HomeMy WebLinkAbout1980-11 Amending Title 6 of the Vail Municipal Code by Requiring Dogs be on a Leash on Certain Specified Public Properties Within the Town of Vail • • • ~ + fir` L ORDINANCE~~ J. 11 ~r ~ Series of 1980 AN ORDINANCE AMENDING TITLE 6 OF THE VAIL MUNICIPAL CODE BY REQUIRING DOGS BE ON A LEASH ON CERTAIN SPECIFIED PUBLIC PROPERTIES WITHIN THE TOWN OF VAIL WHEN OFF THEIR OWNERS OR KEEPERS PREMISES AND SETTING FORTH DETAILS IN RELATION THERETO. WHEREAS, there have been numerous complaints concerning the dog problem within the Town of Vail; and WHEREAS, uncontrolled dogs have been responsible for frightening and annoying the citizens of the Town of Vaal and sometimes terrorizing small children; WHEREAS, it is the opinion of the Town Coucnil that all dogs within the Town should not be allowed to run at large on certain specified. pubic properties; WHEREAS, it would be in the public health, safety and welfare to prohibit dogs frown running at large on such property; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TO~'VN OF VAIL , COLORADO , THAT Section 1. Section F.04.190 A of the Vail Municipal Code is hereby repealed and reenacted to read as follows: 6.04.190 Running at Large A. It is unlawful for the owner or keeper of a dog to permit his dog to run at large within the area located within the Tawn, of Vail and described in Exhibit A attached hereto and made a part hereof. Section 2. If any part, section, subsections, sentence, clause or phrase of this ordinance is for any reason held to be .invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares that it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentence, clauses or phrases be declared invalid. • ~ • dinance No. 11 ~- ~, Page 2 i Section 3. The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, or any other action or proceeding as commenced under or by virture of the provision repealed ar repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any prdinance previously repealed ar superseded unless expressly stated herein. Section 4. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof.
