HomeMy WebLinkAbout1978- 9 Emergency Ordinance Repealing and Reenacting Section 8.24.080 of the Vail Municipal Code "Ice and Snow Overhangs" to Provide That Property Owners are Prohibited from Allowing Dangerous Ice and Snow Overhangs or Snow Accumulationsci ~~ ., {~ ORDINANCE N0. ~~~ Series of 1978 AN EMERGENCY ORDINAP3CI; REPEALING AND REENACTING SECTIOI`d 8.24.080 OF TIIE VAIL MUNICIPAL CODE "ICE AND SNOW OVERHANGS" TO PROVIDE TFIAT PROPERTY OWNERS, MANAGERS, TENANT5 OR OCCUPANTS OF A BUILDING ARE PROHIBITED f'ROi"I ALLOWING DANGEROUS ICE AND SNOW OVER- HANGS OR SNOW ACCUP~IULATIONS ON BUILDINGS THAT WOULD BF A HAZARD TO THE PUBLIC; AND SETTING FORTH DETAILS RELATING THERETO WHEREAS, the existing Section 8.24.080 refers only to "propert_y owners", and many buildings in the Town of Vail are owned by absentee owners; WHEREAS, to have an enforceable ordinance, the manager or occupant of a building should have a duty to keep the build- ing free of dangerous ice and snow accumulations and overhangs; WHEREAS, because of the heavy snow fa11 this winter, there are a number of existing dangerous ice and snow overhangs that must be taken care of promptly and expeditiously to protect the public safety; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TO~~]N OF VAIL , COLORADO , THAT Section (1} Section 8.24.080 Ice and Snow Overhangs of the Vail Municipal Cade is repealed and reenacted to read as follows: 8.24.080 Ica and Snow Overhangs and Accumulations. (a) No owner, occu;~ant or manager of any real property or improvement thereon sha11 allow ar permit ice or snow to project or over- hang from any roof, ledge or other part of the structure or building owned, managed or occupied by him where the projection or overhang consti- tutes a hazard or reasonable possibility that the ice or snow projection or overhang (or water resulting therefrom} might fall, collapse or drop onto any sidewalk, street, alley, public way, park or any other publicly used way. (b) No owner, occupant or manager of any real property or improvement thereon shall allow or permit ice or snow to accumulate on the roof or any other part of the structure or building owned, occupied or ~:anaged by him tahere the accumulated ice or snow constitutes a hazard or reasonable possibility of sliding off the f ~ ~ i~ ~~ t Ord. page 2 building onto any sidewalk, street, alley, public way, park or any other publicly used way. Sectian (2} ~f any part, section, subsection, sen- tense, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Coun- cil hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section (3} The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or pro- seeding as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously re- pealed or superseded unless expressly stated herein. Section {4} The Town Council finds that this ordinance is necessary to protect the public health, safety and welfare and that this ordinance shall become effective as an emergency ordi- nance in accordance with Section 4.11 of the Charter of the Tawn of Vail. The emergency consists of the following: (a} The existing Section 8.24.080 provides for enforce- ment of ice and snow overhang prohibitions only against the pro- peaty owners; (b~ Many properties are owned by persons or entities that are not residents of or located in the Town of Vail; {.c} Therefore, enforcement is difficult,and voluntary compliance has been spotty and less than uniform; (d} The heavy snows of this year have created a num- ber of dangerous conditions as a result of ice and snow overhangs and accumlations; and t ~• f ~ !~~ r Ord.
