HomeMy WebLinkAbout1979-35 Zoning Certain Parcels of Properties Known as the Gore Creek Water Treatment Plant, Bighorn Fire Station, Vail Fire Station, Vail Sewage Treatment Plant, And Others Designating Included Said Properties as Public Use Districtf~ ~ ~ ' ORDINANCE N0. 35 Series of 1979 AN ORDINANCE ZONING CERTAIN PARCELS OF PROPERTIES KNOWN AS THE GORE CREEK WATER TREATMENT PLANT, BIGHORN FIRE STATION, VAIL FIRE STATION, VAIL SEWAGE TREATMENT PLANT, LIONSRIDGE WATER TREATMENT PLANT, GORE VALLEY WATER TREATMENT PLANT AND WATER TANK, AND LIONSRIDGE WATER TREATMENT PLANT: ALL WITHIN THE TOWN OF VAIL; DESIGNATING SAID PROPERTIES AS PUBLIC USE DISTRICT; SETTING FORTH DETAILS RELATING THERETO; AND, AMENDING THE OFFICIAL ZONING MAP IN RELATION TO THE ANNEXED PROPERTY. a WHEREAS, the properties to be rezoned are all owned by public bodies and used for public purpose; and WHEREAS, the Town Council and the Planning Commission considered the appropriate zoning for the public property to be a Public Use District and certain recommendations, therefore, have been made; and WHEREAS, the Town Council considers it in the public interest to zone said property as a Public Use District; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, THAT: Section 1. Findings. The Town Council finds that the procedures for the rezoning of property in the Town of Vail have been ful- filled and the Town Council hereby receives the report of recommendation of the Planning and Environmental Commission recommending the rezoning of the property. Section 2. Pursuant to Chapter 18.66 of the Vail Municipal Code, the parcels of property known as the Gore Creek Water Treatment Plant, Bighorn Fire Station, Vail Fire Station, Vail Sewage Treatment Plant, Lionsridge Water Treatment Plant, Gore Valley Treatment Plant and Water Tank, and Lionsridge Water Treatment Plant; all within the Town of Vail, are rezoned to Public Use District. Section 3. As provided in the Ordinances of the Town of Vail, the Zoning Administrator is hereby directed to modify and amend the official map to include the zoning specified in paragraph two (2) above and in addition, to reflect the conditions ~ ~ Ordinance No. 35 adopted herein. Section 4. Page 2 If any part, section, subsection, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion of this ordinance; and the Town Council hereby declares that it would have passed this ordinance, and each t part, section, subsection, sentence, clause or phrase hereof regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 5. The Town Council hereby finds that this ordinance is necessary for the protection of the public health, safety, and welfare. INTRODUCED, READ ON FIRST READING, APPROVED AND ORDERED PUBLISHED ONCE IN FULL, this 21st day of August, 1979, and a public hearing on this ordinance shall be held at the regular meeting of the Town Council of the Town of Vail, Colorado, on the 4th of September, 1979 at ?:30 P.M., in the Municipal ,~ Building of the Town.
