Series of 1980 AN ORDINANCE AMENDING TITLE 9 OF THE VAIL MUNIC IPAL CODE AND h4AKING THE CONCEALMENT OF UNPURCHASED GOODS, WARES, OR MERCHANDISE PRIMA FACIA EVIDENCE OF THE INTENT TO COMMIT THE OFFENSE OF LARCENY. WHEREAS, it is the intent of the Town Council to strengthen the Town's larceny statute; and, WHEREAS, the property of the people of the Town of Vail should be protected by the prohibition of certain acts; and WHEREAS, the Town Council finds that the following amendment is necessary for the preservation and protection of the public health, safety, and welfaxe. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: The Vail Municipal Code shall be amended as follows: Section 1. Chapter 9.22 of Title 9 is hereby amended by the addition of a new section 9.22.030, entitled "Concealment of Goods", which shall read as follows: 9.22.030. Concealment of Goods If any person willfully conceal s,unpurchased goods, waxes, or merchandise owned ax held by and offered or displayed for sale by any store or any other merchantile establishment, whether the concealment be on his own person or otherwise and whether on or off the premises of said store or merchantile establishment, such concealment constitutes prima facia evidence that the person intended to commit the offense of larceny. Section 2. If any part, section, subsection, sentence, clause or phrase of this ordinance is fox any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares that it would have past this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be de- clared invalid. ~dinance No. r Page 2 • ~, - Section 3. The amendment of any provision of the Vail. Municipal Code as provided in this ordinance shall not affect any right which has accured, any duty imposed, any vinlatign that has occurred prior to the effective date hereof, and prosecution commenced, or any other action or proceeding as commenced under or by virture of the provision amended. ~ Section 4. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper :~ for the health, safety and welfare of the Town of Vail and the inhabitants thereof.
