AN ORDINANCE REPEALING ANU REENACTIDTG
CHAPTER 2.24 OF THE VAIL MUNICIPAL CODE
RiLATING TO THE PLANNING COMMISSION;
THE REENACTMENT TO PROVIDE FOR THE
CREATION OF A PLANNING AND ENVIRONA'IEPdTAL
COP7t'IISS TON , MEi'~BERS IiIP , TER.M.S , REMOVAL ,
VACANCY, OFFICERS AND RULES OF PROCEDURE
FOR THE COMMISSION, AND THE nUNCTIONS OF
THE PLANNING AND ENVIRONMENTAL COMMISSION;
PROVIDING TI~AT ALL PRESENT MEARBERS OF THE
TOWN OF VAIL PLANNING COMMISSION SHALL
CONTINUE AS MEMBERS OF THE PLANNING AND
ENVIRONMENTAL COMMISSION; AND SETTING
FORTH DETAILS IN RELATION THERETO
WHEREAS, the existing Chapter 2.24 of the Vail Muni-
cipal Code does not comply with the Charter of the "'own of
Vail; and
WHEREAS, the Town Council is of the opinion that the
chapter should be brought into conformance with the Charter of
the Town of Vail and that the duties of the Planning Commission
be expanded to include those required by Section 8.4 "Environ-
mental Commission" of the Charter;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL
OF THE TOWN OF VAIL, COLORADO, THAT:
Section-l. Chapter 2.24 of the Vail Municipal Code
is hereby repealed and reenacted to read as follows:
Chapter 2.24
PLANNING AND ENVIRONMENTAL COMMISSION
2,24.010 CREATION - There is created by the
Town Council a "Planning and Environmental
Commission" in accordance with Section 8.3
and 8.4 of the Charter of the Town of Vail,
composed of seven members who shall act in
accordance with the Charter, this Chapter,
the direction of the Town Council and the
ordinances of the Town of Vail, and shall be
appointed and serve as provided in this Chapter.
2.24.020 MEMBERS - APPOI~3TMENT - TERMS - The
Planning Commission shall have seven ~riembers
appointed by the Town Council. A11 members
of the Commission shall be resident, qualified
electors of the Town of Vail, and if any mem-
ber ceases to reside in the Town, his member-
ship on the Commission shall immediately ter-
minate. All members of the Commission shall
serve without compensation unless otherwise
provided by the Town Council. All members of

the Town of Vail Planning Commission as of
the effective date of this ordinance, shall
continue as members of the Planning and
Environmental Commission until the expiration
of their term, their resignation, or removal.
The terms of the members of the Planning and
Environmental Commission shall be for four
years on an overlapping basis.

2.24.030 REMOVAL FROM OFFICE - Members appointed
by the Town Council may be removed by the Town
Council far inefficiency, neglect of_ duty,
failure to attend meetings, or malfeasance
in office. The notification of removal from
the Town Council sha11 state the reasons for
such removal.
2.24.040 VACANCTEB - Vacancies occuring on the
Plann~.ng and Environmental Commission by rea-
son of expiration of the term of the member,
removal, termination by operation of law, or
resignation, shall be filled by a majority
vote of the Town Council.
2.24.054 OFFICERS - MEETINGS - RULES -~ The Com-
missa.on shall elect its chairman from among
the members and shall fill such other offices
as it may determine. The term of the chairman
shall be far one year with eligibility for
reelection. The Commission shall hold at least
one regular meeting each month. It shall. adopt
rules for transaction of business and shall keep
a record of its resolutions, transactions, find-
ings and determinations, which record sha11 be
a public record kept in the office of the Town
Clerk.
2,24.060 FUNCTION OF THE COMMISSTO]`I _ The Plan-
ning and Environmental Commission shall have
the following functions and duties:
(a) To make and adopt a.Master Plan,
far approval by the Town Council, for the physi-
cal development of the Town, including any areas
outside its boundaries, subject to the approval
of the legislative or governing body having juris-
diction thereof, which in the Commission's judg-
ment bear relation to the planning of the Town.
the Plan, with the accompanying maps, olats,
charts, and descriptive matter, shall show the
Commission's recommendations for the development
of the subject territory.
(b) To review and recommend to the Town
Council a Zoning Ordinance with appropriate regu-
lotions, which may by specifically provided_or
required by ordinance of the Town of Vail.
{c) To review and recommend to. the Town
Council subdivision regulations as may be provided or
required by ordinance of the Tawn of Vail.
{d) To review and approve environmental
impact reports and mitigation measures as they
relate to the Zoning Ordinance.

(e} To review and comment on pro-
grams, studies of environmental issues for
the Town and the Gore Valley.

{f} To conduct research and appro-
priate studies of environmental issues for the
Town and the Gore Valley.
{g) To make recommendations to the
Town Cauncil for the control of pollution and
the protection of the environment.
(h) When data is obtained indicating
that State air and water pollution standards
have been violated, to advise the Cauncil of
the necessary and appropriate action.
(i) To be concerned and involved with
environmental issues for the entire Gore Valley
and to take the initiative to organize and
coordinate environmental studies and measures
necessary to protect the residents of Gore
Valley and Eagle County.
(j} To consider any other matters
pertaining the Commission as provided by law,
resolution, or ordinance, and to act in an
advisory capacity to the Town Council when so
requested, and to perform all other powers and
duties authorized and required by ordinance or
State law.
Section 2. Tf any part, section, subsection, sentence,
clause or phrase of this ordinance is far any reason held to be
invalid, such decision shall not affect the validity of the
remaining portions of this ordinance; and the Town Council hereby
declares that it would have passed this ordinance, and each part,
section, subsection, sentence, clause or phrase hereof regardless
of the fact that any one or more parts, sections, subsections,
sentences, clauses or phrases be declared invalid.
Section 3. The repeal or the repeal and reenactment
of any provision of Chapter 2.24 of the Vail Municipal Code as
provided in this ordinance shall not affect an_y right which has
accrued, any duty imposed, any violation that occurred prior to
the effective date hereof, or any other action or proceeding as
commenced under or by virtue of the provision repealed or repealed
and reenacted. Tt is the express intention of the Town Council
that all matters presently before the Planning Commission shall
not be interrupted and shall proceed as scheduled or directed.

Commission prior to the effective date of this ordinance shall
not be set aside, abrogated, or in any way invalidated by the
adoption of this ordinance. The repeal of any provision hereby
shall not revive any provision or any ordinance previously
repealed or superseded unless expressly stated herein.
Section 9:. All present members of the Planning Com--
mission shall continue as members of the Planning and Environ-
mental Commission after the effective date of this ordinance.
Section 5, The Town Council hereby finds, determines,
and declares that this ordinance is necessary and proper far
the health, safety and welfare of the Town of Vail and the
inhabitants thereof.

ORDERED PUBLISHED ONCE TN FULL, this 2l day of t~l~rr_h
1978, and a public hearing shall be held on this ordinance at
the regular meeting of the Town Council of the Town of Vail,
Colorado, on the 4thday of Aoril 1978, at 7:30
P.A'1. in the Municipal Building of the Town.
