HomeMy WebLinkAbout1978-25 Amending Ordinance No. 14, Series of 1978, to Prohibit Vehicular Traffic Within the Pedestrian Mall Consisting of Gore Creek Drive from Willow Bridge Road East to the Easterly Boundary Line of Tract G, Vail Village Fifth Filing, and Bridge Street~" 4 NOT ADOPTED ORDINANCE NO. c~~' Series of 1978 AN ORDINANCE AMENDING ORDINANCE NO. 14, SERIES OF 1978, TO PROHIBIT VEHICULAR TRAFFIC WITHIN THE PEDESTRIAN MALL CONSISTING OF GORE CREEK DRIVE FROM WILLOW BRIDGE ROAD EAST TO THE EASTERLY BOUNDARY LINE OF TRACT G, VAIL VILLAGE FIFTH FILING, AND BRIDGE STREET; SETTING FORTH THE EXCEPTION5 THERETO; AND SETTING FORTH DETAILS IN RELATION THERETO WHEREAS, the pedestrian traffic in the pedestrian mall consisting of Gore Creek Drive from Willow Bridge Road east to the easterly boundary line of Tract G, Vail Village Fifth Filing, and Bridge Street has increased; WHEREAS, the heaviest time of pedestrian traffic in the Gore Creek Drive/Bridge Street pedestrian ma11 is over the lunch hour; WHEREAS, many restaurants adjacent to the Gore Creek Drive/Bridge Street pedestrian mall provide outdoor eating faci- lities for their patrons; WHEREAS, many residents and visitors of the Town enjoy sitting outside in the pedestrian mall area, particularly over the lunch hour; WHEREAS, the intrusion by cars and' trucks into the pedestrian mall, particularly over the lunch hour, creates hazar- dous situations for pedestrians and people using the mall; the noise and noxious emissions from cars and trucks create an unhealthy environment for eating and general enjoyment of the pedestrian ma11; and WHEREAS, the Town Council is of the opinion that it is in the public health, safety and welfare that vehicles be prohibited from the specified pedestrian mall from the hours of 11:00 a.m. to 2:00 p.m. each day except under certain specified circumstances; NOW, THEREFORE, BE IT ORDAINED BY THE TOL~TN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: V i ~~ f ~~ ~ • Ord. Subsection 3 (c) of Ord~.nance No. 14, Series of 1978, is hereby amended by the addition of a subsection 7 to read as follows: (7} From the hour of 11:00 a.m. to 2:00 p.m. on each day, all vehicular traffic shall be prohibited, provided, however, that vehicles may use the mall during the closed hours for the fallowing purposes: (i) to respond to Police, Fire or public emergencies; (ii} to provide necessary support for persons working within the mall area and there is no other reason- able alternative parking or access for the support vehicle; {iii) to make a delivery that is neces- sary for the supplying of a com- mercial enterprise in the ma11 area, when said delivery is required by an unforeseen circumstance, the delivery is necessary immediately, and there is no other reasonable alternative parking or access; (iv) to make a commercial delivery in the mall area that is necessary because of unforeseen circumstances relating to the delivery vehicle or delivery service, the delivery is necessary immediately, and there is no other reasonable alternative parking or access. (2} If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining por- tions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsec- tion, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. (3) The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof.
