HomeMy WebLinkAbout1978-39 Amending Chapter 10.24 "Transportation Center" to Limit the Maximum Duration of Continuous Parking in the Vail Transportation Center to Fourteen Days r ~ ~~~ ., ~ ~~ ORDINANCE NO. ~-= t Series of 1978 AN ORDINANCE AMENDING CHAPTER 10.24 "TRANSPORTATION CENTER" TO LIMIT THE MAXIMUM DURATION OF CONTINUOUS PARKING IN THE VAIL TRANSPORTATION CENTER TO FOURTEEN DAYS; PROVIDING THAT VEHICLES LEFT IN THE VAIL TRANSPORTATION CENTER FOR PERIODS OF LONGER THAN FOURTEEN DAYS MAY BE IMPOUNDED AND DISPOSED OF IN ACCORDANCE WITH THE UNIFORM TRAFFIC CODE; AND SETTING FORTH DETAILS RELATING THERETO "~ 3 WHEREAS, it has been reported by the Vail Transporta-- tion Center Supervisor that there have been a number of cars left in the Center for extended periods of time; WHEREAS, the potential for lost revenue by people storing their vehicles in the Transportation Center is obvious; ;~ WHEREAS, the Transportation Center was not constructed for the storage of vehicles; and WHEREAS, it is the opinion of the Town Council that it is proper and within the intent of the purpose of the Vail Transportation Center that the period during which people may continuously park their vehicles in the Transportation Center should be limited; NOW, THEREFORE, BE IT ORDAINED BY THE TO~~]N COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. Chapter 10.24 of the Vail Municipal Code is amended by the addition of Section 10.24.025 to read as follows: 10.24.025 Storage Prohibited It is unlawful for any owner, operator, or other person having possession or control of a vehicle to store the same in the Vail Transportation Center. (a} A vehicle which has been parked for a con- tinuous period in the Vail Transportation Center without being removed from the Trans- portation Center far a period of more than fourteen (14} days shall be deemed to have been stored in the Transportation Center contrary to the provisions of this section. Any person removing his vehicle from the Transportation Center shall pay all accrued fees for parking in the Center, and failure to pay said fees shall be unlawful. Ord. Page 2 (b) If a vehicle has been left in the Vail Transportation Center for a period in excess of fourteen days without removal and payment of fees as required in sub- section {a} above, then the Vail Trans- portation Supervisor or a Police Officer of the Town of Vail, upon his request, shall cause the vehicle to be impounded in accordance with the provisions of the applicable Model Traffic Code as adopted by the Town of Vail. (c} Any vehicle impounded in accordance with subparagraph (b) above may be reclaimed by the owner thereof, upon payment of those costs imposed by the Model Traffic Code, and in addition thereto, the parking fees and charges incurred for parking in the Transportation Center. (d} The impoundment of a vehicle shall not be deemed an exclusive penalty but shall be in addition to any penalties that may be imposed in accordance with Section 10.24.030 of this Chapter. 3 Section 2. If any part, section, subsection, sentence, j .r clause or phrase of this ordinance is for any reason held to be .; invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regard- less of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 3. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof.
