AN ORDINANCE REZONING A PARCEL OF PROPERTY LOCATED
IN THE N2 NE4 OF SECTION 9, T5S, R80W OF' THE 6th
P.M. CONTAINING 5.2966 ACRES MORE OR LESS FROM
SPECIAL DISTRICT N0. 1 TO LOW DENSITY MULTI-FAMILY
(LDMF) WITH RESIDENTIAL CLUSTER (RC) DENSITY AND
TWO ADDITIONAL UNITS.
WHEREAS, Special Development District No. 1 (SDDl)
formerly the Sunburst Project has been dissolved and has had new
zone districts assigned to it; and
WHEREAS, this 5.2966 acre parcel was not given a new
zoning designation; and
WHEREAS, in accordance with Section 18.66.110 of the
Vail Municipal Code, a rezoning has been initiated by the town to
rezone the above-referenced parcel to LDMF with RC Density and two
additional units; and
WHEREAS, the Planning & Environmental Commission of the
Town of Vail has considered the same and recommended approval of
said rezoning to the Town Council; and
WHEREAS, the Town Council considers that it is in the
public interest to rezone said property;
`~ NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF
~ THE TOWN OF VAIL, THAT:
(1) The Council specifically finds that the procedures
' for the amendment of the Official Zoning Map and rezoning of properties
within the Town of Vail as prescribed in Section 18.66.110 of the
Vail Municipal Code have been fulfilled, and the Council hereby
receives the report and recommendation of the Planning & Environmental
Commission recommending the approval of the rezoning of the subject
property.
(2) Pursuant to Section 18.66.160 of the Vail Municipal
Code, the following described parcel is rezoned from SDDlto LDMF with
RC Density:
A portion of the North one-half of the Northeast one-
quarter of Section 9, Township 5 South, Range 80 West
of the Sixth Principal Meridian, Town of Vail, County
of Eagle, State of Colorado, more particularly described
as follows:

Commencing at the Southeast corner of the North one-half
of the North one-half of said Section 9; thence N89°23'41"
W 937.78 feet along the most Southerly limits of Vail
Valley Third Filing, is recorded in Book 259, Page 69
of the records of the Clerk and Recorder of Eagle
County, Colorado, to the Point of Beginning; thence contin-
uing N 89°23'41" W 808.30 along the Southerly limits of
the herein described parcel; thence due North 159.73 feet;
thence due East 68.71 feet; thence N 61°52'59" E 164.79
feet; thence N O1°52'59" E 88.67 feet; thence S 88°07'01"
E 396.39 feet; thence N 32°51'18" E 93.82 feet along a
radial line to a point on a curve; thence 69.00 feet
along the arc of a 108.87 foot radius curve to the left
whose central angle is 36°18'43" and whose long chord
bears S 75°18'03" E.67.85 feet; thence due South along a
non-radial line 143.48 feet, said line also being a Westerly
boundary of said Vail Valley Third Filing; thence N 88°
21'29" E 70.00 feet along the limits of said Vail Valley
Third Filing; thence S 02°02'30" E 241.80 feet along a
Westerly limit of said Vail Valley Third Filing to a point
on the most Southerly limits of said Vail Valley Third
Filing, said point being the point of Beginning. The
herein described parcel contains 230,718.5 square feet
or 5.2966 acres more or less.
(3) An additional two (2) units with a corresponding
percentage increase in GRFA (Gross Residential Floor Area) for
these units based on the developable acreage of the 5.2966 acre
parcel is hereby added to the allowable density due to a land trade
involving the Town of Vail.
(4) As provided in Section 18.08.030 of the Vail Municipal
Code, the Zoning Administrator is hereby directed to promptly modify
and amend the Official Zoning Map to indicate the rezoning specified
in paragraph (2) above.
(5) If any part, section, subsection, sentence, clause
or phrase of this ordinance is for any reason -held to be invalid,
such decision shall not affect the validity of the remaining portions
of this ordinance; and the Town Council hereby declares that it
would have passed this ordinance, and each part, section, subsection,
sentence, clause or phrase hereof regardless of the fact that any
one or more parts, sections, subsections, sentences, clauses or phrases
be declared invalid.
(6) The Town Council hereby finds that this ordinance is
necessary for the protection of the public health, safety and welfare.
INTRODUCED, READ ON FIRST READING, APPROVED AND
