ORDINANCE NO. ~ AN ORDINANCE ADOPTING BY REFERENCE THE COLORADO 1140DEL ENERGY EFFICIENCY CONSTRUCTION AND RENOVATION STANDARDS FRO NONRESIDENTIAL BUILDINGS OF THE STATE OF COLORADO, REPEALING ALL ORDINANCES OF THE TOWN OF VAIL, COLORADO, TN CONFLICT OR INCONSISTENT THEREtiVITIi, AND PROVIDING A PENALTY FOR VIOLATION THEREOF. WHEREAS, Senate Bill No. 432, adopted by the Colorado General Assembly in 1977, requires each municipality which has a bua.lding code to adopt energy efficiency construction and renovation standards for non-residential buildings prior to July 1, 1978; and, Whereas, the Town of Vail has a building code; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO: Section 1. Adoption. Pursuant to Title 31, Article 16, Part 2, Colorado revised Statutes 1973, as amended, there is hereby adopted as the energy efficiency construction and renovation standards far residential and nonresidential buildings of the Town of Vail, by reference thereto, the Colorado Model Energy Efficiency Construction and Renovation Standards fox Nonresidential Buildings, adopted November, 1977, and published P:iarch, 1978 by the State of Colorado, Office of State Planning and Budgeting, Board of Energy Efficient Nonresidential Building Standards, 1525 Sherman Street, Denver, Colorado 80203, to have the same force and effect as is set forth herein in every particular. The subject matter of the adopted standards include comprehensive provisions and standards regulating energy efficiency in the design, construction, renovation, erection, enlarge- ment, alteration, repair, conversion, occupancy, equipment, and maintenance of certain nonresidential buildings and structures for the purpose of protecting the public health, safety and general welfare . Section 2. Amendments. The Colorado Model Energy Efficiency Construction and Renovation Standards for Nonresidential Buildings is hereby amended as follows: {a) Section 101.1 is deleted in its entirety, {b) Amended Section 103.0 is amended as follows: 103.0 Scope. This code sets forth the minimum requirements for design of new buildings and structures or portions thereof and additions to existing buildings that comply with the occupancy types listed below and axe designed primarily .for human occupancy, regulating their exterior envelopes r ~~- • Or~.A~ance No . ~ Page 2 ,• and selection of their H,V.A.C. Service, Water Heating, Electrical Distribution and Illuminating System and Equipment for effective use of energy: 1,} Occupancy types other than Type M, as defined in the Uniform Building Code, 1976 Edition. 2,) A11 buildings of over three stories used for apartments or other permanent residential purposes defined as occupancy type R-1, Uniform Building Code, 1976 Edition. 8.} All other buildings of any number of stories used far hotels, motels, or other transient residential purposes defined as occupancy Type R-1 Uniform Building Code, 1976 Edition Buildings shall be designed to comply with the requirements of either Sections 4,5,G, or Appendix B of this code. (c) A new Section 1.08.0 is added, to read: "108.0. Adminstrative and Appeal Procedures. Administrative and appeal procedures set forth in Sections 201, 202, and 204, and Chapter 3 of the Uniform Building Code, 1976 Edition, shall be applicable and followed in the administration of this Code." (d) Section 320.1 is amended by the inclusion of the following temperatures; "Winter Design Dry-Bulb -14aF F Summer Design Dry-Bulb 78 0 Summer Design Wet-Bulb E 59 Degree Days Heating 10,008 Degrees North Latitude 39 45' (e) Section 502.2(a), Table 5-l, is amended by the addition of .the follawing specific values: i • } O,rd~nance No. • 1 page 3 ~~ • ' "Walls, ~~~stories or Less, Heating, u0 not exceeding .2 Walls, 3 stories or less, Cooling, OTTV not exceeding 33.E ~Yalls, over 3 stories-; Iieating, u0 not exceeding .2S Walls, over 3 stories, Cooling, OTTV not exceeding 33.4 Roof/Ceiling, Heating or Cooling, u0 not exceeding .08 Floors aver unheated spaces, Heating, u0 not exceeding .08 Slab on Grade, Heating, minimum R Value ;.5 Solar Factor, Cooling, 126" {f) Section 'TO1.0 is amended by the addition of the following: "SMACNA refers to Sheet Metal Air Conditioning Contractors National Association. NESCA refers to National Environmental System Contractors Association." (g} Residential Appendix "A" is deleted in its entirety. (h) Residential Appendix "B" known as the Colorado Recommended Energy Conservation "Performance" Code for new-construction and renovation of residential buildings shall be included as part of this Code. Section 3. Code Copies. At least three copies of the Colorado Model Energy Efficiency Construcgion and Renovation Standards for Non- residential Buildings and of each secondary code adopted therein, all certified by the Mayor and the Vail Tawn Cler~~ to be true copies, have been and will continue to be on file in the office of the Vail Town Clerk, and may be inspected by any interested person between the hours of S a.m. and 5 p.m., Monday through Friday, holidays excepted, except that one copy of each code may be kept in the office of the chief en- forcement officer instead of the office of the clerk. The Colorado Model Energy Efficiency Construction and Renovation Standards far Nonresidential Buildings will be available for purchase by the public at a moderate price. Section 4. Penalties. It shall be unlavrful for any person, firm, or corporation to erect, construct, renovate, enlarge, alter, repair, improve, convert, equip, use, occupy, or maintain any building or structure in the Town, or cause to permit the same to be done, contrary to or in violation of any of the provisions of the Colorado Model Energy Efficiency Construction and Renovation Standards for Nonresidential Buildings. • ~~ ~ j • ~. t Ordinance N0. Page 4 Any person, firm, or corporation violating any of the provisions of the Colorado Tiodel Energy Efficiency Construction and Renovation Standards for Nonresidential Buildings or of this ordinance shall be punishable by a fine not exceeding three hundred dollars ($300) or imprisonment not exceed ninety (90) days or by both such fine and imprisonment. Each and every day or portion thereof during which any such violation is committdd, continued, or permitted, shall be considered a separate offense. Section 5. Severability Clause. Tf any part, section, sub- section, sentence, clause, or phrase of this ordinance or of the Colorado DTodel Energy Efficiency Construction and Renovation Standards for Nonresi- dential Buildings adopted hereby is for any reason held to be invalid; such invalidity shall not affect the validity of the remaining sections of the ordinance or of said standards; the Town Council hereby declares that it would have passed the ordinance and adopted such standards in each part, section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that one or more parts, sections, subsections, sentences, clauses, ar phrases be declared invalid. Section 6. Repeal. Any or all ordiances ar parts of ordinances of the Town of Vail, in conflict or inconsistent herewith, are hereby re- pealed; provided, however, that such repeal shall not affect any offense committed or act done, any penalty or forfeiture incurred or any contract, right, or obligation established prior to the time of such repeal. Section 7. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 8. There shall be a public hearing for the consideration of the adoption of the Colorado r.~ode1 Energy Efficiency Construction and Renovation Standards for Nonresidential Buildings, and of the Colorado Recommended Energy Conservation "Performance" Code for New Construction and Renovation and P~~sidential Buildings, by reference on the 7th day of November, 1978, at 7:30 p.m. in the Town Council Chambers, Municipal Building Vail, Colorado. The Town Clerk shall have Notice of that public hearing published in the Vail Trail on two occasions, the first not less than fifteen days prior to the public hearing and the second not less than eight days prior to the public hearing.
