HomeMy WebLinkAbout1977-34 Amending Section 18.52.170 of the Vail Municipal Code to Allow for the Leasing of Private Parking Spacest ORDINANCE NO. ~ /_ Series of 1977 AN ORDINANCE AMENDING SECTION 18.52.170 OF THE VATL MUNICIPAL CODE TO ALLOW FOR THE LEASING OF PRIVATE PARKING SPACES; SETTING FORTH THE REQUIREMENTS AS TO WHO IS ELIGIBLE TO LEASE PRIVATE PARKING SPACES, NUMBER OF PARKING SPACES THAT CAN BE LEASED, LIMITATIONS ON THE TERM OF THE PARKING SPACE LEASE, REQUIRE- MENTS OF THE LESSOR TO SIGN AND OVERSEE THE LEASED SPACES, AND ZONE DISTRICTS TN WHICH PRIVATE SPACES CAN BE LEASED; SETTING FORTH REQUIREMENTS AS TO APPROVAL BY THE ZONING ADMINISTRATOR AND ISSUANCE OF A LEASING PERMIT; REQUIRING PARKING UTILIZATION STUDIES; AND, SETTING FORTH DETAILS IN RELATION TO THE FOREGOING. WHEREAS, Section 18.52.170 of the Vail Municipal Code prohibits the leasing of parking spaces; and WHEREAS, parking studies and considerations done by the Department of Community Development of the Town indicate that the leasing of private parking spaces may be desirable, and a proposed recommendation was submitted to the Planning Commission in accordance with the amendment procedures of Title 18 of the Vail Municipal Code; and, WHEREAS, after notice and public hearing the Planning Commission recommended to the Town Council that Title 18 be amended to allow for the leasing of private parking spaces under certain conditions and in certain areas; and, WHEREAS, the Town Council has received said recommen- dations, published notice of a public hearing, held a public hearing and thereafter finds that the leasing of private parking spaces would be in the interest of the public health, safety and welfare. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO THAT: Section 1. Section 18.52.170 is hereby repealed and reinacted to read as follows: 1$.52.170 LEASING OF PARKING SPACES. (a) No owner, occupant or building manager or ~ ~ ~ Page 2 their respective agent or representative, shall lease, rent, convey or restrict the use of any parking space, spaces or area to any person other than a tenant, occu- pant or user of the building for which the space, spaces or area are required to be provided by the zoning ordinances or regulations of the Town except as may be specifically provided in this Section. {b} Parking space, spaces or areas may be leased by the owner, occupant or building manager thereof in accordance with the following; (I) Any owner, occupant or building manager who owns, occupies or manages ten (10) or more private parking spaces located in Commercial Core 1, Commercial Core 2, High Density Multiple Family, Public Accommodations or Special Development zone districts and provides sufficient parking for use by employees may apply to the Zoning Administrator of the Town of Vail for a permit to lease private parking spaces. (2) Application shall be made on a form pro- vided by the Zoning Administrator and upon approval of the application by the Zoning Administrator a Leasing Permit shall be issued with or without condition as determined by the Zoning Administrator. (3) The Zoning Administrator may request that an applicant conduct a parking utlization study to determine the difference between the average capacity of the lot and the peak day utilization, and such other infor- mation as may be necessary for the proper consideration of the application. {4} The applicant shall submit with the appli- cation a proposed cease agreement to be reviewed by the Zoning Administrator. (5) The proposed lease agreement shall be for the period of not less than one month nor greater than ten (10} months from the effective date of this ordinance. (6) No applicant shall be permitted to lease more than twenty -five percent (25%) of the parking spaces which are the difference be- tween the average capacity of the lot and the peak day utilization as determined by the Zoning Administrator. (7) No applicant who is operating a private parking area charging an hourly fee therefor on the date of this ordinance shall ~ f ! page 3 be eligible for approval of his applica- tion. (8} Parking required for any use in accordance with this Title 18 may not be satisfied by the leasing of space from another person under the provisions of this Section 18. 52.170 (b). (9) It shall be the responsibility of the owner, occupant, or building manager who has leased spaces to others to provide adequate and proper signs therefor and to see that the leased spaces are used and occupied in accordance with the lease agreement. Section 2. All ordinances, acts, resolutions or parts thereof of the Town of Vail and in conflict with this ordinance are hereby repealed. This repealer or the specific repealer above shall not be construed to revive any ordinances, acts, orders, resolutions or part thereof heretofore repealed. Section 3. If any paragraph, clause or provision of this ordinance is judicially adjudged invalid or unenforceable, such judgment shall not affect, impair or invalidate the remaining' para- graphs, clauses or provisions hereof, and the Town Council specifi- cally states that its intention that various paragraphs, clauses or provisions hereof are severable. Section 4. The Town Council specifically finds that this ordinance is necessary for the public health, safety and welfare.
