WHEREAS, there have been complaints made to the Town Council concerning the placement of trash, refuse and garbage on private property including privately main•- twined trash receptacles; WHEREAS, the Town Council is concerned about the control of trash, refuse and litter about the Town and desires to provide restrictions therefore; and, WHEREAS, the Town Council is of the opinion that this ordinance is necessary for tl~e protection of the health, safety and welfare of the residents and visitors to the Town of Vail; N(7W, THEREFORE, SE IT ORDAINED BY THE TO~~T COUNCIL OF THH TOWN OF VAIL, COLORADO THAT: SECTION 1, Section 8.16.120 of the Vail Municipal. Code is here- by repealed and reenacted to read as follows: Section 8.16.120 Littering of public and private property is prohibited. It is unlawful for any person to deposit, throw or leave any refuse on any public or pri- vate property or on any water or watercourse. (1) "Public or private property" as used in this section includes. but is not limited to, the right-of-wa_y of any road or highway, a body of water or watercourse, any park, vlay- ground, recreation area, building, ?parcel of property, (publically or privately owned), re- fuse container or receptacle provided for pri- vate use. (2) It shall be an affirmative defense that: (a) The property where the refuse was deposited, thrown or left in an area•desig- nated by law for the disposal of such refuse and the person is authorized by the proper public authority to so use the property; or, _,:' .... ~ ~ • _~- (b) The refuse is placed in a recep- tacle or container installed on such property for that purpose; and the person is authorized by the owner, provider, or maintainer of the receptacle or container to use the same; or (c) Such person is the owner or tenant in lawful possession of such property, or has obtained written consent of the owner in lawful possession or the act is done under the personal direction of said owner or tenant. (3) Whenever refuse is thrown, deposited, dropped or dumped from any motor vehicle in violation of this section the operator of said motor vehicle is presumed to have caused or permitted the refuse to be so thrown or depo- sited, dropped or dumped therefrom. SECTION 2. Tf any section, subsection, sentence, clause, phrase, part or portion of this ordinance is for any reason held in- valid or unconstitutional, such portion sha11 be deemed as a separate, distinct provision and such holding shall not affect the validity of the remaining portions hereof. The Town Council hereby declares that it would have adopted this ordi- nance and each section, subsection, sentence, clause, phrase, part or portion thereof, irrespective of the fact that any one or mare of the sections, subsections, sentences, clauses, phrases, parts or portions may be declared invalid or unconsti- tutional. SECTION 3. All offenses committed and all liabilities incurred under Section $.16.120 prior to the effective date of this ordinance shall be treated as though said section was in full force and effect for the purposes of sustaining any proper suit or prosecution with respect to such offenses and liabilities. SECTION 4. The Town Council finds that this ordinance is nece- sary for the protection of the public health, safety and wel- fare. ~ • • -3- INTRODUCED, READ AND ADOPTED ON FIRST READING this 20th day of September, 1977.
