HomeMy WebLinkAbout1979-21 Rezoning Two Parcels of Property Located in the SE 1/4 of Section 2, T5S, R80W, of the 6th P.M. the First From Residential Cluster to Public Use District and the Second from Residential Cluster to Medium Density Multiple Family Districtr • • ORDINANCE N0. ~ SERIES of 1979 AN ORDINANCE REZONING TWO PARCELS OF PROPERTY LOCATED IN THE SEA OF SECTION 2, T5S, R80W, OF THE 6TH P.M., THE FIRST DESCRIBED ON EXHIBIT A ATTACHED HERETO FROM RESIDENTIAL CLUSTER TO PUBLIC USE DISTRICT AND THE SECOND DESCRIBED ON EXHIBIT B ATTACHED HERETO FROM RESIDENTIAL CLUSTER TO MEDIUM DENSITY MULTIPLE FAMILY DISTRICT WITH A MAXIMUM OF 25 DWELLING UNITS PERMITTED ON THE REZONED PROPERTY, AND OTHER SPECIFIED CONDITIONS; AND, AMENDING THE OFFICIAL ZONING MAP IN RELATION THERETO. WHEREAS, on the official zoning map of the Town of Vail, Colorado, the subject property is currently zoned as Residential Cluster; WHEREAS, in accordance with Section 18.66.110 of the Vail Municipal Code, the Town of Vailh a sinitiated a rezoning of the subject property, requesting that the property described on Exihibit "A" attached hereto be rezoned from Residential Cluster to Public Use District, and the subject property described on Exhibit "B" attached hereto be rezoned from Residential Cluster to Medium Density Multiple Family District with certain specified conditions; WHEREAS, the Planning and Environmental Commission of the Town of Vail has considered the same and recommended approval of said application to the Town Council; WHEREAS, the Town Council considers it is in the Public interest to rezone said property; NOW, THEREFORE, BE ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. The Town Council specifically finds that the procedures for the amendment of the official Zoning Map and rezoning of properties within the Town of Vail as prescribed in Section 18.66.110 of the Vail Municipal Code had been fulfilled, and the Council hereby receives the report and recommendation of the Planning and Environmental Commission recommending the approval of the application for rezoning of the above specified property. Section 2. Pursuant to Section 18.66.160 of the Vail Municipal Code, the two parcels of property located in the SE$ of Section 2, T5S, R80W, of the 6th P.M., are rezoned as follows: ~~ . Ordinance No. 21 Page 2 (a) The subject property described on Exhibit "A" attached hereto and by this reference .made a part hereof is rezoned from Residential Cluster to Public Use District. (b) The subject property described on Exhibit "B" attached hereto and by this reference made a part hereof is rezoned from Residential Cluster to Medium Density Multiple Family provided, that said rezoning shall be upon the following conditions: (i) The maximum allowable density on the subject property shall be 25 dwelling units; (ii) At such time as the purchase money mortgage that that is payable by the Town of Vail for the benefit of E.F. Hutton and which encumbers the property is paid off, the property shall be automatically rezoned from Medium Density Multiple Family to Public Use. Section 3.
