AN ORDINANCE AMENDING CHAPTER 18.46 RELATING TO
SPECIAL DEVELOPMENT DISTRICT 4 OF TITLE 18
"ZONING", PROVIDING THAT DEVELOPMENT AREA D
ONLY NEEDS TO GO THROUGH DESIGN REVIEW PROCESS;
THAT NO ADDITIONAL ENVIRONMENTAL IMPACT REPORT
NEED BE SUBMITTED; THAT ARCHITECTURAL MODELS
FOR INDIVIDUAL BUILDINGS NOT BE REQUIRED; THAT
THE DEVELOPMENT PLANS BE APPROVED BY RESOLUTION
RATHER THAN ORDINANCE; SETTING FORTH DETAILS
IN RELATION TO THE FOREGOING; AND PROVIDING
A SEVERABILITY CLAUSE FOR THIS ORDINANCE.
WHEREAS, the Town Council has previously approved a

Special Development District 4; and
WHEREAS, the changes as proposed are primarily administra-
tive and generally simplify the review process; and
WHEREAS, the Town Council is of the opinion that the
proposed changes to Special Development District 4 are proper and
• would be in the best interest of public health, safety and welfare;
WHEREAS, the Planning & Environmental Commission has
reviewed the proposed amendments to Chapter 18.46 relating to
Special Development District 4 and have recommended approval of said
changes;
NOW, TFIEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF
THE TOWN OF VAIL, COLORADO, THAT:
Section 1. Paragraph B of Section 18.46.030 "DEVELOPMENT
PLAN-REQUIRED-APPROVAL PROCEDURE: is amended to read as follows:
18.46.030 (B) Each development area with the exception
of development area D shall be subject to a single
development plan. Development area D shall be required
only to go through the design review process.
' Section 2. Paragraph D of Section 18.46.030 "DEVELOPMENT
PLAN-REQUIRED-APPROVAL PROCEDURE" is amended to read as follows:
18.46.030 (D) Upon receipt of the proposed development
plan and planning & environmental commission report, the
town council shall determine whether the plan is accept-
able to the town in accordance with the applicable
provisions of Sections 18.66.150 and 18.66.160. This
determination by the town council shall be made through
its enactment of a resolution which incorporates the
development plan as an official Town of Vail document.
Section 3. Section 18.46.040 "DEVELOPMENT PLAN-CONTENTS"
is repealed and reenacted to read as follows:
18.46.040 DEVELOPMENT PLAN-CONTENTS
The proposed development plan shall include, but is not
limited to the following data:
A. A complete environmental impact report submitted in
accordance with Chapter 18.56.

B. Existing contours having contour intervals of not
more than five (5) feet if the average slope of
the site is twenty percent or less with contour
intervals of not more than ten (10) feet if the
average slope of the site is greater than twenty
percent. Existing and proposed contours after
grading for each phase.
C. A conceptual site plan, at a scale not smaller than
one inch equals fifty feet, showing the locations
and dimensions of all buildings and structures with
the exception of single-family and two-family structures,
uses therein, and all principal site development fea-
tures, such as landscaped areas, recreational facilities,
pedestrian plazas and walkways, service entries, drive-
ways, and off-street and loading areas.
D. A conceptual landscape plan, at a scale not smaller
than one inch equals fifty feet, showing existing
landscape features to be retained or removed, and
showing, proposed landscaping and landscaped site
development features such as outdoor recreational
facilities, bicycle paths, trails, pedestrian plazas
and walkways, water features and other elements.
E. Preliminary building sections and floor plans at a
scale not smaller than one inch equals twenty feet,
in sufficient detail to determine floor area, gross
residential floor area, general uses within the
buildings, and the general scale and appearance of
the proposed development for each development area.
F. A proposed plan of parking, loading, traffic circu-
lation, and transit facilities; and a proposed
program for satisfying traffic and transportation
needs generated by the project.
G. A volumetric model at a scale not smaller than one
inch equals fifty feet, portraying the scale and
relationships of the proposed development to the
site and illustrating the form and mass of the proposed
buildings for development areas A, B and D.
H. A proposed program indicating order of construction
phases, transportation facilities, and recreational
amenities.
I. A proposal regarding the dedication to the town or
private ownership and maintenance of that portion
of the development area within the one-hundred year
floodplain of Gore Creek. In the event the one-hundred
year floodplain is not dedicated to the town, such
lands shall be subject to a right of public access
to Gore Creek, and the right to use a portion of the
lands for a bicycle path, and for park purposes
• provided that the location and use of the facilities
and access shall be determined by mutual agreement
between the town and the owner of the development areas
involved.
Section 4. If any part, section, subsection, sentence,
clause or phrase of this ordinance is for any reason held to be
invalid, such decision shall not affect the validity of the remaining
portions of this ordinance; and the Town Council hereby declares
that it would have passed this ordinance, and each part, section,
subsection, sentence, clause or phrase hereof regardless of the
fact that any one or more parts, sections, subsections, sentences,
clauses or phrases be declared invalid.

Section 5. The Town Council hereby finds that this
ordinance is necessary for the protection of the public health,
safety and welfare.
INTRODUCED, READ ON FIRST READING, APPROVED AND
ORDERED PUBLISHED ONCE IN FULL, this 16 day of January ,
1979, and a public hearing on this ordinance shall be held at the
regular meeting of the Town Council of the Town of Vail, Colorado,
on the 6 day of Feburary , 1979 at 7:30 P.M. in the Municipal
Building of the Town.
