant may appeal said refusal to the
Town Manager.

Section 7: A transient dealer's license issued
hereunder may be revoked by the Town Council, after notice to
the licensee and a hearing at which the licensee may be heard,
for any of the following causes:
(a) Fraud, misrepresentation, or false statement
contained in the application of the license;
(b) Fraud, misrepresentation, or false statement
made in the course of carrying on his business as a transient
dealer;
(c) Any violation of this ordinance;
(d} Conviction of any crime or misdemeanor involving
moral turpitude; or
(e} Conducting. the business of a transient dealer
in an unlawful manner or in such a manner as to constitute a
breach of the peace, or to constitute a menace to the health,
safety or general welfare of the public.
Notice of the hearing for revocation of a license
sha11 be given in writing, setting forth spec ificall_y the grounds
of complaint and the time and place of hearing. Such notice
shall be mailed, postage prepaid, to the licensee at his local
address as set forth on the application, at least five (5) days
prior to the date set for the hearing.
Section 2. Section 10 of Ordinance No. 12, Series
of 1969, is repealed and reenacted to read as follows:
Section 10(a): A11 religious and charitable organ~.~-
zations shall be exempt from the license fee and the sales tax
deposit required by this ordinance, however, such organizations
must register with the Town Clerk prior to any solicitation
activities.
Section 14(b): Any fair, show or exhibition of arts,
crafts or similar handiwork which wi11 include more than 5
exhibitionists or merchants sha11 apply to the Town Council for
a Special Events license. Said application shall include the
name and local address of the sponsor, proposed duration, number

of exhibitions or merchants taking part in the fair, purpose
of the event, goods or types of goods to be sold, and a
statement as to whether or not the applicant or its agents
have ever been convicted of any crime ar misdemeanor and the
nature thereof.
At the time of the filing of the application, a fee
of Fifty Dollars ($50.00) shall be paid to the Town Clerk to
cover the cast of investigating the facts stated therein.
The Town Council may.impose conditions on the approval
of the Special Events license including required sanitation
and clean up measures, security measures, bond to guarantee
performance of the condition or to secure the payment of the
sales tax due to the Town.
Section 3, Severability.
Tf any part or parts of this ordinance are for any
reason held to be invalid, such decision sha11 not affect the
validity of the remaining portions of this ordinance, The Tawn
Council hereby declares that it would have passed this ordinance
and each section, sub-section, sentence, clause, or phrase
thereof, irrespective of the fact that any one or more sections,
sub--sections, sentences, clauses, or phrases may be declared
invalid.
Section 4. The Town Council finds that this ordinance
is necessary for the preservation of the public health, safety,
and welfare.
