AN ORDINANCE AMENDING CHAPTER 3.28 OF THE
VAIL MUNICIPAL CODE ENTITLED "POLICEMEN'S
~= PENSION FUND"; REPEALING SAID CHAPTER 3.28
AND REENACTING THE SAME TO PROVIDE FOR A
POLICEMEN'S PENSION FUND, PROVIDING FOR
A CONTRIBUTION BY THE TOWN TO THE PENSION
FUND, A CONTRIBUTION BY MEMBERS OF THE VAIL
POLICE DEPARTMENT TO THE PENSION FUND, AND
FOR A RETURN OF THE CONTRIBUTION MADE BY
MEMBERS OF THE POLICE DEPARTMENT TO THEM
UPON LEAVING THE VAIL POLICE DEPARTMENT;
PROVIDING DETAILS RELATING THERETO; AND
DECLARING AN EMERGENCY
WHEREAS, Chapter 3.28 of the Vail Municipal Code pro-
vides for a Policemen's Pension Fund in accordance with the
Statutes of the State of Colorado;
WHEREAS, the Statutes have been substantially amended
since the adoption of Chapter 3.28 and that Chapter needs to be
revised in accordance with the new statutes;
WHEREAS, it is the opinion of the Town Council that
the contribution of individual police officers to the Pension
Fund should be returned to them upon their leaving the Vail Police
Department; and
WHEREAS, the Town Council finds that this ordinance is
necessary for the protection of the public health, safety and
welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF
THE TOWN OF VAIL, COLORADO, THAT:
Section 1. Chapter 3.28 "Policemen's Pension Fund" is
hereby repealed and reenacted to read as follows:
POLICEMEN'S PENSION FUND
3.28.010 Authority
As authorized by the Statutes of the State
of Colorado, there is hereby created and
established a Policemen's Pension Fund to
be operated and maintained in accordance
with the Statutes as they presently exist
or may be amended in the future.
3.28.020 Board of Trustees
A Board of Trustees is established for the
local administration of the Police Pension
Fund as provided by State Statute. The

members of the Board shall be as pxovided
by the Statutes. The Board sha11 make all
necessary rules and regulations for manag-
ing and discharging its duties, shall
supervise the Town's and the police officers'
contributions to the Fund, shall hear and
decide all applications for relief or pen-
sions, and its actions on such contributions
and applications shall be final and conclu-
sive, except that when, in its opinion,
justice demands that the action should be
reconsidered, the same may be reversed by
the Board. A record of the action and all
other matters coming before the Board shall
be kept and preserved,
3.28.030 Town Contribution
The propex officers of the Tawn are authorized
to contribute from the general funds of the
Town a sum monthly that shall equal six percent
(60) of the monthly salaries of the total
Police Department of the Town. In November of
each subsequent year, the Town's contribution
shall be reviewed and increased or decreased
as nec~:ssary tp provide for a sound Pension
Fund.
3.28.040 Member Contributions
All members of the Police Department shall from
their respective monthly salaries contribute
into the Town's Policemen's Pension Fund six
percent (6%) of their respective monthly salar-
ies so that the contribution of the Police
Department as a whole shall match the contri-
bution of the Town, and the appropriate officers
of the Tom are authorized to make payroll deduc-
tions from the salaries and wage checks of all
policemen and members of the Police Department
in such amount. In November of each subsequent
year, the members' contributions shall be
reviewed and increased or decreased as necessary
to provide for a sound Pension Fund.
If any new policeman or member of the Police
Department has received the refund of his or
her contribution to a Policemen's Pension Fund
maintained by any Colorado municipality or
special district, where he or she was employed
next preceding his employment with the Town of
Vail, he shall deposit that amount with the
Town of Vail as a credit to his contribution
to the Town of Vail Policemen's Pension Fund.
3.2$.050 Refund
Any member of the Vail Police Department employed
by the Town of Vail on December 1, 1978, or
employed by the Town of Vail subsequent to Dec-
ember 1, 1978, shall be entitled to the refund
of any contribution he or she may have made to
the Policemen's Pension Fund either in the form
of a monthly deduction or an initial contribu-
tion of previously refunded pension funds, upon
the termination (voluntary or involuntary) of
that member of the Vail Police Department.

Section 2. If any part, section, subsection, sentence,
clause or phrase of this ordinance is for any reason held to be
invalid, such decision shall not affect the validity of the
remaining portions of this ordinance; and the Town Council
hereby declares it would have passed this ordinance, and each
part, section, subsection, sentence, clause or phrase thereof,
regardless of the fact that any one ar more parts, sections, sub-
sections, sentences, clauses or phrases be declared invalid.
Section 3. S.B. 46 (1978) of the Colorado General
Assembly relating to Policemen's and Firemen's Pension Funds,
requires that any change in existing plans be made before December
1, 1.978. Therefore, in order to insure that this ordinance is
effective, it is hereby adopted as an emergency measure, and it
shall become effective in accordance with the Charter of the Town
of Vail, as an emergency measure.
