AN ORDINANCE MAKING AMENDMENTS TO TITLE 9 OF THE
VAIL MUNICIPAL CODE AND PROVIDING FOR CERTAIN
PROHIBITED CONDUCT AND ACTIONS INCLUDING AIDING
AND ABETTING, RESISTING ARREST, QBSTRUCTING A
PEACE OFFICER OR FIREMAN, Ir~~PERSONATING AN OF-
FICER, ASSAULT AND BATTERY, REPORTING REQUIRED,
LARCENY, INDECENT EXPOSURE, UNLAWFUL ASSEMBLY,
DISORDERLY CONDUCT, CONDUCT PROHIBITED ON LIQUOR
LICENSED PREMISES, TUMULTUOUS AND VIOLENT CONDUCT,
HARASSA?ENT, CRIMINAL INS'URY TO PROPERTY, TRES-
PASSING, AND CONCEALED WEAPONS; A1~~NDING SECTIONS
6.04.190, 6.04.200, 6.04.210 AND 6.04.220 TO
PROHIBIT DOGS RUNNING-AT-LARGE WITHIN THE TOWN,
COMA4ERCIAL DISTRICTS OF THE TOWN, CONFINEMENT
OF FEMALE DOGS DURING ESTRUS, AND MAKING CERTAIN
DEFINITIONS; REPEALING CERTAIN SECTIONS; AND,
PROVIDING DETAILS IN RELATION TO THE FOREGOING.
WHEREAS, the Town Council is concerned that certain of the
ordinances of the Town are confusing and difficult to enforce; and,
WHEREAS, the people of the Tawn should be protected in their
property and their persons by the prohibition of certain acts; and,
WHE REAS, the Tocan Council wishes to clarify and strengthen
the ordinances of the Town, and specifically finds that the following
are necessary for the preservation and protection of the public health,
safety and welfare.
NOW,. THEREFORE, BE TT ORDAINED BY THE TQWN COUNCIL OF THE
TOri~1N OF VAIL, COLORADO, THAT:
The Vail Municipal Code shall be amended as follows:
Section 1. Section 9.08.010 is hereby repealed and re-
enacted to read as follows:
9.08.010. Aiding and Abetting.
It is unlawful for any person, with the intent
to promote or facilitate the commission of an
offense or violation of any provision of the
Town Code, to aid, abet, counsel, advise or
encourage any other person in planning or
committing such offense or violation.
Section 2. Section 9.i0.O10 is hereby repealed and re-
enacted to read as follows:
9.10.010. Resisting Arrest.
It is unlawful for any person within the Town
to intentionally prevent or attempt to prevent
any peace officer, acting under color of his
official authority, from effecting an arrest of
the person by the use or threat of physical force
or violence against the police officer or by the
use of any other means which creates a substantial
risk of causing physical injury to the peace officer.

Section 3. Chapter 9.10 of Title 9 is hereby amended by
the addition of a new Section 9.10.020, entitled "Obstructing a
Peace Officer ar Fireman", which shall. read as follows:
9.10.020. Obstructing a Peace Officer.
It is unlawful. for any person within the Town
to intentionally use or threaten to use violence,
force or physical interference to obstruct, impair
or hinder the enforcement of the provisions of this
Code or the preservation of the peace by a peace
officer acting under color of his official authority,
or intentionally obstruct, impair or hinder the prevention,
control, or abatement of fire by a fireman acting
under color of his official authority.
Section 4. Section 9.12.010 is hereby repealed and re-
enacted to read as follows:
9.12.010. Inpersonating an Officer
It is unlawful for any person to falsely pretend to be
a peace officer and perform an act in that pretended
capacity.
Section 5. Chapter 9.20, "Assault", is hereby amended by
the repeal of Sections 9.20.010, 9.20.020, 9.20.030 and 9.20.040 and
the adoption of two sections which shall read as follows:
9.20.010. Assault and Battery.
It is unlawful for a person to purposely,
knowingly or recklessly cause or attempt to
cause bodily injury to another person.
9.20.020. Reporting Required.
It is the duty of the owner ax manager of any
premises licensed by the Town to serve, sell or
dispense alcoholic beverages or fermented malt
beverages to report or cause to be reported to
the Town police department all incidents involving
violations of Section 9.20.010 occurring within or
upon their premises within twenty-four hours of such
incidents.
Section 6. Chapter 9.22, "Larceny, Fraud and Related
Offenses", is hereby amended by the repeal of Subsection A of
9.22.010, and the repeal of Sections 9.22.030, 9.22.040 and
9.22.080. Anew Subsection A of 9.22.010 is hereby adopted to
read as follows:
9.22.010. Definitions.
A. "Larceny" means to take or exercise control
over property of another having a value of less
than one hundred dollars, without authorization
or by threat or deception, and:
(1) With the intention to deprive the
owner permanently of the use or benefit
of such property; or

(2) To knowingly use, conceal or
abandon such property in a manner so as
to deprive the owner permanently of its
use or benefit; or
(3} To use, conceal or abandon such
property intending that such use,
concealment or abandonment will deprive
the owner permanently of its use and
benefit; or
(4) To demand any consideration for
which one is not legally entitled as a
condition of restoring such property
to the owner.
Section 7. Section 9.26.010 is hereby repealed and re-
enacted to read as follows:
9.26.010. Indecent Exposure.
It is unlawful for any person to intentionally
expose his genitals to the view of any person
under circumstances in which such conduct is likely
to cause affront or alarm to the other person.
Section $, Chapter 9.28, "Soliciting Drinks", and
9.30 "Prostitution", are hereby repealed and Chapter 9.28 is re-
enacted to read as follows:
9.28.010. Prohibited Conduct-Liquor Licensed Premises.
A, No licensee for the sale of spiritous, vinous or
malt beverages or 3,2~ beer shall install, maintain
or operate, or permit the installation, maintenance
or operation of, within or upon the licensed premises,
any gambling table, establishment, device, machine,
apparatus or other thing contrary to this ordinance
or to the laws of this state or which is kept,or
used for the purpose of gambling either directly
or indirectly. This ordinance shall not be construed
to prohibit the use of bona fide amusement devices
which do not and cannot be adjusted to pay anything
of value, and which may not be used for gambling,
directly or indirectly, and for the scoring, achieve-
ment, use or operation of which nn prize, reward
or thing of value is offered or paid by any person.
B. Each licensee shall conduct his establishment in a
decent, orderly and respectable manner, and shall
not permit within or upon the licensed premises
lewd or indecent displays, profanity, rowdiness,
undue noise, or other disturbance or activity
offensive to the senses of the average citizen, or
to the residents or the neighborhood in which the
establishment is located.
C. No licensee, manager or agent sha11 employ or permit
upon any liquor licensed premises, for consumption
on the premises any employee, waiter, waitress,
entertainer, host or hostess to mingle with patrons
and personally beg, procure, or solicit the purchase
or sale of drinks or beverages for the use of the

one begging, procuring or soliciting or for the use
of any other employee,
D. No licensee, manager or agent shall permit upon any
Liquor licensed premises for consumption an the premises
anyone to loiter in or about said premises for the
purpose of begging and soliciting any patron or
customer of, or visitor in, such premises to purchase
any drinks ar beverages of any type or nature what-
soever, for the one soliciting or begging.
E. No licensee for retail sale by the drink of spiritous,
vinous, or malt beverages or 3.2o beer shall permit
any person or persons to appear in a state of nudity
or simulated nudity within or upon the premises.
F. No licensee for retail sale by the drink of spiritous,
vinous, or malt beverages or 3.2~ beer shall permit
the showing of film, sti11 pictures, electronic re-
production, or other visual reproductions depicting
any act or live performance prohibited by this section.
G. Far purposes of this section (9.28) the following
definitions shall apply:
(1) "Lewd or Indecent Displays" sha11 mean performing
acts of or acts which simulate:
a. Sexual intercourse, masturbation, sodomy,
bestiality, oral copulation, flagellation
or any sexual acts which are prohibited
by law;
b. The touching, caressing or fondling an the
breast, buttocks, anus or genitals;
c. The displaying of the pubic hair, anus, vulva
or genitals;
d. The displaying of the post-pubertal human
female breast below a point immediately
above the top of the areola, or the display-
ing of the post-pubertal human female breast
where the nipple only or the nipple and areola
only are covered.
(2) "Nudity" shall mean the following:
"Nudity"means uncovered, or less than opaquely
covered, post-pubertal human genitals, pubic
areas, the post-pubertal human female breast
below a paint immediately above the top of the
areola, or the covered human male genitals in
a discernibly turgid state. Far purposes of
this definition, a female breast is considered
uncovered if the nipple only or the nipple and
the areola only are covered.
Section 9. Section 9.36.010 is hereby repealed and re-
enacted to read as follows:
9.36.010. Unlawful Assembly,
It i.s unlawful for two or more persons to assemble
together, or being assembled together, to act in
concert to commit, or conspire to commit, any
unlawful act.
Section 10. Section 9,38.010 is hereby repealed and re-
enacted to read as follows:

9.38.010. Disorderly Conduct.
It is unlawful far a person to intentionally,
knowingly or recklessly:
A. Make a coarse and obviously offensive
utterance in a public place, and the
language by its very utterance tends
to incite an immediate breach of the
peace; or
B. Make a coarse and offensive gesture or
display in a public place, and the
gesture or display tends to incite an
immediate breach of the peace; or
C. Fight with another in a public place,
except in an amateur or professional
contest of athletic skill; or
D. Make an unreasonable noise in a public
place or near a private residence that
he has no right to occupy,
Section 11. Sections 9.40.01.0, "Quarreling", and
9.40.020, "Tumultuous Manner", are hereby repealed. Anew
Section 9.40.010 is hereby adopted to read as follows:
9.40.010. Tumultuous and Violent Conduct.
Zt is unlawful for a person to participate
with two or more others in tumultuous and
violent conduct which creates grave danger
of damage or injury to property or persons
or substantially obstructs the performance
of any governmental function.
Section 12. Chapters 9.42, "Disturbing the Peace",
and 9.44, "Vagrancy", are hereby repealed, and Chapter 9.42,re-
enacted to read as follows:
9.42.010. Harassment.
(1} It shall be unlawful for a person to
intentionally harass, annoy or alarm
another person by:
a. insults, taunts or challenges to
another in a manner likely to provoke
a violent or disorderly response; or
b. following a person in or about a public
place; or
c. engaging in conduct or repeatedly com-
miting acts that alarm or seriously
annoy another person and that serve
no legitimate purpose; or
d. initiating communication with a person,
anonymously or otherwise by telephone,
in a manner intended to harass or
threaten bodily harm or property damage,
or making any comment, request, suggestion,
or proposal by telephone which is obscene; or
e. making a telephone call or causing a
telephone to ring repeatedly, whether
or not a conversation ensues, with na

legitimate conversation; or
f. making repeated communications at incon-
venient hours or in offensively coarse
language;
(2) As used in this section, unless the context
otherwise requires, "obscene" means a patently
offensive description of ultimate sexual acts.
or solicitation to commit ultimate sexual acts,
whether or not said ultimate sexual acts are
normal or perverted, actual or simulated, in-
cluding masturbation, cunnilingus, fellatio,
anilingus, or excretory functions.
(3) Any act prohibited by paragraph (e) of subsection
(1) of this section may be deemed to have occurred
or to have been committed at the place at which
the telephone call was either made or received.
Section 13. Chapter 9.46 "Malicious Injury to Property"
is hereby repealed and reenacted to read as follows:
9.46.414. Criminal Injury to Property
It is unlawful for any person intentionally to
injure, deface, mutilate, remove, pull down,
break, or in any way interfere with, molest,
desecrate or destroy any trees or real or
personal property belonging to or under control
of the Town or any person within the limits
of the Town.
Section 14. Section 9.48.010 is hereby repealed
and reenacted to read as~follows:
9.48.010. Trepassing.
It is unlawful far a person to enter upon any
property within the Town owned or occupied
by another without license or privilege to do
so, or to remain upon any such property after
having been requested to leave by the owner of
the property or by any person having charge
of the property.
Section 15. Section 9.56.010 is hereby repealed and
reenacted to read as follows:
9.56.010. Concealed ~~Teapon.
It is unlawful for any person, without legal
authority to da so, to wear under his clothes
or conceal about his person, or to display
in a threatening manner, any dangerous or
deadly weapon within the Town. A Town peace
officer is authorized and empowered to conduct
a limited search of a person for the purpose
of determining the existence of such a weapon
when he has reasonable grounds to believe
that the individual is armed and dangerous and
that such action is necessary in order to
protect himself or others. Any weapon so

found shall be confiscated and turned over to
the chief of police for disposition.
Section 16. Sections 6.04.190, 6.04.200, 4.04.210 and
6.04.220 are hereby repealed and reenacted to read as follows:
6.04.190. Running-at-Large-ComMercial Bistricts
A. Tt is unlawful for the owner, ar keeper of
a dog to permit his dog ,to run-at--large within
the commercial districts of the Town designated
as CCI, CC2 and CSC as shown on the official
zoning map of the Town.
B. A dog shall be deemed "running-at-large within
the commercial districts of the Town" when it
is off or away from the property or premises
of its owner ar keeper and is not on a leash
of not more than seven feet in length that is
held by a responsible person.
6.04.200. Running-at--Large Elsewhere.
A. zt is unlawful for t?~e owner ar keeper o.f a dog
to permit his dog to run-at-large within the
Town. This section applies to all areas of
the Town other than as specified in Section
6.04.190.
B. "Running at Large", as used in this section shall
be deemed to mean that the dog is not accompanied
by and under the reasonable control of its owner,
keeper or other responsible person.
C. A dog shall be deemed not under control when it
inflicts injury or damage to the person or
property of any person other than the dog`s
owner except in the defense of the owner, or
the owner's family or property.
6.04.210. Confinement During Estrus.
The owner or keeper of female dog, during its period
of Estrus shall securely confine the dog on the property
or premises of the owner or 'ceeper.
Section 17. If any part, section, subsection, sentence,
clause or phrase of this ordinance is for any reason held to be
invalid, such decision shall not affect the validity of the
remaining portions of this ordinance; and the Town Council hereby
declares it would have passed this ordinance, and each part, sec-
tion, subsection, sentence, clause or phrase thereof, regardless
of the fact that any one or more parts, sections, subsections,
' sentences, clauses or phrases be declared invalid.
Section 1$. The repeal or the repeal and reenactment
of any provision of the Vail x4unicipal Code as provided in this
ordinance sha11 not affect any right which has accrued, anv
duty ir.-bosed, any violation that occurred prior to the effective

date hereof, any prosecution commenced, nor any other action or
proceeding as commenced under or by virtue of the provision zepealed
or repealed and reenacted. The repeal of any provision hereby
shall not revive any provision or any ordinance previously re-
pealed or superseded unless expressly stated herein.
Section 19. The Town Council hereby finds, determines
and delcares that this ordinance is necessary and proper for the
health, safety and welfare of the Town of Vail and the inhabitants
thereof .
INTRODUCED, READ ON FTRST READING, APPROVED, AND ORDERED
PUBLISHED ONCE IN FULL this 6th day of September, 1977, and a
public hearing on this ordinance shall be held at the regular
meeting of the Town Council of the Town of Vail, Colorado, on the
20th day of September, 1.977, at 7:30 P.M., in the Municipal Building
of the Town.
