AN ORDINANCE REQUIRING THAT ALL NEW STRUCTURES
AND ALL PLUMBING PERMITS FOR ALTERATION C~IxTHIN
EXISTING STRUCTURES SHALL PROVIDE TIiAT ALL TANI:
TYPE WATER CLOSETS SHALL NOT EXCEED 3.5 GALLON
FLUSH CAPACITY; AND SETTING FORTH DETAILS
RELATING THERETO
WHEREAS, water is a limited natural resource in the
Gore Valley;
WHEREAS, water can be conserved by consumers in the
Gore Valley with the use of certain devices in plumbing fix-
tares; and
WHEREAS, it is in the public interest to conserve
water in the Gore Valley and for that reason, the Town Council
finds that the regulation of certain plumbing devices and fix--
tares is necessary to protect the public health, safety and
welfare;
NOW, THEREFORE, 3E IT ORDAINED BY THE TOWN COUNCIL
OF THE TOWN OF VAIL, COLORADO, THAT:
(1) PURPOSE: This ordinance is enacted by the Town
Council to encourage the preservation of the water resources of
the Gore Valley to reserve an adequate water supply to the,
citizens and visitors of the Town. It is intended that the
provisions of this ordinance shall apply to all pluzrtbing permits
issued for new structures and all plumbing permits for altera-
tions within existing structures, provided, however, all persons
in the Town are encouraged to change to plumbing fixtures that
comply with the terms of this ordinance for the conservation of
water,
(2) No plumbing permit shall be issued for a new
structure or alteration to an existing structure unless the

plumbing fixtures to be installed in accordance with the permit
comply with the following minimum standards:
A11 tank type water closets shall use not in
excess of three and five tenths {3.5) gallons
of water per flush.

Prior to issuing a plumbing permit, the Building
Official shall require proof that the plumbing fixtures meet
the above stated requirements.
(3) The Town Council finds that this ordinance is
necessary far the protection of the public health, safety,
and welfare.
(4) This ordinance shall become effective 30 days
from its adoption on second reading.
INTRODUCED, READ ON I'IRST READING, APPROVED, AND
ORDERED PUBLISHED ONCE IN FULL this 20th day of September,
1977, and a public hearing on this ordinance shall be held at
the regular meeting of the Town Council of the Town of Vail,
Colorado, on the 4th day of October, 1977, at 7:30 P.M, in the
Municipal Building of the Town.
