HomeMy WebLinkAbout1977-28 Amending Special Development District 4 to Provide for the Area Thereof, Development Plan and Its Contents, Permitted Uses, Certain Accessory Uses, Density, Parking, Recreational Amentities Tax, Fireplaces, and Transportation_.~ • ~~V- .~ . f~ ~ - ~. ~ ..~ f:1 i ORDINANCE NO. 28 Series of 1477 AN ORDINANCE AMENDING SPECIAL DEVELOPMENT DISTRICT 4 TO PROVIDE FOR THE AREA THEREOF, DEVELOPMENT PLAN AND ITS CONTENTS, PERMITTED USES, CERTAIN ACCESSORY USES, DENSITY, PARKING, RECREATIONAL AMENTITIES TAX, FIREPLACES, AND TRANSPORTATION; AND SETTING FORTH DETAILS RELATING THERETO; AMENDING SPECIFIC PROVISIONS OF CHAPTER 18.46 OF THE__ VAIL MUNICIPAL CODE; AND At~4ENDING THE ZONING MAP WHEREAS, the Town Council has previously approved Special Development District 4 as contained in Chapter 18.46 of the Vail Municipal Cade; WHEREAS, application has been made for certain changes to SDD4; WHEREAS, the Town staff and the Planning Commission have considered said application and recommended approval thereof; and WHEREAS, the Town Council is of the opinion that said amendments should be made to SDD4; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: (1} Chapter 18.46 of the Vail Municipal Code is::amended as follows: (A) Subsection {B) of 18.46.424 is repealed and reenacted to read: B. The district shall consist of four separate 'development areas as identif ied on the map, consisting of the following approz~i- nnate sire: Development Areas Acreage Roads 4.7 A 16.82 ~ 4.40 TOTAL 80 C 29.10 ' D 1.8 Dedicated Open Space 40.4 {B) subsections {B) (3} ; (B} (4) ; (B) (7) ; and {B) (8) of 18.46.040 are repealed and reenacted to read: • • s ., Ordinance No. 2$ -2- B. 3. A conceptual site plan, at a scale not smaller than one inch equals fifty feet, showing the locations and dimensions of all buildings and structures with the exception of single-family and two-family structures uses therein and all principal site development fea- tures, such as landscaped areas, recreational facilit- ies, pedestrian plazas and walkways, service entries, driveways, and off-street and loading areas; 4. A conceptual landscape plan, at a scale not smaller than one inch equals fifty feet, showing existing landscape features to be retained or removed, anal showing, proposed landscaping and landscaped site development features, such as outdoor recreational facilities, bicycle paths, trails, pedestrian plazas and walkways, water features and other elements for each development area; 7. A volumetric model of the site and the proposed develop- ment, at a scale not smaller than one inch equals one hundred feet, portraying the scale and relationships of the proposed development to the site and illustrat- ing the form and mass of the proposed buildings for development areas A, B, and D. $. An architectural model of each proposed building at a scale deemed appropriate to the development by the zon- ing administrator portraying design details for each phase in development areas A, B, and D. (C) Section 18.46.050 is repealed and reenacted to read: 18.46.050 Permitted Uses. Single-family residential dwellings and two--family resi- dentiai dwellings shall be permitted uses in development area C. Two-family dwellings, residential cluster dwellings, and O~nance No . 2 8 Page 3 Multiple-family dwellings shall be permitted uses in develop- ment areas A and B. Professional offices and business offices, with a total. gross floor area not to exceed ten thousand square feet, shall be permitted use in development area-D. {D) Subsection (A) of 18.46.070 is amended by the addition of Subsection {3) to read: 3. Attached garages or carports, private green houses, swimming pools, tennis courts, patios, or other recreational facilities customarily incidental to permitted residential uses. (R) Section 18.46.080 is repealed and reenacted to read: 18.46.080 Density--Dwelling units. The number of dwelling units shall not exceed the following: Development Area A, Two hundred fifty-two units; (252) Development Area B, Sixty-five units; (65) Development Area C, One--Hundred Four units; (104) (F) Section 18.46.130 is repealed and reenacted to read: 18.46.130 Density-Floor area. The gross residential floor area of all buildings in each development area sha11 not exceed .35 GRFA in area A., 65,000 square feet GRFA in area B, and .25 GRFA for the first 15,000 sq. ft. of site area, plus not more than .10 GRFA shall be permitted for each sq. ft. of site area over 15x000 not to exceed 30,000 sq. ft. of site area, plus not more than .05 sq. ft. of GRFA for each sq. ft of site area over 30,000 sq. ft. in area C. On any site containing two duelling units, one of the units shall not exceed ane-third {1/3) of the allowable total gross residential floor area (GRFA). {G) Section 18.46.170 is repealed and reenacted to read: 18.46.170 Parking Off street parking shall be provided in accordance with Chapter 1$.52, except that seventy-five percent of the required parking in area A shall be located within the main building or buildings. in areas B and D, fifty percent of the required parking shall be located within the main building or buildings and hidden from public view or shall be completely hidden from ,• Ord No. Z8 Page 4 public view from adjoining properties within a landscaped berm. Onsite parking shall be provided in Development area A far common carriers providing charter service to the development. Bus parking shall be indicated on the development plan. Na parking or loading area sha11 be located in any required front setback area. If any portion of areas A and B is developed as an institutional or educational center, these limitations may be modified in accordance with amendment procedures specified in Sections 18.66.100 through 18.66.166. (H) Section 18.46.180 is repealed and reanacted to read: 18.46.180 Recreation amenities tax assessed The recreational amenities tax due for the development with SD4 under Chapter 3.Z0 shall be assessed at a rate not to exceed twenty five cents per square foot of the floor area in development A and at a rate not to exceed fifty cents per square foot of GRFA in development area B, and at a rate not to exceed f fifteen cents per square foot of GRFA in development area C; and at a rate not to exceed seventy-five cents per square foot in development area D; and shall be paid in conjunction with each construction phase prior to the issuance of building permit. (I) Section 18.46.190 is amended by the addition of subsection {C) to read: (C) if fireplaces are provided within the development they must be heat efficient through the use of glass enclosures and heat circulating devices as technology exists at the time of development. {J) Sub Section,A of 18.46.21Q is repealed and reanacted to read: A. Developer sha11 provide adequate private transportation services to the owners and guests of the development so as to ORD N0. 28 PAGE 5 transport them from the development to the village core area and Lionshead area as outlined in the approved development plan in the event development area A and or B are developed as an institutional or educational center. SECTION 2. If any part, section, subsection, sentance, clause of phrase of this ordinance is for any reason held to be invalid, such decision shall. not affect the validity of the remaining portions of this ordinance, and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentance, clause or phrase thereof, regardless of the fact that any ane or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. SECTION 3 The repeal. or the repeal and reanactment of any provision of the Vail Municipal Code as provided in this ordinance shall. not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under by virtue of the provision repealed or repealed and re~:nacted. The repeal. of any provision hereby sha11 nat revive any provision or any ordinance previously repealed or superseded unless expressly stated-herein.
