Series of 1978 AN ORDINANCE FOR THE REGULATION OF TRAFFIC BY THE TOWN OF VAIL, COLORADO, FOR THE PURPOSE OF PROVIDING A SYSTEP'[ ~ OF TRAFFIC REGULATIONS CONSISTENT WITH STATE LAW AND GENERALLY CONFORMING TO SIMILAR REGULATTOrIS THROUGHOUT THE STATE AND THE NATION; ADOPTING BY REFERENCE THE 1.977 EDITION OF THE "MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES"; REPEALING ALL ORDI- NANCES IN CONFLICT THEREWITH; AND PROVIDING PENALTIES FOR VIOLATION THEREOF WHEREAS, the Town Council of the Town of Vail has previously adopted by reference the "Model Traffic Code for Colorado Municipalities", 1974 Edition, for the regulation of traffic within the Town of Vail; and WHEREAS, the Department of Highways for the State of Colorado has revised said "Model Traffic Code", and the Town Council of the Town of Vail deems it in the interest of the public safety and welfare to adopt such revised "Model Traffic Cade" in its revised form for the regulation of traffic within the Town of Vail; NOVd, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. Adoption by Reference. Pursuant to Chapter 31, Article 16, C.R.S. 1973, as amended, there is hereby adopted by reference Sections 1 to 26 inclusive, of the "Model Traffic Code for Colorado Municipalities", officially approved, adopted, and published in 1977 as such by the State Department of Highways, Denver, Colorado, and herein- after referred to as the "Municipal Traffic Code" of which three (3) copies are naw filed in the office of the Clerk of the Town of Vail, Colorado, and may be inspected during regular business hours, the same being adopted as if set out at length save and except the following articles and sections which are declared to be inapplicable to this municipality and are therefore expressly deleted. ` ~ f • Ord. Page 2 A. Deletions. 1. Article III, Sections 1 through ~ inclusive, relating to railroad crossings, are hereby deleted. 2. Article XIV, relating to parking meters, is hereby deleted in its entirety. 3. Article XVII, Sections 2 through 9 inclusive, and Section 17(a), relating to bicycle licensing and parking, are hereby deleted. 4. Article XVIII, Section 1{d), relating to travel on restricted public ways, is hereby deleted. B. Amendments. 1. Article IV, Section 1(b) is hereby amended as follows: {1) 1S miles per hour in any business district. (2) 15 miles per hour in any residential district. 2. Article XIII, Section 1, is hereby amended by changing the words, "and then only for a period not to exceed 3 minutes." to "and then only for a period not to exceed 10 minutes." 3. Article XVI, Section 7(b), is hereby amended by the addition of a sentence to read as follows: "The provisions of subsections 16-7(a) and 16-7(b) shall not apply on streets or rights- of-way designated by the Town of Vail as pedes- trian malls or areas." 4. Article XX, Section 13, shall be amended by adding the following subparagraph; (n) Any motorcycle and motorized bicycle shall be prohibited in areas designated by the Town as pedestrian malls or areas. 5. Article XXII is hereby amended by the addition of Section 23, which shall read as follows: Penalty Assessment Schedule: The Penalty assessment and the nature of the violation for which said penalty assessment may be made by t Ord. Page 3 ' the arresting officer and accepted and paid by the violator under the privileges of this Section shall be designated by the Municipal Judge, and a schedule thereof filed with the Traffic Violations Bureau, Vail Police Depart- ment, and the Traffic Engineer. Section 2. Application of Ordinance. This ordinance and the Municipal Traffic Code sha11 apply to every street, alley, sidewalk or sidewalk area, driveway, park and to every public or private way and public parking area, whether within ar outside the corporate limits of the Town, the use of which the Town has jurisdiction and authority to regulate. Section 3. Violations and Penalties Thereof. It shall be unlawful for any person to violate any of the provisions of the Municipal Traffic Code as adopted and amended herein, or of any provision of this ordinance, and any such viola- tion shall be punishable as hereinbefore pravided. Every person convicted of a violation of any provision of the Municipal Traffic Code or of any provision of this ordinance shall be punished by a fine of not more than three hundred dollars ($300.00} or by impri- sonment for not more than ninety (90} days, or by both such fine and imprisionment. Section 4. Filing Copies. After the effective date of the adoption of the Municipal Traffic Code, three copies certified to be true copies by the Mayor and the Town Clerk shall be filed in the Office of the Town Clerk where they shall be kept far public inspection during regular office hours while this ordinance is in farce. Section 5. Repeal. This ordinance shall be in full force and effect after its approval by the Town Council and final publication as pres- cribed by law, and shall supersede all previously adopted Muni- cipal Traffic Codes as amended. Upon the effective date of this ordinance, the Town Council specifically repeals Ordinance No. 10, Series of 1976, provided, however, that nothing herein sha11 be construed or deemed to affect ar prevent the prosecution or pun- ishment of any person for any act done or committed in violation of any ordinance, section or provision of any ordinance repealed or superseded by this ordinance. ~ • , ... . ~-~ ~ t ~ Ord. Page 4 Section 6. Severability. Tt is the intention of the Town Council that this ordinance or any part or provision thereof, shall be considered severable and, if any provision of this ordinance or the appli- cation thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared severable. Section 7. Public Hearing. There shall be a public hearing for the consideration of the adoption of the Model Traffic Cade for Colorado Municipal- ities by reference an the Sth day of December, 1978, at 7:30 P.M. in the Town Council Chambers, Municipal Building, Vail, Colorado.
