HomeMy WebLinkAbout1978-30 Amending Title 18 of the Vail Municipal Code by the Amendment of Chapters 18.6, 18.62, and 18.66 ORDINANCE NO. ,~~ Series of 1978 AN ORDINANCE AP4ENDING TITLE 18 OF THE VAIL MUNICIPAL CODE BY THE AMENDMENT OF CHAPTERS 18.60, 18.62, and 18.66, PROVIDING FOR THE NOTIFICATION OF ' CONDOMINIUM MANAGERS, AGENTS, OR DIRECTORS OF CONDOMINIUM ASSOCIATIONS OF HEAF.INGS •~ BEFORE THE PLANNING AND ENVIRONMENTAL COMMISSION AND APPEALS TO THE TOWN COUNCIL; SPECIFYING THE PROCEDURE FOR NOTIFICATION AND THE PROPER PERSON OR AGENTS TO BE NOTIFIED; AND SETTING FORTH DETAILS IN RELATION TO THE FOREG`OTNG ~^7HEREAS, the Town Council deemed it necessary to notify property owners of proposed zone changes, variances and conditional uses in them' immediate vicinity; VdHEREAS, in certain districts in which condominiums are located, the administration of notifying all listed property owners of the condominium project has been administratively difficult; WHEREAS, the Planning and Environmental Commission recom- mended that notification of the authorized agent or individuals representing a condominium association is sufficient to meet the intent of the ordinance, and the Town Council agrees; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. Subsection G of 18.60.020 is amended by the addition of a sentence to read as follows: Notification of owners in a condominium project or development shall be satisfied by notifying the managing agent, registered agent, or any member of the Board of Directors of the condo- minium association. The applicants shall pro- vide this information on the owners' list required herein. Section 2. Section 18.52.020 is repealed and reenacted to read as follows: 18.62.020 Application - Information Required F. A list of the owners of the properties within 300 feet in a single-family residential, two-family residential, or two-family primary/secondary resi- dential zone district; or adjacent to the subject property in all other zoned districts. Provided, however, notifica- tion of owners within a condominium Ord. Page 2 project sha11 be satisfied by noti- fying the managing agent of the condominium project or the regis- tered agent or any membex' of the Board of Directors of a condominium assoc~.ation. The list of owners, managing agent, registered agent, or members of the Board of Directors, as appropriate sha11 include the name of the indi~riduals, their addresses, and the general description of the property owned or managed by each. Accompanying the list shall be stamped, addressed envelopes to each individual or agent to be notified to be used for the mailing of the Notice of Hearing. It will be the applicant's responsibility to provide this information and stamped, addressed envelopes. Section 3. Section 18.66.080 is repealed and reenacted to read as follows: 18.66.OS0 Hearing - Notice A. Not less than fifteen (15) days prior to the date set for the hearing before the Planning Commission, the Zoning Adminis- trator shall cause a copy of the Notice of the time and place of the hearing to be published once in a newspaper of general circulation in the county. In addition thereto, the Zoninq Administrator shall mail to property owners within 300 feet in a single--family residential, two- family residential, or two-family primary/ secondary residential zone district; and to adjacent property owners or the managing agent, registered agent, ar any member of the Board of Directors of adjacent condo- minium projects in other zone districts, a copy of a notice of the time and place of the hearing, name of the applicant, a general description of the property indicating its location, a brief summary or explanation of the subject matter of the hearing, and a statement that the application or proposal is available in the Zoning Administrator's office during regular business hours for review or inspec- tion by the public. Said notice shall be mailed by regular mail, postage prepaid. B. Upon an appeal to the Town Council of any matter provided for herein, the above specified notice shall be mailed to the property owners within 300 feet in a single- family residential, two-family residential, or two--family primary/secondary residential zone district; and to adjacent property owners ar the managing agent, registered agent, or any member of the Board of Direc- tors of the condominium project in all zone districts within seven (7) days of the filinq_ of the appeal and publication shall be once no later than ten (10) days prior to the hearing date of the appeal. .. .~, ~ ~ ~ ~ S a ~' v `~ Ord. Page 3 Section 4. xf any part, section, subsec~.ion, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the Validity of the remaining portions of this ordinance, and the Town Council hereby declares it would have passed this ordinance and each part, sec- tion, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses, or phrases be declared invalid.
