1978-16 Amending Title 18 "Zoning" of the Vail Municipal Code to Provide General Amendments to the Hearing Procedures; Specifically, Providing A Definition of "Planning Commission"

({'~ Series of 1978 AN ORDINANCE AMENDING TITLE 18 "ZONING" OF THE VAIL MUNICIPAL CODE TO FROVIDE GENERAL AMENDMENTS TO THE HEARING PROCEDURES; SPECIFICALLY, PROVIDING A DEFINITION OF "PLANNTNG COMMISSION"; REQUIRING APPLICANTS TO SUBMIT THE NAMES OF ADJACENT PROPERTY OWNERS AND THE MAILING OF NOTICE THERETO, PROVIDING THAT THE PLANNING COMMISSION SHALL MAKE THE DECISIONS ON ENVIRONMENTAL IMPACT REPORTS, VARIANCES, AND CONDITIONAL USES AND THAT THE TOWN COUNCIL SHALL HEAR APPEALS FROM THOSE DECISIONS, PROVIDING THAT THE PLANNTNG COMMISSION SHALL HEAR APPEALS FROM THE ZONING ADMTNTSTRATOR'S DECISIONS ON HOME OCCUPATION PERMITS AND HORSE GRAZING PERMITS; AND, SETTING FORTH DETAILS IN RELATION TO THE FOREGOING WHEREAS, the existing Title 18 "Zoning" provides that the Town Council hear all manner of zoning decisions; WHEREAS, the Planning Commission has been consti- tuted by the Town Council to exercise expertise in the area of planning and zoning and that expertise and experience snoula be used for the making of final decisions; WHEREAS, the Town Council should hear only appeals from the decisions of the Design Review Board and Planning Commission; and WHEREAS, it is the opinion of the Town Council that this ordinance is for the public health, safety and welfare; NOGd, THEREFORE, BE TT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. There is hereby adopted a new Section 18.04.275 PLANNING COMMISSION: "Planning Commission" means the Planning and Environmental Commission ar Planning Commission as may be: constituted by ordinance of the Town Council. Section 2. Chapter 18.56 ENVIRONA~ENTAL IMPACT REPORTS is amended by the following: (a) Reference in Section 18.56.070 to the "Town Council" is amended to read the "Planning Commission". ` (~ ~ ~ 1 ' Ord. page Z (b) All references in Sections 18.56.100, 18.56.110 and 18.56.120 to the "Town Council" or "Council" are amended to read the "Planning Commission" or "Commission" as would be appropriate. (c) Anew Section 18.56.115 is hereby adopted to read as follows: 18.56.115 APPEAL TO THE TOWN COLTNCTL A. A decision of the Planning Commission may be appealed to the Town Council by the applicant, any aggrieved person, or the Town Manager at any time before the deci- sion becomes final. D. Within three (3) days following a decision by the Planning Commission, its decision to approve, disapprove, or recruest changes in the project shall be transmitted to the applicant. The decision shall became final if no written appeal is made to the Town Council within ten (10) clays following the decision of the Planning Commission. C. Not more than twenty-one (21} days follow- ing the filing of an appeal, the Town Council shall review the action of the Planning Com- mission. The Town Council shall confirm, modify or reverse the decision of the Plan- ing Commission within twenty-one (21) days following the filing of the appeal. If the Council finds that there is insufficient information to provide the basis for a sound decision, the Council may postpone final action for not more than thirty (30) addi- tional days. Failure of the Council to act within 21 days of the filing of the appeal or within the 30 additional days if the appeal has been continued by motion of the Council, shall be deemed approval by the Council of the report unless the applicant consents to a time extension. D. Any decision of the Town Council which results in the disapproval of the report shall specifically describe the basis upon which the disapproval was entered. Section 3. Sections 18.58.190 HOME OCCUPATION PERMITS and 18.5$.280 HORSE GRAZING PERMITS are amended by the changing of the "Town Council" or "Council" references therein to read "Planning Commission" or "Commission" as would be appropriate. Section ~4. Chapter 18.60 CONDITIONAL USE PERMIT is amended by the following: (a) There shall be added a new paragraph G to Section 1$.60.020 to read as follows: ,~ '. Ord. Page 3 G. A list of the owners of the properties within 300 feet in a Single-Family Resi- dential, Two-Family Residential, or Two- Family Primary/Secondary Residential Zone District; or adjacent to the subject pro- perty in all other zone districts. The owners list sha11 include the name of all owners, their addresses, and a general description of the property owned by each. Accompanying the list sha11 be stamped, addressed envelopes to each owner to be used far the mailing of the Notice of Hearing. (b) Subsection B of 18.60.050 is amended by changing the reference as to the procedure for the granting of variances from Chapter 18.50 to 18.62., (c) Section 18.6fl.070 is repealed and reenacted to read as follows: 18.60.070 APPEAL TO TOWN COUNCIL A. A decision of the Planning Commission may be appealed to the Town Council by the applicant, any aggrieved person, or the Town Manager at any time before the decision becomes final. B. Within three (3} days fallowing a decision by the Planning Commission, its decision to approve, disapprove, or request changes in the project shall be transmitted to the applicant. The decision shall become final if no written appeal is made to the Town Council within ten (10) days following the decision of the Planning Commission. C. Not ~ more than twenty--one (21} days follow- ing the filing of an appeal, the Town Council shall review the action of the Planning Com- mission. The Town Council shall confirm, modify or reverse the decision of the Plan- ning Commission within twenty-one (21} days following the filing of the appeal. If the Council finds that there is insufficient information to provide the basis for a sound decision, the Council nay postpone final action for not mare than thirty (3fl) additional days. Failure of the Council to act within 21 days of the filing of the appeal or within the 30 additional days if the appeal has been contin- ued by motion of the Council, shall be deemed approval by the Council of the conditional use permit unless the applicant consents to a time extension. D. Any decision of the Town Council which results in the disapproval of the conditional use per- mit shall specifically describe the basis upon which the disapproval was entered. {d) Section 18.60.080 is repealed and reenacted to read as follows: .~ 1 .. 1 Ord. Page 4 1.8.60.080 PERMIT - ISSETANCE AND EFFECT The Zoning Administrator shall issue a con- ditional use permit when action of the Plan- ning Commission becomes final, subject to such conditions as may be prescribed by the Commission. The permit shall lapse if can~- struction is not commenced within one year of the date of issuance and diligently pursued to completion, or if the use for which the permit is granted is not commenced within one year. Section 5. Chapter 18.52 VARIANCES is amended by the following: (a} There shall be hereby added a new paragraph F to 18.62.020 to read as follows: F. A list of the owners of the properties within 300 feet in a Single-Family Resi- dential, Two-Family Residential, ar Two- Family Primary/Secondary Residential Zone District; or adjacent to the subject pro- perty in all other zone districts. The owners list shall include the name of all owners, their addresses, and a general description of the property owned by each. Accompanying the list shall be stamped, addressed envelopes to each owner to be used for the mailing of the Notice of Hearing. {b) Section 1$.62.070 is repealed and reenacted to read as follows: 18.62.070 APPEAL TO THE TOWN COUNCIL A. Page 5 D. Any decision of the Town Council which results in the disapproval of the variance shall specifically describe the basis upon which the disapproval was entered. (c} Section 18.62.080 is repealed and reenacted to read as follows: 18.62.080 PERMTT ISSUANCE AND EFFECT The Zoning Administrator shall issue a variance permit when action of the Planning Commission becomes final, subject to such conditions as may be prescribed by the Commission. The permit shall Lapse if construction is not commenced within one year of the date of issuance and diligently pursued to completion. Section 6. Section 18.66.030 shall be amended by changing of the references therein to "Town Council" or "Council" to "Planning Commission" or "Commission" as would be appropriate. Section 7. Sections 18.66.070, 18.66.080 and 18.66.090(B) are repealed and reenacted to read as follows: 18.66.070 HEARINGS - SETTTNG DATE Upon the filing of an application, petition or appeal, the disposition of which requires a hear- ing before either the Planning Commission or the Town Council or both, pursuant to this title, a date for the hearing shall be set which shall be not more than thirty days from the date of filing of the application or receipt of the document. 18.66.080 HEARING - NOTTCE A. Nat less than fifteen (15} days prior to the date set for the hearing before the Planning Commission, the Zoning Administrator shall cause a copy of a notice of the time and place of the hearing to be published once in a news- paper of general circulation in the County. Yn addition thereto, the Zoning Administrator shall mail to property owners within 300 feet in a Single-Family Residential, Two-Family Residential, or Two--Family Primary/Secondary Residential Zone District; and to adjacent property owners in all other zone districts a copy of a notice of the time and place of the hearing, name of the appli- cant, a general description of the property indi- cating its location, a brief summary or explanation of the subject matter of the hearing, and a state- ment that the application or proposal is available in the Zoning Administrator's office during regular bus- iness hours for review or inspection by the public. Said notice shall be mailed by regular mail, postage pre-paid. B. Upon an appeal to the Town Council of any matter provided for herein, the above specified notice shall be mailed to property owners within 300 feet in a Single-Family Residential, Two-Family Residen- tial, or Two-Family Primary/Secondary Residential Zone District; and to adjacent property owners in all other none districts within seven (7) days of the filing of the appeal and publication shall be once no later than ten (10} days prior to the hear- ing date of the appeal, Ord. Page 6 18.66.090 HEARING _ EVIDENCE B. The Town Council shall base its detex'mina- tions upon statements contained in the application or petition, upon reports from the Tawn staff or consultants, if any, upon evidence submitted to the Plan- ning Commission and the recommendations or findings of the Commission, and upon evidence presented to the Council at the hearing. Section 8. Section 18.66.110 is amended by the repeal and reenactment of subsection (B) thereof to read as follows: B. A petition for amendment of the regulations or a change in district boundaries shall be filed on a farm to be prescribed by the Zoning Administrator. The petition shall include a summary of the proposed revision of the regulations, or a complete description of proposed changes in district boundaries and a map indicating the existing and pro- posed district boundaries. Tf the petition is for a change in district boundaries, the petition shall include a list of the owners of all properties within the boundaries of the area to be rezoned or changed, and the property adjacent thereto. The owners list shall include the name of all owners, their addresses, and a general description of the property owned by each. Accompanying the list shall be stamped, addressed envelopes to each owner to be used f'or the mailing of the Notice of Hearing. The petition also shall include such additional information as prescribed by the Zoning Administrator. Section 9. Tf any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remain- ing portions of this ordinance; and the Tawn Council hereby declares that it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase hereof regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 10. The repeal or the repeal and reenactment of any provision of Title 1$ of the Vail Municipal Code by this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, or any other action ar proceeding as commenced under or by virtue of the provisions repealed or repealed and reenacted. Tt is the express intention of the Town Council that all matters ..; ~ ~~ ~~ ..~.. ~ ~ ~ Ord. Page 7 presently before the Planning Commission shall not be inter- rupted and shall proceed as scheduled or directed_ Any duty, condition, ar requirement imposed by the Planning Commission or the Town Council prior to the effective date of this ordinance shall not be set aside, abrogated, or in any way invalidated by the adoption of this ordinance. The repeal of any provision hereby sha11 not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section 11. The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof.
