AN ORDINANCE AMENDING TITLE 6 OF THE VAIL
i`~NNICIPAL CODE RELATING TO DOGS; AMENDING
THE REFERENCES THEREIN FROM POLICE OFFICER
TO ANIMAL CONTROL OFFICER; AND AUTHORIZING
THE TOWN MANAGER TO APPOINT AN ANIMAL
CONTROL OFFICER AND ESTABLISH A POUND;
INCREASING THE FEES FOR IMPOUNDING AND
KEEPING DOGS IN VIOLATION OF THE ORDINANCE;
AUTHORIZING THE IMPOUNDMENT OF VICIOUS DOGS;.
DEFINING VICIOUS DOG AND PROHIBITING THE
SAME IN PUBLIC PLACES; PROHIBITING THE
KEEPING OF A BARKING AND HOWLING DOG; AND
INCREASING THE MINIMUM FINE SCHEDULE;
GRANTING TO THE MUNICIPAL COURT THE AUTHOR-
ITY TO ORDER THE DESTRUCTION OF ANIMALS
THAT ARE NUISANCES OR A REAL AND PRESENT
DANGER; AND SETTING FORTH DETAILS IN
RELATION TO THE FOREGOING
WHEREAS, the dog ordinances of the Town are deficient
in certain areas and to make mare efficient the implementation
and enforcement of the dog ordinances, certain changes should
be made; and
WHEREAS, the Town Council is of the opinion that the
dog ordinances can be improved by the adoption of certain changes,
and it would be in the public's health, safety and welfare to
make those changes;
NOW, THEREFORE, BE IT ORDAINED BY THE TOVJN COUNCIL OF
THE TOWN OF VAIL, COLORADO, THAT:
Section 1, There is hereby adopted a new Section
6.04.220 to read as follows:
6.04.220 DESIGNATION OF ANIMAL CONTROL OFFICER AND
POUND
(a) The Town Manager sha11 appoint at least one
animal control officer to perform such duties
as may be assigned to him by this article and
such other duties as may be assigned to him
from time to time by the Town Manager. The
animal control officer shall be Town personnel
unless the Town Manager, subject to the appro-
val of the Town Council, elects to contract with
a private person or organization to provide
animal. control officer services for and on
behalf of the Town.
(b) The Town Manager shall have the right to estab-
lish a dog pound for the Tawn to be operated by
Town personnel, or at his election he may, sub-
ject to the approval of.the Town Council, con-
tract with a private person or organization to
operate a dog pound for and on behalf of the
Town.

Section 2. section 6.04.230; 6.04.240 and 6.04.254
are repealed and reenacted to read as follows:
6.04.230 IMPOUNDMENT - T~]HEN - REGISTRATION
It is the duty of the animal control officer of
the Town to apprehend any stray dog or any dog
found running at large contrary to the provisions
of the code or not duly licensed or vaccinated as
required or any vicious dog and to impound such
dog in the Town pound or other suitable place
determined by the Town Manager. The poundmaster
or some other designated official upon receiving
any dog shall make a complete registry, entering
the breed, see and color of such dog, and whether
licensed. If licensed, he shall enter the name
and address of the owner and the date and number
of the dog tag.
6.04.240 IMPOUNDMENT - NOTICE -CHARGES
Not later than seven (7) days after the impounding
of a dog, the dog owner, if' known, shall be noti-
fied in a reasonable manner, or if the owner of
the dog is unkngwn or if the dog is a stray dog,
a notice shall be posted at one or more conspicuous
places in the Town for three {3) days describing
the dog and the place and time of taking. The
owner of the dog impounded may reclaim the dog
only upon payment of the license fee, if unpaid,
presentation of proof of vaccination as required,
and payment of all costs and charges incurred by
the Town far impounding and maintenance of the dog.
No employee or officer of the Town or the Town pound
shall release the dog to any owner without first
obtaining license for the dog, proof of vaccination
and payment for the impound fees and charges incurred.
The fallowing charges shall be paid to the Town pound
or other appropriate official designated by the Town
Manager for impounding any dog:
Far impounding $5.00
For keeping any dog 5.00 per day
For giving notice 3.00
The charges shall be in addition to any penalties
imposed on the dog owner pursuant to the provisions
of this Titie 6.
6.04,250 QUARANTINE - TERM -- EXAMINATION
A dog which is known to have bitten or injured any
person so as to cause abrasion of the skin or a dog
which, in the opinion of the member of the Police
Department of the Town of Vail, the animal control
officer, or a licensed veterinarian, appears to be
inflicted with rabies, .shall be closely confined by
the dag owner in accordance with the directions of
the appropriate officers of the Town of Vail or the
veterinarian, for a period of not less than ten (10)
days. Tf the dog dies while confined or impounded
as provided in this section, proper medical tests
shall be conducted at the expense of the dog owner
upon the dog to determine whether the animal was
suffering from rabies at the time of death.

OF IMPOUNDED OR QUARANTINED DOGS; and 6.04.290 QUARANTINE AND
DESTRUCTION OF RABID DOGS are amended by changing the references
to Police Department to Animal Control Officer.
Section 4. Section 6.04.300 is repealed and reenacted
to read as follows:
6.04.300 VICIOUS DOG
(a} It shall be unlawful for any person awning,
possessing or keeping custodial or supervis-
ory authority or control aver any vicious
dog, regardless of his intent, to permit,
cause or suffer any vicious dog to run at
large.
{b) For the purposes of this section., a vicious
dog is one that bites, growls, snaps or jumps
at a person upon any street, public way or
public place including private establishments
during such times that they are open to the
public, which has a known propensity to damage
property or attack or injure any person or
other animal. without provocation; provided,
however, that in order to convict any person
of a violation of this section, it shall not
be necessary to show that the person owning,
possessing, or keeping custodial control or
supervisory authority over a vicious dog, as
herein defined, has actual knowledge of the
viciousness of said animal.
(c} For purposes of this section, running at large
shall mean not being on a leash no longer than
seven {7) feet in length that is held by a
responsible person,
(d) In the event any dog is found to have bitten
persons twice, the doq shall. be permanently
removed from the Town by the animal control
officer or otherwise destroyed by the dog
owner or other agent appropriately designated
by the Town Manager.
Section 5. Section 6.04.320 is repealed and reenacted
to read as follows:
6.04.320 BARKING OR HOWLING DOGS
(a) It is unlawful for any person owning, possess-
ing or keeping custodial or supervisory author-
ity or control over any dog to permit such
dog by loud and persistant or habitual barking,
howling, yelping, or by making any other per--
sistant or habitual noise, to disturb, or tend
to disturb, the peace of any other person.
(b) Whenever a person is charged with a violation
of subsection (a) hereof, he shall not be con-
victed thereof unless he has, within the twelve
(12) month period immediately preceding the date

of the issuance of the summons and complaint
charging a violation of subsection (a) hereof,
received at least one warning by a police
officer or the animal control officer.
Section 6. Subsection 6.04.340(B) is repealed and
reenacted to read as follows:
6.04.340 VIOLATION - PENALTY
B. Every person convicted of a violation of Section
6.04.190, 6.04.200, 6.04.201, 6.04.300 shall
have a minimum fine, none of which can be sus-
pended, imposed against him according to the
following schedule:
First conviction $15.00
Second conviction 25.00
Third and each subsequent
conviction 50.00
In applying such schedule, the Municipal Court
shall consider the following:
(1) The above stated are minimum fines, and the
Court may impose a greater amount up to and
including the maximum;
(2) The date when the actual violation occurred
will. control. regardless of the date of the
conviction;
(3) The record of the violator for two (2} years
prior to the date of the current violation
shall be considered.
Section 7. There is hereby added a new Section 6.04.350
to read as follows:
6.04.350 POWER OF MUNICIPAL COURT
In addition to any penalties which may be provided
for in this Title for violation of any provision
hereof, the Municipal Judge shall have the authority,
upon making a finding that the dog constitutes a
nuisance or that the dog constitutes a real and
present danger to the citizens of the Town of Vail
to order that the dog be destroyed in a humane
fashion .
Section 8. The repeal or the repeal and reenactment of
any provision of the Vail Municipal Code as provided in this ordi-
nance shall not affect any right which has accrued, any duty
imposed, any violation that occurred prior to the effective date
hereof, any prosecution commenced, nor any other action or pro-
ceeding as commenced under or by virtue of the provision repealed
or repealed and reenacted. The repeal of any provision hereby
shall not revive any provision or any ordinance previously repealed
or superseded unless expressly stated herein.

Section. 9. If any part, section, subsection, sentence,
clause or phrase of this ordinance is for any reason held to be
invalid, such decision shall not affect the validity of the
remaining portions of this ordinance; and the Town Council hereby
declares it would have passed this ordinance, and each part, sec~-
Lion, subsection, sentence, clause or phrase thereof, regardless
of the fact that any one or more parts, sections, subsections,
sentences, clauses ar phrases be declared invalid.
Section 10. The Town Council hereby finds, determines
and declares that this ordinance is necessary and proper for the
health, safety and welfare of the Town of Vail and the inhabitants
thereof .
INTRODUCED, READ ON FIRST READING, APPROVED, AND
ORDERED PUBLISHED ONCE IN FULL, this 16th day of May, 1978, and
a public hearing on this ordinance shall be held at the regular
meeting of the Town Council of the Town of Vail, Colorado, on the
6th day of June, 1978, at 7:30 P.M. in the Municipal Building of
the Town.
