I r l L ~ ~ ~'~ ORDINANCE N0. .~ Series of 1980 AN ORDINANCE MAKING AMENDMENTS TO TILE 9 OF THE VAIL MUNICIPAL CODE AND PROVIDING FOR THE APPEAL AND REENACTMENT OF SECTION 1.01.100 "VIOLATIONS AND PUNxSHMENT", MAKING VIOLATIONS OF PROVISIONS OF THE CODE, BY ANY PERSON UNDER THE AGE OF 18, EXCEPT xN THE CASE OF VIOLATIONS OF THE MODEL TRAFFIC CODE, PUNISHABLE BY A FINE OF NOT MORE THAN $300.00, AND PROVIDING DETAILS IN RELATION TO THE FOREGOING. WHEREAS, the Town Council believes that the public health, safety and welfare of the people of the Town of Vail would best be served if the Municipal Court could hear cases involving juvenile offenders; and WHEREAS, the Municipal Court pursuant to law can pnly hear cases involving juvenile offenders, except for traffic cases, if the violation of the provisions of the Code by juveniles is not punishable by a jail term. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: The Vail Municipal Code sha11 be amended as follows: Section 1. Section 1.01.100 is hereby repealed and reenacted to read as follows: 1.01.100 Violations and Punishment. It is unlawful for any person to violate any provision ar fail to comply with any of the requirements of this Code. Unless otherwise specifically provided, any person eighteen (18) years of age or older violating any provision of this Code by performing an act prohibited or declared to be unlawful. by this Cade or by failing to perform an act requried by or otherwise made mandatory by this Code shall be punished by a fine of not more than three hundred dollars {$300.00) or by incarceration not to exceed ninety (90) days or by both such fine and incarceration. Any person under eighteen {18) years of age convicted of violating any provision of this Code, except the provisions of the 14iadel Traffic Code as adopted by Section 1 .04.010 herein, may be "t finance No. r~~ ~ Page 2 ~.- r" ~ punished by a fine of not more than three hundred dollars {$300.00). Any person under the age of eighteen (18) years of age convicted of violating any provision of the Model Traffic Cade as adapted by Section 1.0.010 herein, may be punished by a fine of not more than three hundred dollars ($300.00) or by incarceration not to exceed ninety (90) days or by both, such fine and incarceration. Any such person shall be guilty of a separate offense for each and every day during any portion of which a violation of any provision of this Code is commited, continued, or permitted by such person and shall be punished accordingly. Zn addition to penalties provided in this section any condition caused or permitted to exist in violation of any provisions of this Code shall be deemed a public nuisance, and may be by this Town summarily abated as such, and each day that such condition continues shall be regarded as a new and separate offense. Section 2. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases to be declared invalid. Section 3. The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accured, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virture of the provision repealed or repealed and reenacted.
