AN ORDINANCE REZONING A PARCEL
COMMONLY REFERRED TO AS THE
GETTY OIL SITE, A 1.02 ACRE
UNPLATTED PIECE OF LAND IN
BIGHORN, FROM HEAVY SERVICE
(HS) TO LOW DENSITY MULTI-
FAMILY (LDMF) AND SETTING
FORTH DETAILS RELATED THERETO.
WHEREAS, in accordance with Section 18.8F.110
of the Vail Municipal Code, a rezoning has been re-
quested by Woodbridge Group, Inc. to rezone the Getty
Oil. Site from Heavy Service (HS) to Low Density Multi-
Family (LDMF); and,
WHEREAS, the applicant has agreed to a maximum of
eight units and 10,250 square feet of Gross Residential
Floor Area (GRFA}; and,
WHEREAS, the Planning and Environmental Commission
of the Town of Vail has considered the same and recommend--
ed approval of said rezoning to the Town Council; and,
WHEREAS, the Town Council considers that it is in
the public interest to rezone said property;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL
OF THE TOWN OF VAIL, THAT:
(1) The Council specifically fznds that the
procedures for the amendment of the Official Zoning Map
and rezoning of properties within the Town of Vail as
prescribed in Section 18.65.I10 of the Vail Municipal
Code have been fulfilled, and the Council hereby receives
the report and recommendation of the Planning and Environ-
mental Commission recommending the approval of the re-
zoning of the sub,~ect property.
(2) Pursuant to Section 18.66.150 of the Vaal
Municipal Code, the Getty Oil Sate is rezoned from
Heavy Service (HS) to Low Density Multi-Family {LDMF)
with a maximum of eight units two of which shall be
reserved for sale or lease by a resident/employee of
the Upper Eagle Valley and 10,250 square feet of Gross

Residential Floor Area (GRFA).
(3) As provided in Section 18.08.030 of the
Vaal Municipal Code, the Zoning Administrator is here-
by daxected to promptly modify and amend the Official
Zoning Map to indicate the rezoning specified in para-
graph (2) above.
(~) If any part, section, subsection, clause or
phrase of this ordinance is for any reason held to be
invalid, such decision shall not affect the validity
of the remaining portions of this ordinance; and the Town
Council hereby declares that it would have passed this
ordinance, and each part, section, subsection, sentence,
clause or phrase hereof regardless of the fact that any
one or more parts, sections, subsections, sentences,
clauses or phrases be declared invalid.
(5) The Town Council hereby finds that this ordinance
is necessary for the protection of the public health, safety,
and welfare.
INTRODUCED, READ ON FIRST READSNG, APPROVED AND
ORDERED PUBLISHED ONCE IN FULL, this 19th day of February,
1980, and a public hearing on this ordinance shall be heJ.d
at the regular meeting of the Town Council of the Town
of Vail, Colorado, on the 4th day of March, 1980 at 7:30 P.NI.
in the Municipal Building of the Town.

~, RESTRICTION RELATIVE TO 'l~~lL TWO EMPLOYEE UNITS ~
ON THE GETTY OzL SITE
Units and are subject
to the following restr~.ctions on sale, resale, lease
or sublease:
(1) The units shall be sold only to
qualified purchasers.
{2} If the units are leased or sublet they
shall be leased and sublet only to qualified purchasers
and said lease or sublease shall not be for a term of
less than ninety (90} days.
{3) A "qual~.fied purchaser" shall be a resident
of the Upper Eagle V~.l1ey which includes the Gore Valley,
Avon, M.inturn, Red Cliff, Gilman and Eagle/Nail, and a full-
time employee in the Upper Eagle Valley. "Full-time Employ-
ment" shall be deemed to mean employment of more than 30
hours per week. Members of the family of the employee
shall be exempt from this requirement.
{4) These restrictions shall be in full force
and effect for two years from the date of closing, at
which time they sha11 terminate.
{5) These covenants and restrictions relating
to units and shall run with the land and
be binding thereon and thep shall run z.n favor of the Town
of Vail which may enforce the provisions hereof.
