AN EMERGENCY ORDINANCE STATING THAT THE PORTION
OF HIGHWAY U.S. 6 FRONT EAST VAIL INTERCHANGE TO THE
TOWN OF VAIL BOUNDARY EAST OF THE INTERSECTION OF
MAIN GORE DRIVE AND U.S. 6 IS NECESSARY FOR USE
AS A PUBLIC HIGHWAY AND DESIGNATING THE SAME AS A
TOWN STREET; AND DECLARING AN EMERGENCY THERFORE.
WHEREAS, the State Highway Commission by Resolution
adopted November 15, 1978, abandoned that portion of Highway U.S.
6 from the East Vail Interchange east to Polk Creek in accordance
with C.R.S. 43-2-106 (1973); and
WHEREAS, in order to preserve the roadway for use by
the public, the Town is required to declare that the abandoned
roadway or any portion thereof, is necessary for the public's
use and thereby designating the same as a Town street;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF
THE TOWN OF VAIL, COLORADO, THAT:
Section 1. In accordance with C.R.S. 43-2-108 (1973)
The Town Council hereby declares that the portion of Highway U.S.
6 from the East Vail Interchange of Interstate 70 (#180) east to
Town of Vail boundary east of the intersection of 11~ain Gore Drive
and U.S. 6 (a distance of approximately 1.5 miles) is necessary
for the public's use.
Section 2. By the declaration of Section 1 above, the
abandoned portion of Highway U.S. 6 is designated as a Town street
and it shall be included in the Town's street system.
Section 3. The portion of the abandoned Highway U.S. 6
incorporated into the Town's street system shall be named Bighorn
Road.
Section 4. In accordance with C.R.S. 43-2-106 (1973)
this ordinance must be effective within 90 days of the abandonment
of the roadway by the State Highway Commission. The 90 day period
would expire on February 15, 1979. Therefore it is necessary that
this Ordinance be adopted by the Council as an emergency measure in
accordance with the Charter of the Town of Vail.
